Reciprocation And Redistribution: The Emergence Of The Trade-Development Fault Line In The Contemporary Wto, Tana Johnson Jan 2025

Reciprocation And Redistribution: The Emergence Of The Trade-Development Fault Line In The Contemporary Wto, Tana Johnson

Fordham International Law Journal

This Article argues that: 1) trade and development reflect different mindsets and policy implications; 2) both are deeply embedded in the legal past of the World Trade Organization (WTO); and 3) tensions between them jeopardize the WTO’s policymaking future. At the argument’s core is the contrast between “reciprocation” and “redistribution.” Trade is associated with reciprocation (bargaining and two-way concessions), while development is associated with redistribution (assistance and one- way concessions). The WTO’s predecessor—the General Agreement on Tariffs and Trade (GATT)—initially insisted on reciprocation but relaxed that insistence over time, eventually merging with redistribution-related elements of the defunct Havana Charter to …

Reframing Reparations: Sovereign Unjust Enrichment Claims As A Private Law Model For Reparatory Justice, Britta Redwood Jan 2025

Reframing Reparations: Sovereign Unjust Enrichment Claims As A Private Law Model For Reparatory Justice, Britta Redwood

Fordham International Law Journal

Over the past ten years, states in the Caribbean Community and Common Market (CARICOM) have called on European states to make reparations for transatlantic chattel slavery (TCS). CARICOM states have suggested that if former colonial powers were unwilling to adequately respond to their demands for reparations, they would pursue them through judicial means before international tribunals, such as the International Court of Justice (ICJ). If brought, these claims would face major jurisdictional challenges that would make it unlikely that they would be adjudicated on the merits. This Article proposes a novel approach to reparations claims. It demonstrates how these claims …

That's One Small Sale For Man: On The Merits Of American Unilateralism In The Evolution Of International Space Law, Sam Grossman

Fordham International Law Journal

In 2020, the United States National Aeronautics and Space Administration (NASA) awarded four contracts to commercial companies to collect lunar resources as part of its Artemis program. This contract was the culmination of a controversial shift in global space policy, as it came shortly after an executive order from President Donald J. Trump. That executive order articulated America’s policy to encourage “public and private recovery and use of resources in outer space,” and to seek international support in doing so. Further, it reaffirmed the 2015 U.S. Commercial Space Launch Competitiveness Act (the “Space Act”), which entitled American individuals and corporations …

Alert During What? Beyond The "Big O" To A Culturally-Cognizant, Process View Of Entrepreneurial Alertness, Robert J. Pidduck, Daniel R. Clark

Management Faculty Publications

Entrepreneurial alertness is a psychological aptitude generally associated with aspects of nascent venturing, centered on individuals' environmental observations, the association of resources, and idea evaluation. A decade following the Tang et al. (2012) consensus construct and scale, critiques remain questioning its utility and unique value to the major conversations in entrepreneurship. Proponents put great emphasis on entrepreneurial alertness's proven association with opportunity recognition and entrepreneurial actions. Yet, critics suggest it might be an unnecessary step offering little more than a positive association with opportunity recognition in a highly generalized and static way. The purpose of this paper is to address …

A Different Risk-Return Relationship, Aydin Selim Oksoy, Matthew R. Farrell, Shaomin Li Jan 2025

A Different Risk-Return Relationship, Aydin Selim Oksoy, Matthew R. Farrell, Shaomin Li

Management Faculty Publications

We challenge the widely accepted premise that the valuation of an early-stage firm is simply the capital invested (USD) divided by the equity received (%). Instead, we argue that this calculation determines the break-even point for the investor; for example, investing USD 1.0 in exchange for a 10% equity sets a firm-level free cash flow target of USD 10.0, resulting in a 0% return for the investor. The design of our study is that of a descriptive analysis of the phenomenon, based on three assumptions: that angel investing is a two-issue negotiation, that negotiation positions are communicated sequentially from capital …

Management Faculty Publications

Mergers and Acquisitions (M&A) have long intrigued scholars given their size, complexity, and frequent failure. Despite an extensive body of research on M&A, a key limitation in M&A research is the lack of focus on the motives underpinning acquisitions, which may explain frequent mixed and inconclusive results. Much of the existing literature struggles to fully capture the complex and multifaceted nature of these motives, limiting the ability to draw consistent conclusions. In this paper, we review academic and practical perspectives on M&A motives, highlighting both discrepancies and methodological challenges. Our key contributions include a comparison of theoretical and practical insights, …
