Enhancing Library Collections Through Open Education, Matthew L. Timko Jan 2025

Enhancing Library Collections Through Open Education, Matthew L. Timko

College of Law Faculty Publications

The changes to ABA Accreditation Standards for Law Libraries recognize the trend of increasingly digital legal information used by law schools. Interpretation 604-1 reads: “The appropriate mixture of collection formats depends on the needs of the law library and the law school; it need not entail a mixture that includes physical books.” This interpretation will significantly impact how physical spaces are used, but it also provides several opportunities to rethink digital resources, and the audiences served by the law library.

Part of the collection that varies greatly among law libraries is the casebook/course materials collection. Such materials are often cost-prohibitive …

Unraveling The Ties That Bind: How Dobbs And Loper Bright Might Reconfigure American Party Politics, Gregory A. Elinson Jan 2025

Unraveling The Ties That Bind: How Dobbs And Loper Bright Might Reconfigure American Party Politics, Gregory A. Elinson

College of Law Faculty Publications

What happens to partisan politics when long-standing doctrinal equilibria are upended? In search of answers, this essay engages in an extended comparison of two recent landmark Supreme Court rulings: Dobbs v. Jackson Women’s Health Organization, which overruled Roe v. Wade, and Loper Bright Enterprises v. Raimondo, which overruled Chevron USA v. Natural Resources Defense Council.

It begins with the observation that opposition to abortion and judicial deference on the right, and support for abortion and judicial deference on the left, helped unite the major party coalitions, forging durable alliances among elected officials, organized interests, donors, activists, …

An Intelligent Robotic System For Multi-Sensory Cognitive Fatigue Detection To Assist Persons With Paralysis In Activities Of Daily Living, Enamul Karim Jan 2025

An Intelligent Robotic System For Multi-Sensory Cognitive Fatigue Detection To Assist Persons With Paralysis In Activities Of Daily Living, Enamul Karim

Computer Science and Engineering Dissertations - Archive

Assistive robotics is a promising area for improving the quality of life of people with paralysis, specifically through assistance in Activities of Daily Living (ADLs). Current state-of-the-art assistive robotic systems do not have the capability to dynamically modulate their functionality according to the cognitive fatigue level of the user, which can negatively impact their effectiveness and usability in real-life settings.

This dissertation explores an adaptive robotic framework that adjusts its behavior depending on the cognitive fatigue level of users. The system operates in three different modes, and switches between Fully Controlled, Semi-Autonomous, and Fully Autonomous modes. The overall goal is …

Fair And Sustainable Machine Learning: A Holistic Approach To Data Quality, Efficiency, And Resource-Aware Training, Zahidur Rahim Talukder Jan 2025

Fair And Sustainable Machine Learning: A Holistic Approach To Data Quality, Efficiency, And Resource-Aware Training, Zahidur Rahim Talukder

Computer Science and Engineering Dissertations - Archive

The increasing reliance on distributed, privacy-sensitive data has driven the emergence of Federated Learning (FL) as a transformative paradigm for collaborative machine learning. By enabling multiple client devices to train a shared global model without transferring raw data, FL offers significant privacy advantages. However, real-world deployments of FL are constrained by critical challenges such as data heterogeneity, client unreliability, and hardware disparities. These factors lead to uneven model convergence, degraded global accuracy, and fairness issues that threaten FL's scalability and inclusivity in diverse environments.

This dissertation investigates these challenges and proposes three novel algorithmic frameworks to advance the state-of-the-art in …

Exploring Emerging Memory Technologies For Enhancing Data Center Applications, Zhen Lin Jan 2025

Exploring Emerging Memory Technologies For Enhancing Data Center Applications, Zhen Lin

Computer Science and Engineering Dissertations - Archive

The rapid evolution of memory and storage technologies is fundamentally reshaping the design of operating systems and data management. Emerging devices such as persistent memory, NVMe SSDs, and Compute Express Link (CXL)--enabled hybrid memory modules introduce new opportunities for high-performance, cost-efficient data management, yet they also expose limitations in traditional software abstractions. File systems, originally designed for slow block-based devices, incur excessive overhead on ultra-low-latency media, while block-level caches suffer from metadata and eviction inefficiencies. Moreover, hardware-managed tiering provides transparency but restricts adaptability across workloads. These challenges highlight the need to rethink caching and tiered memory management across multiple system …

The Excessive Fines Clause In The Federal Courts: A Quarter-Century Of Narrowing, Michael M. O'Hear Jan 2025

The Excessive Fines Clause In The Federal Courts: A Quarter-Century Of Narrowing, Michael M. O'Hear

Faculty Publications

The Eighth Amendment prohibits “excessive fines,” but what exactly does “excessive” mean? The question has taken on some urgency in recent years as American legislatures have sharply increased the economic penalties associated with criminal convictions. In 1998, in United States v. Bajakajian, the Supreme Court for the first time established a test of sorts to determine whether an economic penalty is “excessive” in violation of the Eighth Amendment. The test was not without its ambiguities but offered some potentially robust protection against the rising tide of fines, fees, forfeiture, and restitution. However, the promise of Bajakajian has been undermined …

Beyond Agency Authority: Regulating Sulfur Hexafluoride Under An Enhanced Title Ii Framework Of The Clean Air Act, Matthew Gawley Jan 2025

Beyond Agency Authority: Regulating Sulfur Hexafluoride Under An Enhanced Title Ii Framework Of The Clean Air Act, Matthew Gawley

Fordham Environmental Law Review

This paper explores the critical need for robust Congressional action to regulate sulfur hexafluoride (SF6), a greenhouse gas with a global warming potential more than 20,000 times greater than carbon dioxide. Recent Supreme Court decisions––in West Virginia v. EPA and Loper Bright Enterprises v. Raimondo––to restrict EPA authority and end the Chevron doctrine have curtailed federal environmental agencies’ regulatory authority, shifting the responsibility for addressing major environmental challenges back to Congress. Despite being addressed under Title I of the Clean Air Act (CAA) through the 2022 Inflation Reduction Act (IRA), current SF6 regulations prove grossly inadequate. The utilities industry––the largest …

The Feminicide Epidemic In Brazil: An Analysis Considering The Convention Of Belém Do Pará And The Rome Statute, Suzana Coelho Da Silva

Human Rights Brief

Gender-based violence against women is an issue little discussed both in academia and in various sectors of society. Men in positions of power block any attempts by women to be observed in places of influence and visibility, reflecting a patriarchal society that sees women as inferior, fragile beings incapable of exercising functions that requires intelligence, strength, and rationality.

The pressing need to address mass atrocities, including ethnic conflicts and political unrest, highlights the legal and moral dilemmas associated with humanitarian interventions.

How Pretrial Detention Deprives A Child’S Access To Education: The Convention On The Rights Of The Child And The Juvenile Justice Reform Act, Abby Groetsch Jan 2025

How Pretrial Detention Deprives A Child’S Access To Education: The Convention On The Rights Of The Child And The Juvenile Justice Reform Act, Abby Groetsch

Human Rights Brief

Although the United States (“U.S.”) has not ratified the Convention on the Rights of the Child, which specifically outlines the rights of juvenile defendants, the Supreme Court’s interpretation of the Fifth and Fourteenth Amendments provides implicit rights for children accused of criminal acts. In 1967, the Supreme Court decided In re Gault, definitively establishing that the Due Process Clause of the Fourteenth Amendment applied to juvenile defendants. The Supreme Court has also stated that children should be treated differently than adults, outlining different sentencing requirements for crimes committed while a person is under the age of eighteen.

Upholding The Absolute Prohibition Of Torture: Afchpr On Detention In Tanzania, Aly Orvis

Human Rights Brief

On September 3, 2024, the African Court on Human and Peoples’ Rights (AfCHPR) rendered its decision in Habyalimana Augustino and Muburu Abdulkarim v. United Republic of Tanzania. The case involved two Burundian nationals who, as refugees in Tanzania, were implicated in a murder-for-hire scheme. This scheme was allegedly orchestrated by Mama Mboya—the wife of a high ranking commanding officer who suspected the victim of having an affair with her husband. Convicted in 2007, the applicants were sentenced to death by hanging. In their petition to the AfCHPR, they argued that they had been subjected to torture and inhumane conditions at …

Kobaliya V. Russia: Curtailing Civil Society Through Labels Of Foreign Influence., Alida Blendonohy

Human Rights Brief

In a January 2025 judgment, the European Court of Human Rights (“ECtHR”) held in the case of Kobaliya and Others v. Russia that the application of Russia’s foreign agent legislation violated Articles 8, 9 and 10 of the European Convention on Human Rights (“ECHR”) which protect the rights to freedom of expression, freedom of association, and respect for private and family life.

In Kobaliya, the ECtHR assessed Russia’s foreign agent legislation, its evolution since 2012, and its increasing restrictiveness. In its initial 2012 enactment, the law applied to nongovernmental organizations (“NGOs”) that participated in political activity with foreign funding, …

Study On Motion Prediction Analysis Of Large Vessels Entering Kaohsiung Port Second Harbor, Li-Heng Cheng, Hsing-Yu Wang

Journal of Marine Science and Technology–Taiwan

Pilotage is a primary service offered by ports, ensuring the safe passage of entering and exiting vessels. This study applied motion prediction analysis to large vessels navigating the constrained waterways of Kaohsiung Port’s second harbor. To address the needs of pilots and port operators, a simplified planar motion equation was developed that incorporated speed over ground and rate of turn (ROT) as primary variables. The model relied on inputs of limited navigational data, enabling pilots to predict changes in heading and position over time and determine the conditions for safe harbor entry. Vessel paths and turning angles were analyzed to …

Maritime Piracy Risk Index For Ship Safety, Sang-Lok Yoo, Cho-Young Jung

Journal of Marine Science and Technology–Taiwan

This study presents a comprehensive analysis of the development and implementation of a piracy risk index, crucial for enhancing maritime security and safeguarding the global shipping industry. By integrating both qualitative and quantitative assessments, the research offers a nuanced understanding of piracy risks across various maritime regions. The qualitative assessment incorporates the terrorism index and arms trafficking index, which are averaged and scaled to reflect the underlying socio-political factors influencing piracy. The quantitative assessment utilizes the exponentially weighted moving average (EWMA) to dynamically capture the frequency and severity of piracy incidents over time. The findings reveal significant regional variations in …

Niedoskonałości Rynku I Pomoc Publiczna W Transporcie Kolejowym, Elzbieta Głowicka

internetowy Kwartalnik Antymonopolowy i Regulacyjny (internet Quarterly on Antitrust and Regulation)

Rail transport has a number of characteristics that prevent it from operating efficiently through market forces alone. These include: the natural monopoly of rail infrastructure, the external effects of companies’ decisions, public service nature, coordination failure, information asymmetry, and imperfect competition. State aid to railway undertakings can influence economic incentives to enhance market efficiency. The European Commission’s draft guidelines on land and multimodal transport and its block exemptions in the transport sector address this need.
