Next In Line: Addressing The Constitutional And Policy Problems With The Current Presidential Line Of Succession, Arian Carlo Rubio Jan 2025

Next In Line: Addressing The Constitutional And Policy Problems With The Current Presidential Line Of Succession, Arian Carlo Rubio

University of Michigan Journal of Law Reform

The presidential line of succession is a critical component of the United States government, designed to ensure continuity and stability in the executive leadership during crises. This Note examines the current statutory provisions concerning presidential succession to identify constitutional ambiguities and practical challenges that could undermine governmental operations during unforeseen emergencies.

Through a detailed analysis of historical instances, such as the incapacitation scenarios of past presidents and recent threats to government officials, including the COVID-19 pandemic and a rise in political violence, this Note highlights the risks posed by the existing succession framework. The ambiguity primarily revolves around the roles …

Lawyers And The Abuse Of Government Power, Margaret Tarkington Jan 2025

Lawyers And The Abuse Of Government Power, Margaret Tarkington

University of Michigan Journal of Law Reform

The legal profession needs to amend the rules of professional conduct to protect our constitutional system of government from those most likely to effectively undermine it: lawyers. The historic federal indictment against President Donald Trump for conspiring to stay in power after losing the 2020 presidential election included five attorney co-conspirators: Rudy Giuliani, John Eastman, Sidney Powell, Jeffrey Clark, and Kenneth Chesebro. Eight lawyers were indicted in Georgia on similar charges.

Lawyers weren’t just involved in Trump’s plot; they devised and enabled it. Rather than accurately advise Trump that he had lost and needed to concede, lawyers crafted a plan …

Court Forms And Court Reforms: Pro Se Litigants And The Limited Success Of Standardized Family Court Forms, Caroline Rogus Jan 2025

Court Forms And Court Reforms: Pro Se Litigants And The Limited Success Of Standardized Family Court Forms, Caroline Rogus

University of Michigan Journal of Law Reform

The first step in any civil lawsuit, long before a court will contemplate awarding relief, is initiating the court matter: a plaintiff must always start by effectively pleading their case. The court system rests upon the presumption that an attorney will create and file the requisite court documents—including complaints, answers, and motions—on behalf of their client. The reality, however, is that an extraordinarily high number of litigants do not have legal representation and must therefore proceed pro se and submit these documents on their own. Most jurisdictions offer pro se litigants standardized, fillable court forms. These forms are intended to …

Energy Weaponization In The Ukraine–Russia War: Sanctions, Rerouting Flows, And Implications For Smaller States, Aysel Quliyeva Jan 2025

Energy Weaponization In The Ukraine–Russia War: Sanctions, Rerouting Flows, And Implications For Smaller States, Aysel Quliyeva

Journal of Strategic Security

The 2022 Russian invasion of Ukraine intensified the use of energy as a geopolitical weapon, transforming global energy markets and testing the resilience of states dependent on Russian oil and gas. This study examines the mechanisms of energy weaponization in the context of the Ukraine-Russia war, with particular emphasis on sanctions, the rerouting of energy flows, and the strategic implications for smaller states. Drawing on the theoretical frameworks of energy security, hybrid warfare, and small-state vulnerability, the paper integrates policy analysis with trade and price data from 2014 to 2024. The findings reveal that sanctions accelerated Russia’s eastward energy pivot, …

Navigating Energy Transition: Eu’S Lessons In The Wake Of The Russia-Ukraine Conflict, Sharmistha Hazra, Pramod Kumar

Journal of Strategic Security

Russia’s invasion of Ukraine in February 2022 disrupted the European Union’s energy landscape, exposing its heavy reliance on Russian fuels. The ongoing crisis prompted a shift in the EU’s policy, accelerating efforts toward energy self-sufficiency and diversification of energy sources. The REPowerEU Plan, launched in March 2022, aimed to reduce Russian dependence by boosting renewables, enhancing energy efficiency, and diversifying suppliers, including Norway, the U.S., and Qatar. Despite progress in reducing gas demand and increasing wind and solar capacity, challenges such as slow policy implementation, internal divisions, and continued Russian energy imports remain significant concerns. Geopolitical tensions and reliance on …

Sea Denial: The Ukrainian Case Study And The Future Of Naval Warfare, Jithin Raveendran Jan 2025

Sea Denial: The Ukrainian Case Study And The Future Of Naval Warfare, Jithin Raveendran

Journal of Strategic Security

This article examines Ukraine’s maritime campaign in the Black Sea as a contemporary case study in sea denial against a conventionally superior navy. Despite lacking a blue-water fleet, Ukraine effectively contested Russia’s naval dominance through an integrated use of land-based anti-ship missiles, unmanned surface vehicles, special operations, and real-time intelligence—including support from Western ISR assets. High-profile incidents such as the sinking of the Moskva and sustained strikes on Sevastopol illustrate how denial can be achieved without parity in platforms or tonnage, reaffirming and extending insights from theorists such as Milan Vego, Ian Speller, and Sam Tangredi. While Ukraine’s methods build …

Dimensional Prediction Of Borderline Personality Disorder Traits: A Cross-Sample Comparison, Savanah Stinnett Jan 2025

Dimensional Prediction Of Borderline Personality Disorder Traits: A Cross-Sample Comparison, Savanah Stinnett

Psychology Doctoral Specialization Projects

Borderline Personality Disorder (BPD) presents a significant challenge in clinical diagnosis and treatment due to its pervasive pattern of instability in interpersonal relationships, self-image, affects, and impulsivity, often manifesting in early adulthood. Despite its prevalence, issues with categorical personality disorder (PD) diagnosis have been highlighted, leading to the introduction of the Alternative Model of Personality Disorders (AMPD) in Section III of the DSM-5. This doctoral project seeks to address the current mapping of AMPD traits for BPD by evaluating the comprehensive assessment of traits relevant to BPD to determine whether these traits accurately measure the construct or if supplemental characteristics …

What Is The Meaning Of This? A Proposed Assessment Tool For Exploring Meaning Of Life In The Therapeutic Realm, Logan S. Burris

Psychology Doctoral Specialization Projects

It is likely that since man has first learned to communicate with one another, we have wondered what the meaning of life is. Throughout recorded history, groups of individuals with religious, philosophical, and scientific backgrounds have searched for the answer to this deceptively simple question. Previous research has shown that finding meaning in one’s life can render positive psychological and physiological outcomes for individuals presenting with depressive and anxiety disorders, trauma, chronic and terminal illness, and many more. There have been numerous attempts of creating assessments intended to measure a person’s meaning in life, however most of them either do …

Building A Burnout-Resistant Workforce: The Benefits Of Mindfulness For Clinical Psychology Doctoral Students, Joseph Dickhaus

Psychology Doctoral Specialization Projects

Burnout has long been a significant occupational hazard for mental health professionals. Despite the increasing recognition of its prevalence and impact, many graduate programs fail to adequately address self-care strategies. Mindfulness, a practice of focused attention, has emerged as a promising approach to prevent and mitigate burnout. This paper reviews the literature on burnout and its effects on mental health professionals. Next, the paper will provide an overview of mindfulness, mindfulness-based interventions, and benefits of mindfulness. It argues for the integration of mindfulness training into graduate programs to equip students with essential self-care skills early in their careers. The paper …

Psychology Doctoral Specialization Projects

Navigating college life can be difficult; add to that the complications of navigating different cultures and it creates a chasm for young adults to overcome. This is true for many Latinx college students who often attend colleges where few resources exist to offer support in navigating these social and cultural issues in their everyday life. Additionally, while group therapy is championed as a treatment modality for many, few groups exist that target Latinx communities, especially Latinx college students. This project aims to highlight these social and cultural issues faced by Latinx individuals and provide clinicians with a treatment manual to …

Comparing Approaches To Estimating Person Parameters For The Mupp Model, David M. Lahuis, Caitlin E. Blackmore, Gage M. Ammons Jan 2025

Comparing Approaches To Estimating Person Parameters For The Mupp Model, David M. Lahuis, Caitlin E. Blackmore, Gage M. Ammons

Psychology Faculty Publications

This study compared maximum a posteriori (MAP), expected a posteriori (EAP), and Markov Chain Monte Carlo (MCMC) approaches to computing person scores from the Multi-Unidimensional Pairwise Preference Model. The MCMC approach used the No-U-Turn sampling (NUTS). Results suggested the EAP with fully crossed quadrature and the NUTS outperformed the others when there were fewer dimensions. In addition, the NUTS produced the most accurate estimates in larger dimension conditions. The number of items per dimension had the largest effect on person parameter recovery.

Business Model Evaluation Of Renewable Energy Community In Multi Unit Residential Building In Canada Net Metering, Considering The Regulatory Framework, Ownership And Organizational Structure, Zahra Keshavarz Moraveji, Yunping Liang, Ursula Eicker

Durham School of Architectural Engineering and Construction: Faculty Publications

Renewable Energy Community (REC) is an emerging concept that empowers local customers to generate decentralized renewable energy. Integrating RECs into the building industry presents a promising opportunity to support the transition toward net-zero cities. However, the viability of RECs depends on regional regulatory frameworks, permitted governance structures, and very importantly, business models. Compared to pioneering European countries, Canada lacks the regulatory support needed to fully enable REC. This paper proposes and evaluates various business models for potential REC implementations under Canada's existing regulatory constraints. The analyzed models focus on "behind-the-meter" electricity distribution, a multi-stakeholder type of REC, where generation occurs …

Integrated Valuation Of The Ecological, Social And Economic Benefits Provided By A Multifunctional Nature-Based Solution, Laura Costadone, Shan Zhang

ODU Articles

Nature-based Solutions (NbS) offer multifunctional approaches to address climate change and environmental challenges, providing a sustainable alternative to traditional gray infrastructure. Despite their promise, widespread adoption remains limited, in part due to an incomplete understanding of their full costs and benefits relative to conventional infrastructure. Traditional benefit–cost analyses often overlook non-monetized benefits and the interconnected ecosystem services provided by NbS. This study introduces a methodological approach to quantify both the physical and monetary value of ecosystem services and co-benefits delivered by an NbS project. We applied an integrated valuation framework to a case study in Virginia Beach, VA, USA, where …

Defining Arbitration, Jill I. Gross Jan 2025

Defining Arbitration, Jill I. Gross

Elisabeth Haub School of Law Faculty Publications

The Federal Arbitration Act (FAA) does not define the term “arbitration,” the very process the one-hundred-year-old statute was enacted to promote. The absence of a definition has led to courts' inconsistent and unpredictable application of the FAA's regulatory benefits to agreements to resolve disputes in processes other than traditional, binding arbitration, such as appraisal, evaluation, and mediation. Additionally, with no clear definition as guidance, companies have inserted arbitration clauses into adhesive consumer and employment agreements that require “arbitration” of disputes but designate a process lacking hallmarks of due process. The Supreme Court even justified enforcing class action waivers in arbitration …

Reading Into Things: Articulate Objects In North America, 1650-1820, Lily Higgins Jan 2025

Reading Into Things: Articulate Objects In North America, 1650-1820, Lily Higgins

Yale Graduate School of Arts and Sciences Dissertations

In the eighteenth century, it-narratives emerged as a new literary genre, elevating objects to the role of heroes and heroines. Investing fictional objects with the power to participate in human affairs, these stories offer insight into how the contemporaneous reading public grappled with the agency of objects in real life. Responding to questions about agency and subjectivity provoked within the early modern it-narrative, this dissertation considers how actual objects made and used within an ever-widening world of material goods were “speaking” to people in new ways, both exciting and disconcerting. Defining these “speaking” things as “articulate objects,” the research suggests …
