Popular Originalism, Thomas G. Donnelly Jan 2025

Popular Originalism, Thomas G. Donnelly

Law Faculty Publications

Scholars are obsessed with the Roberts Court’s recent turn to history and tradition. But another source of authority has also emerged as an important feature of the Roberts Court’s approach to constitutional cases. In previous work, I have referred to this source of authority as popular meaning. While original meaning identifies the best reading of the Constitution’s text at the time of its ratification, popular meaning draws on sources of authority outside the courts to capture the constitutional views of the American people today. In this Article, I demonstrate how interpreters might draw on the Constitution’s popular meaning to help …

A Crust Of Bread: Religious Resistance And The Fourteenth Amendment, Kurt T. Lash, Stephanie Hall Barclay Jan 2025

A Crust Of Bread: Religious Resistance And The Fourteenth Amendment, Kurt T. Lash, Stephanie Hall Barclay

Law Faculty Publications

In Employment Division v. Smith, the U.S. Supreme Court denied heightened constitutional protection to religiously motivated exercise burdened by neutral and generally applicable laws. The history presented in this Article suggests that the Smith approach conflicts with the original understanding of the Fourteenth Amendment. Out of the crucible of religious abolitionist resistance to the Fugitive Slave Act emerged a substantive theory of constitutional religious freedom: American citizens should have the right to obey the Biblical command to care for the needy and provide the hungry a "crust of bread," even if doing so was contrary to neutral and generally …

The Beleaguered Sovereign: Judicial Restraints On Public Enforcement, Luke P. Norris, Helen Hershkoff Jan 2025

The Beleaguered Sovereign: Judicial Restraints On Public Enforcement, Luke P. Norris, Helen Hershkoff

Law Faculty Publications

Looking back at the federal courts over the last generation, commentators will likely focus on their role in undermining the functioning of the regulatory state. Well-acknowledged in this story are Supreme Court decisions that have constrained administrative agencies under the newly minted “major questions” doctrine, as well as the Court’s blockbuster decision overruling the longstanding Chevron doctrine. The Court also has made it increasingly difficult for individuals—often workers and consumers, people of color, women, and those who live from paycheck to paycheck—to seek federal judicial redress for regulatory violations as private enforcers. And the Court has questioned whether certain private …

Sulfate Sources In Groundwater From An Agricultural Area Central Illinois, Christabel I. Obi Jan 2025

Sulfate Sources In Groundwater From An Agricultural Area Central Illinois, Christabel I. Obi

Theses and Dissertations

Increasing sulfate (SO42-) concentrations in the water environment, corresponding with increases in urbanization and industrialization, are a rising global concern. Over 250 mg/L, sulfate threatens human health and ecosystems. Elevated concentrations influence carbonate rock weathering, contributing to the evolution of the global carbon cycle. Knowledge of sulfate sources, whether natural or anthropogenic, is essential for understanding sulfate transport and fate in groundwater. This study investigates SO42- origin and transport in groundwater in an area dominated by agricultural land use in Mclean County, Illinois. Specifically, we explored these questions: 1) Do sulfate concentrations change with groundwater …

Secrets Of The Killing State: The Medical Professional Mandate, Corinna Barrett Lain Jan 2025

Secrets Of The Killing State: The Medical Professional Mandate, Corinna Barrett Lain

Law Faculty Publications

When New Jersey reinstated the death penalty in 1983, the state hadn’t conducted an execution in twenty years, so no one knew how to conduct an execution by lethal injection. Doctors at the state prison refused to participate, citing medical ethics that required them to “support life, not end it,” and that left prison officials thinking that they might have to conduct the executions themselves. “That is not an easy task for an amateur,” a reporter covering the quandary wrote. Unsure of what else do to, officials called upon Fred Leuchter, an engineer who had worked with a number of …

AI in Education: Teaching, Learning, and Thinking with Machines

This collection from the Humanities Research Center (HRC) Digital Technology in Education (DTE) working group arose from questions around how rapidly emerging generative AI tools are reshaping teaching and learning in K-12 and higher education. The contributions, loosely organized around ethics, policy, and practice, adopt a humanities lens to probe how generative AI and other emerging digital technologies impact human values, experiences, and social structures, surfacing their philosophical, ethical, cultural, and societal implications for schooling. From the perspectives of practitioners and interdisciplinary scholars, the pieces showcase various dimensions of AI's creative potential in education, while also questioning its limitations and …

Intraspecific Variation In Plant–Fungal Interactions Across Tidal Elevation In A Salt Marsh, Torrie Hanley, Catherine Gehring, Ron Deckert, Behzad Mortazavi, Christina Richards, A. Randall Hughes Jan 2025

Intraspecific Variation In Plant–Fungal Interactions Across Tidal Elevation In A Salt Marsh, Torrie Hanley, Catherine Gehring, Ron Deckert, Behzad Mortazavi, Christina Richards, A. Randall Hughes

Biology Faculty Publications

Interspecific interactions vary depending on environmental and genetic factors, with intraspecific variation potentially altering these relationships. Specifically, intraspecific variation within host plants and their endosymbionts may affect above- and belowground interactions depending on environmental conditions. We examined how intraspecific variation within the salt marsh foundation species Spartina alterniflora and a common fungal root endosymbiont (Lulworthia sp.) affected their interactions. We conducted a glasshouse experiment comparing interactions between Spartina growth forms (tall-form from low marsh and short-form from high marsh) and Lulworthia isolates from different marsh locations, and a laboratory experiment exposing Lulworthia isolates from both endpoints of a tidal elevation …

Comparing The Development And Viability Of Horseshoe Crab Eggs Laid In Beach And Salt Marsh Habitats, Daniel A. Sasson, Christopher C. Chabot, Jo-Marie Kasinak, Jennifer Mattei Ph.D., Elizabeth U. Scott, Fletcher K. Hall, Michael R. Kendrick Jan 2025

Comparing The Development And Viability Of Horseshoe Crab Eggs Laid In Beach And Salt Marsh Habitats, Daniel A. Sasson, Christopher C. Chabot, Jo-Marie Kasinak, Jennifer Mattei Ph.D., Elizabeth U. Scott, Fletcher K. Hall, Michael R. Kendrick

Biology Faculty Publications

The horseshoe crab, Limulus polyphemus, has recently been found to spawn regularly in salt marshes, despite the long-held assumption that salt marsh sediments are not conducive for embryonic development. Here, we tested the prediction that eggs laid in the salt marsh would develop more slowly and be less viable than eggs laid on beaches. We flagged the nests of spawning horseshoe crabs in the marshes and beaches of three states—South Carolina, Connecticut, and New Hampshire—and then excavated those nests one or three weeks later. We staged the excavated embryos to compare developmental progress between marshes and beaches. We found …

Attention's Loop: A Sculptor's Reverie On The Coexistence Of Substance And Spirit, Elizabeth King, Katherine Wetzel Jan 2025

Attention's Loop: A Sculptor's Reverie On The Coexistence Of Substance And Spirit, Elizabeth King, Katherine Wetzel

Attention's Loop

This is a book about attention and memory. I am a sculptor, so it is also a book about size, dirt, artifice, work, and eye. The text is a set of stories and interruptions that pile up to make a play of overlapping loops. My organizing principle is the image of the round-trip, so one may open the book and step into it at any point. Most of Katherine Wetzel’s photographs are of a single sculpture. It is a self-portrait, a particular kind of round-trip, and it is small: one-half life-size. Called Pupil, it is jointed and movable, and …

A Civil Rights Defense Of Gentrification, Carol Brown Jan 2025

A Civil Rights Defense Of Gentrification, Carol Brown

Law Faculty Publications

Scholars across disciplines such as sociology, economics, and urban planning are writing about gentrification. The literature and beliefs surrounding gentrification are very diverse, but what often connects the various views is a negative perception that gentrification always disadvantages and displaces low-income minority residents, physically or culturally. But the connotations of race and class associated with gentrification in the minds of many do not align with the empirical research and scholarly findings. Thus far in law, there is no thick legal account of gentrification and its legal or policy implications. Much of the legal writing is predicated upon an inaccurate conception …

Living The Good Life In The Anthropocene, Danielle Stokes Jan 2025

Living The Good Life In The Anthropocene, Danielle Stokes

Law Faculty Publications

The Stockholm Resilience Centre has concluded that the number of “planetary boundaries” we are crossing has increased from three in 2009, when the Centre’s researchers first introduced the concept, to six in 2023. Crossing these boundaries means humans are changing basic attributes of planetary systems to the point of risking the future of civilization. And the distinction between “safe” and “just” planetary boundaries raises questions regarding how to conceptualize the “good life.” In this latest in a biannual series of essays, members of the Environmental Law Collaborative explore conceptions of the “good” as well as the various elements necessary to …

Trust Law And The Tides Of Colonialism, Allison Anna Tait Jan 2025

Trust Law And The Tides Of Colonialism, Allison Anna Tait

Law Faculty Publications

Tethered to and inextricably linked with the absence or decline of democratic governance, there has always been empire. Empires rise and fall, as they say, but the imperial impulse is perennial and new iterations of old empires emerge with dismal regularity, showing us that imperial formations are hard to erase...

The Masterplot Of The Market, Allison Anna Tait, Luke Norris Jan 2025

The Masterplot Of The Market, Allison Anna Tait, Luke Norris

Law Faculty Publications

Stories about the family, work, and the market circulate in law, legal discourse, and beyond. The family, we are told by numerous authorities, is a non-market site, centred on emotional attachment rather than economic transaction. It is a site of interpersonal care, growth, and nurturance that acts as a counter to the excesses of an unbridled marketplace. The market, in contrast, is a site where autonomous beings contract, pursuing their interests efficiently and maximising wealth. This is one masterplot of the market, which, as it operates in the United States, constructs certain household members outside of the market and constructs …

The Resurgence Of Massive Resistance, Danielle Wingfield-Smith Jan 2025

The Resurgence Of Massive Resistance, Danielle Wingfield-Smith

Law Faculty Publications

“Massive Resistance” to equal access to good quality public education is resurging across the nation. First employed by segregationists in Virginia, Massive Resistance spread across the South to oppose school desegregation. This extreme push to suppress equitable education occurred most notably post-Brown. Although 2024 marked Brown’s seventieth anniversary, Massive Resistance is again surging. In fact, the last few years have witnessed increasing resistance to publicly funded education. Some areas where anti-public education resistance strategies have manifested include political rhetoric around Critical Race Theory, library censorship, and renewed parental rights debates.

To devise the most effective response to …

A Bounded Custom Gpt Structures Operational Knowledge For Small-Industry Decision Support, Ikhwan Arief, Alizar Hasan, Nilda Tri Putri, Hafiz Rahmann Jan 2025

A Bounded Custom Gpt Structures Operational Knowledge For Small-Industry Decision Support, Ikhwan Arief, Alizar Hasan, Nilda Tri Putri, Hafiz Rahmann

Knowledge Engineering and Data Science

Small manufacturing and craft-based firms increasingly use Generative Artificial Intelligence (GenAI) through public chat interfaces, low-cost tools, and informal experimentation. However, these firms often make operational decisions with incomplete records, tacit owner knowledge, fragmented spreadsheets, and limited managerial capacity. Under such conditions, open-ended chatbots may generate fluent but unsafe recommendations by overlooking missing information, contradictory evidence, feasibility constraints, and implementation constraints. This study presents Asisten Cerdas Industri Kecil as a bounded Custom GPT artifact for operational diagnosis, priority selection, and short-horizon action planning in small industries. Using a Design Science Research approach, the study develops a documented artifact corpus comprising …

From The Heart: Writing Love Poetry With Ai, Dan Ryan Jan 2025

From The Heart: Writing Love Poetry With Ai, Dan Ryan

Open Educational Resources

The chief reason our writing students turn to AI is not "laziness.” It’s fear. This lesson plan helps college students overcome their fear of a first-time poetry assignment by empowering them to partner with “collaborators”—first AI, then each other—to co-write a love poem before finally writing a poem on their own. This 4-hour lesson plan for a college-level Introductory Creative Writing course includes three low stakes drafting and revision assignments, and culminates in a high stakes poetry assignment.

The Tyranny Of Rockefeller Center: Architecture And Infrastructure In Greater New York, Joesph M. Watson Jan 2025

The Tyranny Of Rockefeller Center: Architecture And Infrastructure In Greater New York, Joesph M. Watson

Funded Scholarship

Rockefeller Center has long been described as a city in miniature. The project’s aspirations to completeness have been discussed in a variety of terms, but most critics and historians focus on the contrast between the project’s cohesive visual language and the more varied urban landscape surrounding it. This preoccupation has led to blind spots in received understanding of this well-known project. This article focuses on little-known infrastructural and housing projects—some built, others not—that carry the Center’s history from the heart of Manhattan to the margins of the metropolis. To ensure financial viability, these projects mostly sought to pull wealthy, white …

Contemporary Normative Values For Five Common Static Standing Tasks On Firm And Compliant Floor Surfaces In Children Two To Thirteen Years, Nancy Darr Jan 2025

Contemporary Normative Values For Five Common Static Standing Tasks On Firm And Compliant Floor Surfaces In Children Two To Thirteen Years, Nancy Darr

Funded Scholarship

Background/Objectives: Static upright tasks, including standing unsupported (SU), eyes closed (SEC), feet together (SFT), tandem (TS), and single limb (SLS), are routinely examined in children and are included in many norm-referenced measures. Existing normative values for these standing tasks may not apply to contemporary children and have not been established across wide age ranges. The primary purpose of this study was to investigate developmental trajectories of and relationships between four static standing positions (SPs [SU, SFT, TS, SLS]) in children aged 2 through 13 years who are developing typically. The effects of altered sensory input, including floor surface (firm and …

Repositioning Antimalarial Drugs As Anticancer Agents: Focus On Tafenoquine, Chris Barton Jan 2025

Repositioning Antimalarial Drugs As Anticancer Agents: Focus On Tafenoquine, Chris Barton

Funded Scholarship

Due to the expensive and lengthy process of drug design and approval, drug repurposing (or repositioning) has become another option for identifying preexisting molecules that may be used for alternative purposes. Recently, some antimalarial compounds have been shown to display efficacy against cancer cell proliferation. In this study, we provide evidence to suggest that multiple preexisting antimalarial drugs can reduce the viability of human cancer cells in culture. Furthermore, we provide the first evidence that one antimalarial, Tafenoquine (LD50 = 9.6 μM in HCT116 cells), is capable of decreasing viability with an efficacy comparable to Etoposide (LD50 = 15.2 μM …

Alternative Grading Approaches In Health Professions Education: A Scoping Review Protocol, Elena Wong Espiritu, Aine O'Connor, Sara Blass, Kathryn Lewis, Angela Shelton Clauson Jan 2025

Alternative Grading Approaches In Health Professions Education: A Scoping Review Protocol, Elena Wong Espiritu, Aine O'Connor, Sara Blass, Kathryn Lewis, Angela Shelton Clauson

Funded Scholarship

Objective: The objective of this scoping review is to map the existing literature on alternative grading approaches in health professions education and how these approaches are implemented.

Introduction: Although traditional alphanumerical tiered grading methods are widely used in health professions education, this approach is typically insufficient in providing descriptive feedback, allowing formative assessment, and promoting deeper learning and clinical application. Alternative grading approaches, including competency based assessment, pass-fail grading, ungrading, specifications grading, and others, are increasingly being implemented, but there is a gap in understanding which approaches are being used in which health professions programs and how the approaches are …

Forgoing Nuclear: Nuclear Power Plant Closures And Carbon Emissions In The United States, Luke Petach Jan 2025

Forgoing Nuclear: Nuclear Power Plant Closures And Carbon Emissions In The United States, Luke Petach

Funded Scholarship

This paper examines the effect of nuclear power plant decommissioning on electricity generation and carbon emissions in the United States. Using data on nuclear reactor closures in the United States between 1993 and 2022 and data on state-level carbon emissions and electricity generation from the Energy Information Administration (EIA), this paper adopts a difference-in differences (DiD) approach to estimate the effect of nuclear decommissioning. Two-way fixed-effects (TWFE) DiD estimates suggest a nuclear plant closure increases annual state-level per capita carbon emissions between 6% and 8%. The increase in state-level carbon emissions is driven by a substitution toward fossil fuel electricity—particularly …

Tandem Virtue Development: Latent Growth Trajectories Of Welcoming Accountability, Patience, And Courage In Goal Pursuit, Robert J. Ridder, Hiroko Matsuo, Charlotte [email protected], Anne Jeffrey, Karen K. Melton, Perry L. Glanzer, Sarah A. Schnitker Jan 2025

Tandem Virtue Development: Latent Growth Trajectories Of Welcoming Accountability, Patience, And Courage In Goal Pursuit, Robert J. Ridder, Hiroko Matsuo, Charlotte [email protected], Anne Jeffrey, Karen K. Melton, Perry L. Glanzer, Sarah A. Schnitker

Funded Scholarship

Informed by philosophical virtue theory, we tested developmental trajectories of welcoming accountability to other people in tandem with patience and courage. We sampled 870 US undergraduates pursuing personally-identified goals (N = 1,996 goals) across four timepoints in two years. Multi-level bivariate latent growth curve modeling disaggregated between-person patterns from within-person goal-level patterns for the three virtue measures. All three virtues’ slopes were nonsignificant, meaning virtues showed no uniform patterns of change for the sample. The slope of welcoming accountability was associated with the slopes of patience and courage so closely at the between-person level that a combined slope parameter was …

Simulations Of Electron Detection Systematic Errors For A Ucna+ Experiment, Rashika Gupta Jan 2025

Simulations Of Electron Detection Systematic Errors For A Ucna+ Experiment, Rashika Gupta

Theses and Dissertations--Physics and Astronomy

The Ultracold Neutron Asymmetry+ (UCNA+) experiment at the Los Alamos Neu- tron Science Center (LANSCE) Ultracold Neutron source is an upgrade of the UCNA experiment, designed to measure the neutron beta decay asymmetry parameter, A 0 , with a precision of less than 0.2% using polarized ultracold neutrons (UCN). Neutron beta decay is governed by the weak interaction, and a precise measurement of A 0 provides a determination of the axial-vector to vector coupling ratio, λ = gA /gV . When combined with a measurement of the neutron lifetime, this allows the extraction of the Cabibbo-Kobayashi-Maskawa (CKM) matrix element Vud …

Optimizing External Radioactive Calibration Source Strength To Maximize The Livetime Of The Nexo Detector, Thakur P. Bhatta Jan 2025

Optimizing External Radioactive Calibration Source Strength To Maximize The Livetime Of The Nexo Detector, Thakur P. Bhatta

Theses and Dissertations--Physics and Astronomy

The proposed next Enriched Xenon Observatory (nEXO) experiment aims to detect neutrinoless double beta decay in 136Xe, a rare process with profound implications for particle physics and our understanding of the neutrino. Achieving the required sensitivity demands ultra-low background conditions, making both material radiop urity screening and precise detector calibration essential. This dissertation addresses two key calibration challenges in preparation for nEXO. First, I investigated discrepancies in calibration efficiency measurements of the high-purity germanium (HPGe) detector named as GeIV located 4850 feet under ground at the Sanford Underground Research Facility, Lead, SD. The root cause for the discrepancy was found …

Precision Measurement Of The Muon’ S Anomalous Precession Frequency Using Energy Integrated Analysis In The Fermilab Muon G- 2 Experiment, Joseph Peck Jan 2025

Precision Measurement Of The Muon’ S Anomalous Precession Frequency Using Energy Integrated Analysis In The Fermilab Muon G- 2 Experiment, Joseph Peck

Theses and Dissertations--Physics and Astronomy

This dissertation investigates the anomalous magnetic moment of the muon, aµ, through the Fermilab Muon g -2 Experiment, which aims to measure aµ to a precision of about 140 parts-per-billion.

Muons were injected into a magnetic storage ring where their decay positrons were detected by calorimeters. The changing spin and momentum orientation leads to an oscillation in decay positron counts, known as the anomalous precession frequency ! a. Using the magnetic field and !a measurements, we can determine the value of a µ. This study focuses on the Q-Method determination of !a, which utilizes an energyintegrated reconstruction rather than high-energy …

A Multidisciplinary Approach To The Thermal And Non-Thermal Mechanisms In Galaxy Clusters, Sheng-Chieh Lin Jan 2025

A Multidisciplinary Approach To The Thermal And Non-Thermal Mechanisms In Galaxy Clusters, Sheng-Chieh Lin

Theses and Dissertations--Physics and Astronomy

Galaxy clusters form at the intersections of the cosmic web and carry imprints of the structure formation history of the universe. As massive, multi-component systems, they offer unique insights into the astrophysical processes that govern both structure formation and galaxy evolution. Observable across the full electromagnetic spectrum, clusters emit photons through a variety of mechanisms, each tracing different physical processes. This dissertation investigates both the thermodynamic and non-thermal properties of the intracluster medium (ICM) to better understand the physical processes shaping observed phenomena. It comprises three main studies, each targeting a different aspect of galaxy cluster physics. In the second …
