Experimental psychologists investigating eyewitness memory have periodically gathered their thoughts on a variety of eyewitness memory phenomena. Courts and other stakeholders of eyewitness research rely on the expert opinions reflected in these surveys to make informed decisions. However, the last survey of this sort was published more than 20 years ago, and the science of eyewitness memory has developed since that time. Stakeholders need a current database of expert opinions to make informed decisions. In this article, we provide that update. We surveyed 76 scientists for their opinions on eyewitness memory phenomena. We compared these current expert opinions to expert …

Recent policy shifts at the U.S. Patent and Trademark Office (USPTO) have sharply limited the use of two administrative pathways for patent reviews, inter partes review (IPR) and post-grant review (PGR). Congress created these administrative pathways to provide a faster and less costly way to challenge weak patents. Recently, the USPTO has expanded the use of “discretionary denials,” invoking a new “settled expectations” rationale that blocks IPR petitions for patents more than about six years old. From May to September 2025, 60% of 506 requests for discretionary denial were granted, triple historical levels, including one-third involving drug patents. These changes …

Narrowly Person-Affecting Axiology: A Reconsideration, Matthew D. Adler

A narrowly person-affecting (NPA) axiology is an account of the moral ranking of outcomes such that the comparison of any two outcomes depends on the magnitude and weight of individuals’ well-being gains and losses between the two. This article systematically explores NPA axiology. It argues that NPA axiology yields an outcome ranking that satisfies three fundamental axioms: Pareto, Anonymity and, plausibly, Pigou-Dalton. The axiology is neutral to non-well-being considerations (desert); and (assuming well-being measurability) leads to the Repugnant Conclusion (RC). In short, NPA axiology provides a grounding for Paretian, equity-regarding welfarism, albeit one that includes the RC.

Measuring The Value Of Trademark Distinctiveness: Evidence From The Market For Bordeaux Wine, Christopher Buccafusco, Jonathan S. Masur, Ryan Whalen

The market value of distinctive trademarks is a fundamental assumption of both trademark law and marketing theory. However, there is little empirical evidence underlying this assumption. We examine the relationship between brand dissimilarity and market prices in the context of the Bordeaux wine market. Using a unique dataset covering thousands of wines and their associated prices and professional ratings, we find that brand distinctiveness is related to higher wine prices. We further show that this relationship persists across the wine quality spectrum, with both lower quality and higher quality wines benefiting from dissimilar marks. This article offers a new interpretation of the land grant to freedpeople contained in General William T. Sherman’s Special Field Orders No. 15. Issued in January 1865 at the end of the Civil War, Sherman’s Orders are widely considered to be the origin of the government promise to endow freedpeople with “forty acres and a mule” as they transitioned from slavery to freedom. As such, the Special Field Orders have played a central role in shaping the cultural memory of the Civil War, historical accounts of Reconstruction, and contemporary debates over reparations for slavery. To examine changes in staffing levels over time in Oregon assisted living and residential care (AL/RC) communities between 2017 and 2023.

Design

Longitudinal study of licensed AL/RC communities.

Setting and Participants

A total of 1720 setting-year observations from 535 individual AL/RC communities in Oregon between 2017 and 2023.

Methods

Primary data were collected through the Oregon Community-Based Care (CBC) study. Given the extent of the eviction crisis in Oregon, it is crucial to investigate what happens to tenants after they are displaced from their homes. This report investigates three main questions concerning tenants’ post-eviction housing outcomes: Where do tenants live after they have been evicted? How do post-eviction housing outcomes affect tenants’ health, finances, and safety? How do rental assistance and legal assistance affect post-eviction housing outcomes?

Nearly two thirds of evicted tenants moved directly into some form of homelessness, including sheltered, unsheltered, or doubled-up homelessness. These findings indicate that Oregon’s eviction crisis and homelessness crisis are closely linked.

The matter–antimatter asymmetry and the hierarchy problem related to the Higgs boson mass remain key open questions in high energy physics. Electroweak Baryogenesis offers a solution to the asymmetry by modifying the Higgs sector to allow a strongly first-order phase transition. This work investigates two real singlet scalar extensions of the Standard Model, incorporating novel quartic and triple couplings between the new scalar fields, providing a testable framework for vacuum-induced scalar mixing effects and enhanced multi-Higgs boson production. The Donor Advised Fund Research Collaborative (DAFRC) is a group of academic and nonprofit researchers leading a 4-year, comprehensive research initiative to provide empirical data and insights on the characteristics and activities of donor advised funds (DAFs) in the United States.

This report, which is the second of three reports by the DAFRC, provides insights into DAF sponsors’ perceptions, policies, and practices. The report’s findings are based on a 2023 management survey of 128 DAF sponsors. This survey covered topics related to DAF strategy, operational capacity, philanthropic advising, internal policy execution, and the marketing of DAF sponsors.

Transformative innovations—the ones that use new technologies to disrupt the world—command our attention. But most new products are the result of a more mundane process of incremental iterative innovation, evolving through a long series of small modifications of existing technologies. Although both kinds of innovation can result in improved safety and utility, both can also create new dangers. We tend to be more aware of this in transformative innovations (as current worries over artificial intelligence show); by contrast, dangers created by incremental iterative innovation often go unrecognized, because the process itself is easy to overlook. Increasing water demands and declining groundwater levels have led to rising interest in managed aquifer recharge. That interest is growing in the United States—the focus of this article—and elsewhere. Increasing interest makes sense; managed aquifer recharge can reduce water-supply challenges and provide environmental benefits, sometimes with lower costs than alternative water-management approaches. But managed aquifer recharge also faces growing pains, which will make it difficult for projects to scale up and may limit the benefits provided by those projects that do go forward. Land use-land cover (LULC) change is widely implicated in coastal water quality degradation, but we often lack understanding of how LULC change has varied spatiotemporally because so much change occurred before the advent of modern mapping. In this study, we overcome this challenge by using forensic mapping techniques of LULC change over the past 175 years in coastal watersheds on the Atlantic Coast of Florida, USA. Flowering Rush (Butomus umbellatus) is an invasive aquatic plant in the Pacific Northwest that threatens salmon habitat. The Center for Lakes and Reservoirs staff surveyed for this and other aquatic species from 2023 and 2024 in the Columbia River in Lake Umatilla and Lake Celilo. This document summarizes their survey efforts including their protocols, data, and small-scale removal efforts.

Elections do not operate in perfect compliance with the law. Instead, irregularities are routine and, to some extent, inevitable. The law of elections responds to this tension by recognizing that only some legal irregularities, under only some circumstances, have even the potential to invalidate an electoral process. One manifestation of this response involves variable standards of compliance. Doctrines implicated by these standards recognize that some election rules require only substantial compliance, rather than strict compliance, to be considered fulfilled. Public employees do not sacrifice their constitutional rights by accepting public employment, but the doctrines surrounding public employee constitutional rights present a unique amalgam of rights and duties. Nowhere is this amalgam clearer than in the doctrine of public employee free speech. Under the federal Constitution’s First Amendment, public employees, notwithstanding their government roles, may speak out as citizens on matters of public concern, and any restrictions a government employer places on that speech must be justified by compelling workplace concerns that outweigh the speech interests of the employee and the interests of the public in access to relevant information. …

Institutions in developing nations often lack the necessary resources to provide accessible instruction, and the absence of clearly defined policies further impedes upholding the educational rights of such a special population. Unsteady boundary layer flow induced by alternating current (AC) or direct current (DC) electric field through a porous layer is investigated numerically. The finite difference method based on Crank-Nicolson is applied to solve the nonlinear system. The governing equations are built with fractional shear stress and the Cattaneo heat flux model, and time fractional derivatives are computed using the Caputo fractional derivative. The numerical results are presented to demonstrate the effects of varying parameters on momentum and thermal boundary layer. A two-span bridge, supported by steel H-piles and mechanically stabilized earth (MSE) bridge abutments, was constructed as part of a new interchange on I-65 in Whitestown, Indiana. The east and west MSE abutment walls consisted of precast concrete facing panels, ribbed steel strips, and coarse-grained backfill soil. A section near the middle of the east MSE abutment wall was selected for instrumentation and performance monitoring. A variety of sensors, including earth pressure cells, strain gauges, inclinometers, and crackmeters were used to measure the magnitude and evolution of several quantities, such as the vertical stresses at the base of the leveling …
