Manipal Journal of Nursing and Health Sciences
Background: Caregivers play an important role in shaping patients’ experiences with ECT. Despite evidence that ECT is an effective and safe treatment, certain factors, such as social stigma, inadequate knowledge, doubt about efficacy, and safety, have limited its use. With adequate knowledge, information, and understanding caregiver, as well as the patient, will develop a positive attitude towards it simultaneously. Aim: To assess the correlation of knowledge and attitude towards ECT among the caregivers of patients in a tertiary mental health care setting. Methodology: This study employed a descriptive correlational research design, conducted within a tertiary mental health care setting. …

Metamorphosis And Fairy Tale Tropes In Christa Wolf’S Patterns Of Childhood, B. E. Lara
Metamorphosis And Fairy Tale Tropes In Christa Wolf’S Patterns Of Childhood, B. E. Lara
Master's Theses and Doctoral Dissertations
This study is a sociohistorical analysis of East German writer Christa Wolf’s use of fairy tale tropes in her novel Patterns of Childhood, first published in German in 1976 in East Germany as Kindheitsmuster. Wolf uses fairy tale tropes to explore themes that she could not write about openly under East German censorship, which prohibited East German authors from exposing their culpability for prior acts committed under the Nazi Regime. Furthermore, Wolf introduces metamorphosis to explore the intrinsic evil and subsequent guilt of her child protagonist, and she uses the child’s capacity for evil to illustrate the German people’s similar …
Speech-Language Pathologists’ Preparation To Become Clinical Educators, Alivia English
Speech-Language Pathologists’ Preparation To Become Clinical Educators, Alivia English
Master's Theses and Doctoral Dissertations
Clinical education is significant in a student clinician’s educational journey to prepare them for their career after graduation. It provides the hands-on component that can only be learned and fully understood through performing. The literature regarding students’ experiences in clinical education is vast, but there is a shortage of literature that explores the perceptions of clinical educators (CEs). This thesis consists of three articles. The first article explores the perceptions speech-language pathologists’ have regarding the preparation they received to become CEs, and then the second article takes a look at how the requirements to becoming CEs differ across similar clinical …

Faculty, Staff and Student Publications
We developed the narrative video game Sophia that immerses users in the story of a 13-year-old girl during her father's 18-month battle with glioblastoma and her journey toward resilience during her high school years following his passing. The game is designed to engage adolescents coping with parental cancer in multiple gameplay modes and levels, the character, and the outcome of the story as a way to build connections and explore the themes of illness, dying, bereavement, and resilience. The scenes at each level correspond to the stages of glioblastoma illness as well as the teenage milestones she passes through without …

Crisis Pricing, John F. Duffy, Richard M. Hynes
Emory Law Journal
Extraordinary times beget extraordinary measures. Multiple national emergencies during the past quarter century have generated a pitched debate as to whether, and to what extent, a crisis justifies deviations from fundamental legal rules. That debate has often focused on constitutional law and has produced sharply divergent views. Some theorists advocate a “business-as-usual” approach, eschewing emergency deviations, but societies rarely hold that course. More pragmatic scholars would permit some emergency measures but also defend fundamental social structures that have great value even during emergencies.
Emergencies, however, pose challenges not only to constitutional rules but to law generally, including the basic structures …
La "Vie" Continue: Legal Recognition As A Gateway To Sustainable Cross-Border Investments Between China And The U.S., Zhen Tian
Emory Law Journal
The Variable Interest Entity (VIE) structure is a network of contracts that connects the shell company listed on U.S. exchanges to the operating company in China. In 2000, Chinese enterprises first created the VIE structure to circumvent stringent PRC regulations and gain direct access to capital markets overseas. However, despite its strategic utility, the VIE structure has remained in a regulatory gray area. While the VIE contracts effectively mimic equity control, they face an uncertain reception from the PRC government, posing significant risks to U.S. investors.
Following the Luckin Coffee fraud scandal in 2020, the U.S. government passed the Holding …
Safety Whistleblowing, Benjamin L. Cavataro
Safety Whistleblowing, Benjamin L. Cavataro
Emory Law Journal
When companies fail to do the right thing, critical safety-law violations often go unchecked. Using previously unstudied records, this Article provides the first critique of a core component of the federal consumer product safety whistleblower regime created by Congress in 2008.
This Article reveals why and how the current law—which provides protections only to employee-whistleblowers who are retaliated against—has failed to protect consumers from death and injury. First, documents obtained via the Freedom of Information Act provide evidence suggesting that the current program fails on its own terms. Very few workers have filed complaints; the number of successful complaints is …
Farewell, Feres: Does The Camp Lejeune Justice Act Overturn The Feres Doctrine?, Megan E. Rohn
Farewell, Feres: Does The Camp Lejeune Justice Act Overturn The Feres Doctrine?, Megan E. Rohn
Emory Law Journal
In 1950, the Supreme Court held in Feres v. United States that soldiers cannot sue the government for injuries incurred “incident to service.” This holding set a precedent for denying suits by injured soldiers and their families, and the precedent became known as the Feres Doctrine. Over time, the Feres Doctrine has been expanded and abused to universally dismiss lawsuits by soldiers for negligence, medical malpractice, sexual assault, and intentional torts including sexual assault. Because the original decision did not adequately define “incident to service,” the Feres doctrine has been applied differently in different judicial circuits, causing confusion and drawing …
The New Constitutional Challenge To Qui Tam, Emily Mitchell
The New Constitutional Challenge To Qui Tam, Emily Mitchell
Emory Law Journal
Following the June 2023 Supreme Court decision in United States ex rel. Polansky v. Executive Health Resources, Inc., the ability of qui tam relators to litigate False Claims Act actions faces renewed challenges on multiple constitutional grounds. Specifically, in his Polansky dissent, Justice Thomas raises a novel Article I concern that Congress does not have the authority to partially assign the government’s litigation claim to relators, thus leaving them without standing to sue. Defendants in False Claims Act cases have already begun raising Thomas’s constitutional arguments in federal courts. What is heralded as the government’s most effective tool to …
Defying Goldilocks: Why The Flsa Collective Action Notice Standard Set Forth In Lusardi Is “Just Right”, Maguire Tausch
Defying Goldilocks: Why The Flsa Collective Action Notice Standard Set Forth In Lusardi Is “Just Right”, Maguire Tausch
Emory Law Journal
Since the 1980s, federal district courts have applied a lenient standard under § 216 of the Fair Labor Standards Act of 1938 (FLSA), allowing plaintiffs to more easily notify “similarly situated” coworkers of an employer’s potential minimum wage and overtime violations. But recent circuit court decisions have contested this lenient standard. And today, three approaches exist for sending notice to “similarly situated” coworkers hoping to form an FLSA collective action: one lenient, one strict, and one attempting to chart a middle ground. Challenges to the lenient standard threaten workers’ abilities to vindicate their rights and uphold their inherit dignity, eroding …
Rethinking Misdemeanor Incompetence, Susan A. Mcmahon
Rethinking Misdemeanor Incompetence, Susan A. Mcmahon
Emory Law Journal
The competence to stand trial system is a “slow-moving tsunami” that has grown exponentially in recent years, capturing far more people than jurisdictions have the capacity to handle. As a result, individuals who are incompetent become trapped in pretrial competence purgatory, often detained in jail for months or even years. The harms of this system can be tragic. Competence detainees have died by suicide, starvation, and beatings. They are placed in solitary confinement, experience neglect and abuse, and deteriorate mentally and physically while confined. Often, these individuals are accused of misdemeanors. Often, they go through the competence process only to …
The Psychological Impact Of Denied Blood Transfusions By Jehovah's Witness Parents In Pediatric Patients, Jaelyn Capablanca Braganza
The Psychological Impact Of Denied Blood Transfusions By Jehovah's Witness Parents In Pediatric Patients, Jaelyn Capablanca Braganza
Nursing | Student Research Posters
Jehovah's Witnesses believe that it is against God's will to receive blood from someone else, or to tamper with their own blood, influencing them to deny blood transfusions for themselves and for their children. Since minors are legally not allowed to make healthcare decisions on their own until they reach 18 years of age, this decision made by the parents to deny transfusions on the pediatric patient's behalf may create significant emotional and psychological challenges, potentially influencing family dynamics, mental health, and overall well-being. Understanding these effects, especially for the pediatric patient, is crucial for healthcare providers, social workers, and …

Improving Adherence In Adolescent Kidney Transplant Recipients, Kaylen Munoz
Nursing | Student Research Posters
Background: Adolescent and young adult (AYA) kidney transplant recipients face unique challenges in maintaining long-term graft function and overall health. Nonadherence to immunosuppressive therapy and difficulties transitioning from pediatric to adult care contribute to the increased risk of graft failure in this population. Despite proposed tools identifying adherence barriers, there is a lack of implementation and targeted interventions addressing the barriers AYA transplant recipients face. Purpose: This study aims to evaluate the effectiveness of a structured transition program that utilizes an adherence barrier tool and adherence-promoting interventions in improving health outcomes for adolescent and young adult (AYA) kidney transplant recipients. …
The Potential Of Bioactive Foods In Chemotherapy-Induced Gastrointestinal Distress, Haizhu Patterson
The Potential Of Bioactive Foods In Chemotherapy-Induced Gastrointestinal Distress, Haizhu Patterson
Nursing | Student Research Posters
Background: Cancer continues to have a profoundly detrimental impact on global health, and chemotherapy is widely accepted and utilized as one of the most effective cancer treatments. Unfortunately, the downside of chemotherapy is its significant adverse effects, which often manifest as gastrointestinal (GI) distress, leading the patient to discontinue treatment. Recent research has increasingly focused on bioactive foods as a means to mitigate chemotherapy-induced GI distress. By identifying which bioactive foods can alleviate these distresses, nurses can offer valuable recommendations to cancer patients to help them reduce chemotherapy's adverse effects, enhancing their quality of life (QoL) and improving treatment adherence. …

Developing A Culturally Sensitive Nursing Framework For Muslim Patients Practicing Ramadan: Focusing On Fasting Benefits And Islamic Dietary Recommendations, Amreen Mahmood Munshi
Nursing | Student Research Posters
Background: Muslims practice Ramadan, a month-long period of fasting from dawn to dusk, yet many healthcare providers lack knowledge of its principles and practices. Hospitals lack formal education on caring for fasting Muslim patients, leading to a knowledge deficit in cultural competence and sensitivity of Islamic practices. Purpose: This paper proposes a research design for a nurse education program on Ramadan fasting to promote cultural competence and sensitivity in nursing care. The proposed research aims to educate nurses on Islamic practices, particularly Ramadan, to bridge the cultural competency gap. The literature review also explores the health benefits of …

The Impact Of Parental Mental Health On Infants In The Neonatal Intensive Care Unit, Andee L. Plaskett
The Impact Of Parental Mental Health On Infants In The Neonatal Intensive Care Unit, Andee L. Plaskett
Nursing | Student Research Posters
The neonatal intensive care unit (NICU) provides critical and life saving care for infants born with medical complications that may need specialized care. The NICU environment can be an overwhelming and stressful place for both parents and infants. Parental mental health challenges, such as stress, anxiety, and depression, can significantly impact infants in the NICU by hindering parent infant interaction and connection. Parental mental distress is often linked to an increase in anxiety for the infant, as well as higher rates of medical complications and a higher likelihood of longer hospital stays for the infant. Parental stress can have a …
Culturally Sensitive Nursing Care And Its Impact On Abuse Disclosure Among Immigrant-Origin Populations, Jaspal Uppal
Culturally Sensitive Nursing Care And Its Impact On Abuse Disclosure Among Immigrant-Origin Populations, Jaspal Uppal
Nursing | Student Research Posters
Background: Immigrant-origin patients often face many systemic barriers when accessing healthcare. Factors such as language barriers, fear of deportation, limited trust in healthcare providers, and lack of culturally sensitive care make it hard for patients to disclose abuse. These challenges contribute to poor health amongst vulnerable populations which highlights the importance of using culturally sensitive and trauma-informed care. Objective: This research aims to test whether culturally adapted, trauma-informed nursing care improves disclosure of abuse and access to support services. The objective is to strengthen safety and trust between healthcare providers and patients through culturally sensitive care. Method: A quantitative quasi-experimental …
Health Disparities After Redlining: A Comparative Analysis Of Health Outcomes And Health Disparities In Richmond, Virginia And Portland, Oregon, Amal Ali
Araneum: Richmond Journal of American & Global Affairs
Redlining was a discriminatory housing practice introduced by the Home Owners’ Loan Corporation that denied loans and mortgages to Black residents and resulted in a heavily entrenched system of economic discrimination in the U.S. Existing literature points to a strong relationship between redlining and worsened health outcomes in communities of color. For example, redlining is associated with a higher risk of heart failure, a higher risk of death from breast cancer, and a higher risk of COVID-19 infection. While previous research has focused on the relationship between redlining and health outcomes and proposed several possible interventions, there is a lack …

Pitching For Reform: Cangrejeros' Push To Level The Legal Playing Field By Challenging Baseball's Antitrust Exemption, Justin P. Chaljub
Fordham Journal of Corporate & Financial Law
For over one-hundred years, professional baseball has enjoyed an antitrust exemption unique among American major sports leagues, stemming from Supreme Court decisions in Federal Baseball and its progeny. This exemption has significantly influenced the evolution and structure of Major League Baseball (MLB). Despite extensive criticism and challenges for judicial and legislative reform, the exemption persists today.
However, new efforts have emerged to comprehensively disrupt this framework. In 2023, Nostalgic Partners was brought and structured to reach the U.S. Supreme Court. Plaintiffs anticipated they would lose at the lower court levels and garnered widespread support for the Court to grant a …
The Federal Reserve’S Fight Against Covid-19: A Study Of The Corporate Bond Intervention, Noah Seilgson
The Federal Reserve’S Fight Against Covid-19: A Study Of The Corporate Bond Intervention, Noah Seilgson
Fordham Journal of Corporate & Financial Law
In response to the COVID-19 pandemic, the Federal Reserve (Fed) embarked on an unprecedented mission to stabilize the U.S. economy as businesses shut down. One emergency Fed facility, the Secondary Market Corporate Credit Facility (SMCCF), was used to purchase corporate bonds and corporate bond exchange-traded funds (ETFs) in the secondary market. This extraordinary measure, which injected liquidity into the corporate bond market, aimed to mitigate economic fallout for large companies. Purchasing corporate bonds marked a departure from previous Federal Reserve interventions, but the statutory authority was the same as had been used in past crises: Section 13(3) of the Federal …
Company Districts, C.J. Suglia
Company Districts, C.J. Suglia
Fordham Journal of Corporate & Financial Law
Special districts that are owned or controlled by private entities and act almost uniformly like a company town can be dubbed a “company district.” These special districts, similar to historical company towns, have autonomy over the districts, control the local government, and only have to answer to the state government. Historical company towns like Pullman, Illinois and Hershey, Pennsylvania had almost canonical command over the land within their boundaries. Company districts operate their business similar to a company town—in a city that the private entity controls, but do not have employees living on-site. Company districts benefit by being immune to …
