Automating International Human Rights Adjudication, Veronika Fikfak, Laurence R. Helfer Jan 2025

Automating International Human Rights Adjudication, Veronika Fikfak, Laurence R. Helfer

Michigan Journal of International Law

International human rights courts and treaty bodies are increasingly turning to automated decision-making (“ADM”) technologies to expedite and enhance their review of individual complaints. These tribunals have yet to consider many of the legal, normative, and practical issues raised by the use of different types of automation technologies for these purposes. This article offers a comprehensive and balanced assessment of the benefits and challenges of introducing ADM into international human rights adjudication. We argue in favor of using ADM to digitize documents and for internal case management purposes and to make straightforward recommendations regarding registration, inadmissibility, and the calculation of …

Join The Military And Lose Your Kids: An Exploration Of The Adverse Effects Of Military Service In Child Custody Determinations, Cortland T. B. Boechler Jan 2025

Join The Military And Lose Your Kids: An Exploration Of The Adverse Effects Of Military Service In Child Custody Determinations, Cortland T. B. Boechler

Journal of Legislation

Servicemembers do not lose their fundamental rights when they join the military, but in practicality, many lose their parental rights the moment they enlist. Many servicemembers lose custody because judges often interpret service and duty relocations as incongruent to the best interest of the child. Presumably, many judges lack the understanding that military service brings familial stability. That being the case, Congress should add a provision in the Servicemembers Civil Relief Act requiring judges to consider all the benefits of military service in the "best interest of the child" analysis. This solution gives military parents a fighting chance to keep …

Why We Need A Merger Cap: An Antitrust Lesson From General Electric, Carl T. Bogus Jan 2025

Why We Need A Merger Cap: An Antitrust Lesson From General Electric, Carl T. Bogus

Journal of Legislation

This Article makes a modest proposal from a radical perspective. The proposal is this: Once a firm reaches a certain size, it should be prohibited from growing larger through mergers or acquisitions. The radical perspective is that antitrust law should be concerned with corporate size. It was a century ago that Louis D. Brandeis coined the term “curse of bigness,” and his concern about the social and political consequences of corporate size has long since fallen out of favor. Today, the consensus view is that antitrust should be concerned exclusively with economics. Current doctrine allows corporations to merge, provided only …

303 Creative, Exclusive Private Enforcement, And Blue-State Revenge, Howard M. Wasserman, Charles W. “Rocky” Rhodes Jan 2025

303 Creative, Exclusive Private Enforcement, And Blue-State Revenge, Howard M. Wasserman, Charles W. “Rocky” Rhodes

Journal of Legislation

Red states have made exclusive private enforcement schemes targeting locally unpopular but constitutionally protected conduct a cornerstone of culture-war legal strategy. Laws such the Texas Heartbeat Act (“S.B. 8”) in 2021 and anti-“WOKE” laws forego public enforcement in favor of private enforcement; this forces targeted federal rights-holders to vindicate their rights by raising the law’s constitutional invalidity as a defense to liability rather than through pre-enforcement offensive litigation against the government or government officials responsible for enforcing the law. This threatens rights-holders with a wave of costly and burdensome litigation and liability.

Blue states and liberal scholars and advocates have …

How Socially Comparing Emerging Research Institutions To Established Research Institutions Informs Proposed Amendments To The Bayh Dole Act, Clovia Hamilton Jan 2025

How Socially Comparing Emerging Research Institutions To Established Research Institutions Informs Proposed Amendments To The Bayh Dole Act, Clovia Hamilton

Marquette Intellectual Property & Innovation Law Review

Emerging research institutions have a problem with their lack of tech transfer, including start-up business formations. This study investigates that issue using social comparison theory as the framework for a novel experimental design. A group of 245 respondents, comprised of STEM faculty members and STEM administrators at emerging research institutions, completed a stated- choice survey based on the social comparison theory. The respondents were assessed on the level and extent that they compare their emerging research institution to well established research institutions with respect to research, technology commercialization, and academic entrepreneurship. Historically Black Colleges and Universities (HBCUs) in America were …

Board Attributes, Firm Performance, And The Moderating Role Of National Culture: A Meta-Analysis, Matthew Farrell, Chris H. Willis, Nathapon Siangchokyoo, Ryan L. Klinger, Jamil Kreugel, Hami Usta, Timiry R. Tian, Ying Thaviphoke, Samuel Wilson Jan 2025

Board Attributes, Firm Performance, And The Moderating Role Of National Culture: A Meta-Analysis, Matthew Farrell, Chris H. Willis, Nathapon Siangchokyoo, Ryan L. Klinger, Jamil Kreugel, Hami Usta, Timiry R. Tian, Ying Thaviphoke, Samuel Wilson

Business

The impact of board structures on firm performance remains a contentious governance topic with competing theoretical paradigms and inconclusive empirical support. Scholars propose that national culture could reconcile contradictory evidence; yet, argumentation is fragmented and direct tests are rare. We meta-analyzed 513 samples across 54 countries to examine relationships between board structures (i.e., board size, board independence, and CEO duality) and firm performance. We model national culture, using Hofstede's six cultural dimensions, as moderators to test whether these relationships align with agency or stewardship theory across different cultural settings.

A Call For North Carolina To Allow Children To Express Their Wishes In Child Custody Proceedings, A Given Right Established In Binding Precedent, Katelynn Gallimore Jan 2025

A Call For North Carolina To Allow Children To Express Their Wishes In Child Custody Proceedings, A Given Right Established In Binding Precedent, Katelynn Gallimore

Campbell Law Review

The purpose of this Comment is to advocate for amending North Carolina’s child custody statute, N.C. Gen. Stat. section 50-13, to require the court to consider a child’s preference as to their custody arrangements to further align with legal precedent. This Comment illustrates the importance of allowing a child to express their wishes to determine the custodial arrangement that is in the best interests of that child. This Comment uses statutes from other states as guidance for proposing reform to the North Carolina General Assembly to consider and propose new legislation. In addition, the right of a child to express …

A Structural Perspective On Bacterial Transcription, Joshua John Brewer Jan 2025

A Structural Perspective On Bacterial Transcription, Joshua John Brewer

Student Theses and Dissertations

Transcription is a highly conserved process that lies at the very center of biology. As in the other two domains of the tree of life, bacterial transcription is a multistep process. In the first step, RNA polymerase (RNAP) contacts with the promoter DNA are established and then must be broken for the enzyme to transition into the elongation phase of RNA production; a process known as promoter escape. While single-molecule and biochemical observations report that promoter escape is a highly regulated and sometimes rate-limiting step in the transcription cycle, the structural details remain obscure. Promoter escape also serves as the …

Comprehensive Universe『SELF』is developed with three sub-Universes: 『Self』W Universe, Ultra Universe I (comprising Tao-Chi Meontology) and Ultra Universe II (comprising Mind-Matter Ontology.) 『SELF』is the “grand system” in which all momentums of T-CoCreativity proceed from states of Non-T-Continuity into Non-T-Continuity.〖『Self』〗^W, the operational transformational copy of 『SELF』, is the system of “individual life, inter-generational continuum -- rationality-optimism, passion-affection, vision-determination and inter-generational duration.” Then, Type I and II Economies are developed respectively on the basis of Ultra Universe I and Ultra Universe II. Finally, systems of “human activism” (HA: HA-I, HA-II) in “transformational systric forms” connect the philosophical and economic systems.

Applying Machine Learning Methods To Generate Understandings Of Differential Item Functioning In A Flu Knowledge Assessment, William L. Romine, Tanvi Banerjee, Derrick Cox Jan 2025

Applying Machine Learning Methods To Generate Understandings Of Differential Item Functioning In A Flu Knowledge Assessment, William L. Romine, Tanvi Banerjee, Derrick Cox

Computer Science and Engineering Faculty Publications

Current influenza trends, including the severity of the 2025 flu season and the prevalence of H5 bird flu in livestock, necessitate efforts to better understand how to educate students about its transmission. Although validated assessments of influenza knowledge exist, these have not been evaluated for affective and demographic biases. We explore differential item functioning (DIF) effects in four items focused on specific aspects of flu transmission derived from a validated influenza knowledge assessment. In doing so, we introduce and utilize a machine learning framework for exploration of DIF which offers greater flexibility than traditional statistical approaches in terms of studying …

Extraction Of Patient Subtypes Using Llm Generated Knowledge Graphs Integrated With A Transformer Architecture, Benjamin Holmes, Cogan Shimizu Jan 2025

Extraction Of Patient Subtypes Using Llm Generated Knowledge Graphs Integrated With A Transformer Architecture, Benjamin Holmes, Cogan Shimizu

Computer Science and Engineering Faculty Publications

Extracting patient subpopulations (clinically relevant cohorts of individuals who share overlapping symptoms, risk factors, or diagnostic criteria) from unstructured medical notes is an ongoing challenge due to the variability of clinical language and the complex nature of patient conditions. We demonstrate a pipeline that combines named entity recognition (NER), transformer embeddings, guided dimensionality reduction, and LLM-mediated knowledge graph integration to enhance patient extraction. The approach begins with NER using the UMLS metathesaurus [1] to extract clinical terms, followed by transformation into vector embeddings using a biomedical transformer. These embeddings are augmented with structured knowledge graph representations generated through an LLM-driven …

The men, women, and children forced into slavery in the Atlantic world came from diverse African societies with long histories of political, economic, and cultural development. They were taken from the trading centers of the Hausa city-states, the farming and artisanal communities of Senegambia, the Kongo and Mbundu polities of West Central Africa, and many other regions. They carried with them agricultural expertise, metallurgical skills, medical knowledge, religious traditions, and oral histories that helped sustain communities in the face of displacement and enslavement.Enslavement did not erase this intellectual and cultural inheritance, nor did it render its victims passive numbers in …

In Harmony: The Environmental Lives Of Marianne North, Beatrix Farrand, And Mary Hunter Austin, Willa Frank

Pomona Senior Theses

This thesis explores the lives and careers of botanical painter Marianne North, landscape architect Beatrix Farrand, and literary nature writer Mary Hunter Austin to examine the interplay of femininity and the representation of nature in the late nineteenth and early twentieth centuries. All three figures had an approach to environmental representation which was based in field work, knowing a place truly, and a sense of harmony between subject and context of the produced work. This method did not occur because they were women or because it was an inherent feature of their assigned sex. Rather, their socialization in the Anglo-American …

Displaced: Distinguishing Housing Outcomes From Judicial Outcomes In Oregon’S Eviction Cases, Colleen Carroll, Minji Cho, Lisa K. Bates

Urban Studies and Planning Faculty Publications and Presentations

In an eviction case, the tenant’s housing outcome refers to whether the tenant remains in their home (the unit) at the end of the eviction process. At the end of the eviction process, either the tenant remained in the home or was displaced. Unfortunately, housing outcomes are not systematically recorded as part of the eviction process. In some cases, the tenant’s housing outcome is recorded in the case records or court documents, but this is not always consistent. To address this, we developed three categories of housing outcomes—remained, displaced, and undeterminable—to measure the outcomes of eviction cases filed in Multnomah …

The Equity Imperative: Transforming Research Coproduction For Impact: Comment On “Research Coproduction: An Underused Pathway To Impact”, Kathleen P. Conte, Marisa Zapata

Urban Studies and Planning Faculty Publications and Presentations

Coproduction is not a new idea in implementation research, health research, or research in general. There is substantial scholarship that establishes its importance and provides guidance and examples for adoption. Given this, why do editorials like Rycroft-Malone et al’s recent paper, "Research Coproduction: An Underused Pathway to Impact," continue to be published, and also, necessary? In this commentary, we discuss the importance of equity - not equality - as the underlying paradigm of coproduction research. We argue that it is the incomplete understanding and adoption of this equity paradigm by researchers and their institutions that inhibit coproduction from being fully …

A Comparative Analysis Of Data-Driven And Model-Based Neutrosophication Methods: Advancing True Neutrosophic Logic In Medical Data Transformation, Maikel Yelandi Leyva Vázquez, Lorenzo Cevallos-Torres, Omar Mar Cornelio, Florentin Smarandache Jan 2025

A Comparative Analysis Of Data-Driven And Model-Based Neutrosophication Methods: Advancing True Neutrosophic Logic In Medical Data Transformation, Maikel Yelandi Leyva Vázquez, Lorenzo Cevallos-Torres, Omar Mar Cornelio, Florentin Smarandache

Branch Mathematics and Statistics Faculty and Staff Publications

Neutrosophic logic extends fuzzy logic by explicitly modeling indeterminacy (I), offering a robust framework for uncertainty representation. The transformation of crisp data into neutrosophic triplets {T, I, F}—known as neutrosophication—is crucial for applying neutrosophic models in real-world analysis. However, comparative evaluations of existing neutrosophication methods remain limited. This study presents a systematic comparison of five approaches: three model-based methods (Parabolic, Threshold Distance, Fuzzy Membership), one density-based method (Kernel Density Estimation), and a proposed data-driven K-Means clustering method integrating sigmoid membership functions. Using a medical dataset of 299 patients and six continuous clinical variables, we assessed statistical behavior, consistency, and alignment …
