Law, Conflict, And Hybrid Warfare: A Teaching Imperative For A Changing World, Cynthia Alkon, Andrea Kupfer Schneider Jan 2025

Law, Conflict, And Hybrid Warfare: A Teaching Imperative For A Changing World, Cynthia Alkon, Andrea Kupfer Schneider

Faculty Scholarship

Lawyers increasingly find themselves at the frontlines of the battlefield, just not in the traditional sense. Hybrid warfare is a conflict form that combines traditional military offensive measures with nontraditional methods, including the harnessing of legal systems to achieve strategic goals. Lawyers have always been at the frontline of typical legal risk assessment, thinking about a client's risk of liability or regulation costs generally. Now, lawyers must stand at the ready for a lot more: lawyers must be prepared for cyber-attacks, disinformation campaigns using artificial intelligence, the use of court systems to suppress reporting or shield bad actors, and so …

The United States Healthcare System: From Medicare To Post-Pandemic Health Policy, William M. Sage Jan 2025

The United States Healthcare System: From Medicare To Post-Pandemic Health Policy, William M. Sage

Faculty Scholarship

My purpose in this essay is to comment on national health policy in the United States over the past sixty years.  My conclusions are less optimistic than what I had hoped when I began my teaching and research career in the 1990s to be able to say in 2025.  In particular, the successful expansion of publicly supported health coverage via the passage of the Affordable Care Act (“ACA” or “Obamacare”) in 2010 seems to have triggered -- though I hesitate to say that it caused – a backsliding from broader commitments to clinical performance, population health, and social solidarity that …

"Arbitration In Name Only": A Race Claims Mismatch, Michael Z. Green Jan 2025

"Arbitration In Name Only": A Race Claims Mismatch, Michael Z. Green

Faculty Scholarship

With arbitration's meteoric rise as a tool in resolving statutory employment discrimination matters beginning in the 1990s, concerns about lack of employee bargaining power received little consideration when raised in court challenges to the enforcement of employer-mandated agreements to arbitrate those claims. Only in rare circumstances, when an employer appeared to go to extremes in using its overwhelming bargaining power to implement an arbitration process so clearly unfair would a court find the agreement created an unfair "arbitration in name only" that should not be enforced.

Employers have become savvier in how they require employees to agree to resolve discrimination …

Criminal Background Checks: Implications For Discrimination And Crime, Murat C. Mungan Jan 2025

Criminal Background Checks: Implications For Discrimination And Crime, Murat C. Mungan

Faculty Scholarship

Criminal background checks have recently attracted the attention of academics and policy makers alike. Recent laws and policies, like “ban the box” and expungements, focus on the availability of criminal background information as well as the permissibility of using this type of information. Quite surprisingly, policies about the content of the information –whose permissibility and availability are questioned by recent work– is not scrutinized as much.

In this article, I investigate the informational quality of existing background checks. For this purpose, I review the history and evolution of traditional criminal background checks. These checks rely on ‘rap sheets’ –documents containing …

Protect Transgender Kids: What Is “Protection” In Light Of Bans On Gender-Affirming Care?, Patricia B. Barnett Jan 2025

Protect Transgender Kids: What Is “Protection” In Light Of Bans On Gender-Affirming Care?, Patricia B. Barnett

Journal of Race, Gender, and Ethnicity

This Note examines the growing legal and constitutional conflict surrounding state laws that ban or restrict gender-affirming care for transgender minors. At the heart of the issue lies the clash between state authority and the constitutionally protected rights of parents under the Due Process Clause of the Fourteenth Amendment. Drawing on medical consensus that affirms the necessity and efficacy of gender-affirming care, the Note argues that these laws not only endanger the well-being of transgender youth but also infringe on parents' fundamental rights to direct their children’s medical treatment. The analysis highlights how some states mischaracterize gender-affirming care as a …

Book Banning: The Post-Pico Epidemic Upon Nationwide Academic Curricula, Brian Gomberg Jan 2025

Book Banning: The Post-Pico Epidemic Upon Nationwide Academic Curricula, Brian Gomberg

Journal of Race, Gender, and Ethnicity

This Note explores the growing wave of book bans across the United States, highlighting the increasing role of state legislators in advancing policies that restrict access to literature in public schools. While historically driven by private individuals or local challenges, contemporary bans are now often state-sanctioned, with states like Texas, Florida, Missouri, Utah, and South Carolina leading the movement. These actions not only suppress specific titles but also target entire genres, disproportionately affecting books dealing with race, gender, and LGBTQ+ identities. Drawing on sources such as the PEN America Index of School Book Bans, the Note analyzes the historical context …

Patriarch Kirill Of Moscow And All Russia: A True Patriarch Or A False One, A Senior Cleric Or A Senior Politician Of The Russian Federation? The Russian Patriarch And The War In Ukraine, Dilyan Nikolchev

Occasional Papers on Religion in Eastern Europe

This paper focuses on the behavior of the current Russian Orthodox Patriarch Kirill (Gundyaev) in the context of the Russia’s military aggression against sovereign Ukraine – a religious leader who fully supports the war policy of the Kremlin. The pro-war and pro-Putin views and messages of Patriarch Kirill proved him in the eyes of the Orthodox world more as a false Patriarch and a politician than as the primate of the Russian Orthodox Church. To a large extent, the Russian political narratives and ideology of the “Russian Peace” and “Holy Rus” doctrine are a product of the senior leadership of …

Occasional Papers on Religion in Eastern Europe

This study examines the judicial practices of Kazakh beys in 18th–19th century Central Asia, emphasizing their application of Islamic fiqh alongside traditional Kazakh customary law (adat). In a decentralized and nomadic society, beys acted as hybrid legal authorities, integrating Shari’a principles – such as ‘adl (justice), maslaha (public interest), and ijtihad (independent reasoning) with local customs to resolve disputes over property, family matters, and blood feuds. Through historical-legal analysis of oral traditions, archival documents, and ethnographic accounts, the research demonstrates how beys preserved Islamic legal norms while adapting them to practical realities, creating a dynamic model of legal …

Implementation Of The Novel Nurse Intuition Patient Deterioration Scale To Assess For A Correlation Among Nurse Intuition And Patients Returning To The Intensive Care Unit, Janie L. Walsh

Graduate Theses, Dissertations, and Problem Reports (ETD)

Introduction/Background: Adult hospitalized medical and surgical patients at an academic medical center are being transferred out of the Intensive Care Unit (ICU) to the step-down floor and having rapid response calls in less than 48 hours after the transfer. Nurse intuition is not a consideration in the decision to transfer a patient. Physiological variables such as Modified Early Warning Scores (MEWS) and vital signs are relied on heavily as indicators for escalation or de-escalation of care. There is evidence supporting the use of acknowledging nurse intuition to better predict a patient’s readiness for transitions of care.

Purpose: To evaluate the …

Protein biomarker detection is a critical analytical method for quantifying proteins in biological samples. It is relevant not only in medical diagnostics and research but also numerous other fields such as environmental monitoring, pharmacology, food safety, and biotechnology. Sensitive detection at picogram-per-milliliter (pg/mL) levels is essential for diagnosing diseases, monitoring progression, and tailoring treatments, especially for low-abundance biomarkers like troponin, interleukin 6, carcinoembryonic antigen (CEA), activin A, and vascular endothelial growth factor (VEGF). Immunoassays, particularly enzyme-linked immunosorbent assays (ELISAs), are the gold standard for protein biomarker detection due to their high specificity and sensitivity. The development of point-of-care (POC) diagnostic …

What Does It All Mean? Differences In Self-Defining Memories Between Community And Adjudicated Youth, Hannah Elias Jan 2025

What Does It All Mean? Differences In Self-Defining Memories Between Community And Adjudicated Youth, Hannah Elias

Graduate Theses, Dissertations, and Problem Reports (ETD)

Identity development is driven in large part by self-defining memories, or memories though which we base our definition of who we are (Habermas & Bluck, 2000). In adolescence, cognitive skills are gained that allow us to make meaning, or learn lessons and gain insight, from self-defining memories (Bluck & Habermas, 2001; McLean & Thorne, 2003). To determine whether there are differences in their ability to make meaning from their self-defining memories, this study compares narratives of self-defining memories between community youth and adjudicated youth. Additionally, the ability to be specific in self-defining memory recollection may differ between these groups, which …

Three-Dimensional Spreading Of Magnetic Reconnection Between Non-Parallel Flux Ropes With A Guide Field, Regis John Jan 2025

Three-Dimensional Spreading Of Magnetic Reconnection Between Non-Parallel Flux Ropes With A Guide Field, Regis John

Graduate Theses, Dissertations, and Problem Reports (ETD)

Magnetic reconnection is a fundamental plasma process that facilitates the rapid conversion of magnetic energy into particle acceleration, plasma flows, and heating. It plays a central role in explosive astrophysical events such as solar flares, where vast amounts of magnetic energy are released on short time scales. A key structure in many reconnection sites is the magnetic flux rope, a column of plasma carrying current threaded by helical magnetic fields, which is frequently involved in or generated by reconnection. Understanding how reconnection unfolds in such flux rope systems is critical for interpreting both space weather phenomena and laboratory plasma dynamics. …

A Limb-Speed-Driven Locomotor Control System And Its Ability To Adapt, Emily Marie Herrick

Graduate Theses, Dissertations, and Problem Reports (ETD)

Despite how simple walking may seem, the locomotor control system is structurally and functionally complex. Its hierarchical organization of supraspinal and spinal networks with forward and feedback pathways has many interactions at multiple levels that are dependent on the dynamics of a high-dimensional musculoskeletal system. Having a comprehensive understanding of sensorimotor integration within a healthy locomotor control system is crucial for understanding changes to the system due to age or neurologic disease and developing effective technologies to recover mobility in those populations. In this dissertation, we address persistent gaps in knowledge pertaining to how the nervous system controls locomotion.

Searching For The "Tender Places": Shoddy, Knowledge, And Material Culture In The Civil War Era, Robert William Novak Jan 2025

Searching For The "Tender Places": Shoddy, Knowledge, And Material Culture In The Civil War Era, Robert William Novak

Graduate Theses, Dissertations, and Problem Reports (ETD)

In the American Civil War era, shoddy was difficult to understand. It was simultaneously seen as evidence of advancing western civilization as well as a disgusting amalgamation of refuse and disease that threatened those who touched it. Made from shredding woolen rags and tailors’ clippings, the recycled woolen fibers could by applied in myriad woolen blends that came to dominate the ready-made clothing industry that developed through the first half of the nineteenth century. Its application could soften coarse blends and refine the appearance of cheap cloth. When the American Civil War erupted in 1861, however, shoddy came to define …

Expanding The Vibrating Sharp-Edge Spray Ionization Toolkit For Oligonucleotide Characterization, Sultan Mahmud Jan 2025

Expanding The Vibrating Sharp-Edge Spray Ionization Toolkit For Oligonucleotide Characterization, Sultan Mahmud

Graduate Theses, Dissertations, and Problem Reports (ETD)

A gentle or soft Ionization process is a critical component in native mass spectrometry (MS) to lift the biomolecules from the bulk solution into the gas phase environment of the mass spectrometer preserving their shape, topology and non-covalent interactions. Electrospray ionization (ESI) facilitates structural preservation of proteins, nucleic acids and their complexes and as a result it has been extensively used in native MS. However, in negative ion mode, ESI is somewhat limited in sensitivity due to corona discharge effect resulting from the requirement of a high amount of voltage. This often disrupts the ESI process and may not preserve …

Forensic Characterization And Comparison Of Modern Nail Polish Products By Their Physical Features And Chemical Composition, Madison Meredith Lindung Jan 2025

Forensic Characterization And Comparison Of Modern Nail Polish Products By Their Physical Features And Chemical Composition, Madison Meredith Lindung

Graduate Theses, Dissertations, and Problem Reports (ETD)

Nail polish can serve as valuable evidence in forensic investigations as it is often found on the hands and feet of individuals. Nail polish can break off and transfer easily during self-defense actions or forceful contact, such as in cases of kidnapping, sexual assault, or homicide. These residues can provide clues about who was at the scene, as well as where, when, and how the event evolved. However, compared to other types of paints commonly analyzed in forensic laboratories, limited forensic research has been conducted on the chemical composition and discrimination capabilities of popular nail products. The lack of information …

Co-Transmission Is Co-Opted For The Coordination Of Auditory Sensory Integration, Marryn M. Bennett Jan 2025

Co-Transmission Is Co-Opted For The Coordination Of Auditory Sensory Integration, Marryn M. Bennett

Graduate Theses, Dissertations, and Problem Reports (ETD)

Corollary discharge circuits (CDCs) are conserved mechanisms for sensory modulation during species specific behavioral programs. Many behaviors require multiplexed differential sensory modulation for proper execution. Co-transmission of fast and slow neurotransmitters allows for distinct modulation of different downstream targets within one sensorimotor circuit. However, studying co-transmission within the context of modulatory circuits like CDCs requires complete knowledge of behavioral circuits and precise tools for individually determining the implications of each transmitter on its targets. In this dissertation, I used a conserved set of corollary discharge interneurons in Drosophila melanogaster as a model to study the intricacies of sensory modulation through …
