Beyond Agency Authority: Regulating Sulfur Hexafluoride Under An Enhanced Title Ii Framework Of The Clean Air Act, Matthew Gawley
Beyond Agency Authority: Regulating Sulfur Hexafluoride Under An Enhanced Title Ii Framework Of The Clean Air Act, Matthew Gawley
Fordham Environmental Law Review
This paper explores the critical need for robust Congressional action to regulate sulfur hexafluoride (SF6), a greenhouse gas with a global warming potential more than 20,000 times greater than carbon dioxide. Recent Supreme Court decisions––in West Virginia v. EPA and Loper Bright Enterprises v. Raimondo––to restrict EPA authority and end the Chevron doctrine have curtailed federal environmental agencies’ regulatory authority, shifting the responsibility for addressing major environmental challenges back to Congress. Despite being addressed under Title I of the Clean Air Act (CAA) through the 2022 Inflation Reduction Act (IRA), current SF6 regulations prove grossly inadequate. The utilities industry––the largest …
The Feminicide Epidemic In Brazil: An Analysis Considering The Convention Of Belém Do Pará And The Rome Statute, Suzana Coelho Da Silva
The Feminicide Epidemic In Brazil: An Analysis Considering The Convention Of Belém Do Pará And The Rome Statute, Suzana Coelho Da Silva
Human Rights Brief
Gender-based violence against women is an issue little discussed both in academia and in various sectors of society. Men in positions of power block any attempts by women to be observed in places of influence and visibility, reflecting a patriarchal society that sees women as inferior, fragile beings incapable of exercising functions that requires intelligence, strength, and rationality.

Humanitarian Interventions On The Crossroads Of Legality And Legitimacy, Asya Gasparyan
Human Rights Brief
In an era marked by persistent geopolitical conflicts and recurring human rights crises, the discourse surrounding humanitarian interventions (“HI”) and the role of the United Nations in this complex arena is of paramount importance. The pressing need to address mass atrocities, including ethnic conflicts and political unrest, highlights the legal and moral dilemmas associated with humanitarian interventions.
How Pretrial Detention Deprives A Child’S Access To Education: The Convention On The Rights Of The Child And The Juvenile Justice Reform Act, Abby Groetsch
Human Rights Brief
Although the United States (“U.S.”) has not ratified the Convention on the Rights of the Child, which specifically outlines the rights of juvenile defendants, the Supreme Court’s interpretation of the Fifth and Fourteenth Amendments provides implicit rights for children accused of criminal acts. In 1967, the Supreme Court decided In re Gault, definitively establishing that the Due Process Clause of the Fourteenth Amendment applied to juvenile defendants. The Supreme Court has also stated that children should be treated differently than adults, outlining different sentencing requirements for crimes committed while a person is under the age of eighteen.

Upholding The Absolute Prohibition Of Torture: Afchpr On Detention In Tanzania, Aly Orvis
Human Rights Brief
On September 3, 2024, the African Court on Human and Peoples’ Rights (AfCHPR) rendered its decision in Habyalimana Augustino and Muburu Abdulkarim v. United Republic of Tanzania. The case involved two Burundian nationals who, as refugees in Tanzania, were implicated in a murder-for-hire scheme. This scheme was allegedly orchestrated by Mama Mboya—the wife of a high ranking commanding officer who suspected the victim of having an affair with her husband. Convicted in 2007, the applicants were sentenced to death by hanging. In their petition to the AfCHPR, they argued that they had been subjected to torture and inhumane conditions at …

Kobaliya V. Russia: Curtailing Civil Society Through Labels Of Foreign Influence., Alida Blendonohy
Human Rights Brief
In a January 2025 judgment, the European Court of Human Rights (“ECtHR”) held in the case of Kobaliya and Others v. Russia that the application of Russia’s foreign agent legislation violated Articles 8, 9 and 10 of the European Convention on Human Rights (“ECHR”) which protect the rights to freedom of expression, freedom of association, and respect for private and family life.
In Kobaliya, the ECtHR assessed Russia’s foreign agent legislation, its evolution since 2012, and its increasing restrictiveness. In its initial 2012 enactment, the law applied to nongovernmental organizations (“NGOs”) that participated in political activity with foreign funding, …

Study On Motion Prediction Analysis Of Large Vessels Entering Kaohsiung Port Second Harbor, Li-Heng Cheng, Hsing-Yu Wang
Journal of Marine Science and Technology–Taiwan
Pilotage is a primary service offered by ports, ensuring the safe passage of entering and exiting vessels. This study applied motion prediction analysis to large vessels navigating the constrained waterways of Kaohsiung Port’s second harbor. To address the needs of pilots and port operators, a simplified planar motion equation was developed that incorporated speed over ground and rate of turn (ROT) as primary variables. The model relied on inputs of limited navigational data, enabling pilots to predict changes in heading and position over time and determine the conditions for safe harbor entry. Vessel paths and turning angles were analyzed to …

Maritime Piracy Risk Index For Ship Safety, Sang-Lok Yoo, Cho-Young Jung
Journal of Marine Science and Technology–Taiwan
This study presents a comprehensive analysis of the development and implementation of a piracy risk index, crucial for enhancing maritime security and safeguarding the global shipping industry. By integrating both qualitative and quantitative assessments, the research offers a nuanced understanding of piracy risks across various maritime regions. The qualitative assessment incorporates the terrorism index and arms trafficking index, which are averaged and scaled to reflect the underlying socio-political factors influencing piracy. The quantitative assessment utilizes the exponentially weighted moving average (EWMA) to dynamically capture the frequency and severity of piracy incidents over time. The findings reveal significant regional variations in …

Rail transport has a number of characteristics that prevent it from operating efficiently through market forces alone. These include: the natural monopoly of rail infrastructure, the external effects of companies’ decisions, public service nature, coordination failure, information asymmetry, and imperfect competition. State aid to railway undertakings can influence economic incentives to enhance market efficiency. The European Commission’s draft guidelines on land and multimodal transport and its block exemptions in the transport sector address this need.

Housing Sexual Harassment: A Department Of Justice Case Study, Rigel C. Oliveri
Housing Sexual Harassment: A Department Of Justice Case Study, Rigel C. Oliveri
Faculty Publications
Sexual harassment in housing-when tenants or prospective tenants are sexually harassed by their landlords, housing providers, or other people associated with their housing-is a clear national problem. In 2019 the Department of Justice (DOJ) and the Department of Housing and Urban Development (HUD) announced an initiative to bring attention to this issue, as well as a shared commitment to increased enforcement against harassers.
This enforcement push provides an opportunity for study. In particular, there are now a significant number of complaints and other litigation documents posted to the DOJ's website that provide a convenient and robust sample for analysis. The …
A Silence After Slaughter-House: Nineteenth-Century State Constitutional Substantive Rights, Liberties, And Privileges, Charles W. "Rocky" Rhodes
A Silence After Slaughter-House: Nineteenth-Century State Constitutional Substantive Rights, Liberties, And Privileges, Charles W. "Rocky" Rhodes
Faculty Publications
In rejecting federal constitutional challenges to the Louisiana legislature’s exclusive butchering grant in the Slaughter-House Cases, the United States Supreme Court opined that it was the states’ obligation to protect fundamental privileges, such as rights to acquire and possess property, engage in trade and commerce, and pursue happiness, subject only to those restraints necessary for the public good. But the states met this charge with silence. State courts across the nation consistently parroted Slaughter-House’s reasoning, even while occasionally acknowledging the decision did not bind their interpretation of state constitutional provisions guaranteeing fundamental rights, liberties, privileges, and immunities. Although two states …
Comparative Lessons For Enhancing Representation In The U.S. Judiciary - And Countering Democratic Decline, Shruti Rana
Comparative Lessons For Enhancing Representation In The U.S. Judiciary - And Countering Democratic Decline, Shruti Rana
Faculty Publications
At this precarious moment for democratic institutions and the rule of law in the United States, this Essay draws upon efforts to build more representative judiciaries in other countries and in international fora to identify promising strategies for enhancing representation in the U.S. judiciary, particularly with respect to gender and parity. 23 It argues that efforts to enhance judicial representation and parity in the United States could benefit from incorporating and building upon international legal principles and the practices of international courts, institutions, and organizations with respect to parity and representation. Crucially, at the same time, efforts to ensure greater …
Evergreening's Empirical Chasm, Erika Lietzan
Evergreening's Empirical Chasm, Erika Lietzan
Faculty Publications
For more than two decades, policymakers have been told that pharmaceutical innovators companies engage in a practice that is called, disparagingly, “evergreening.” The basic idea is that companies introduce new versions of their drugs that have later expiring patents or regulatory exclusivity. This way, the claim goes, the companies effectively block generic entry for years or decades longer than Congress intended and than is socially desirable. Initially these claims were supported by poorly researched anecdotes. In the last decade, some scholars and advocacy organizations have published papers that purport to provide empirical support for the “evergreening” accusation. But these empirical …
Tax Base Diversification As An Enforcement Tool, David Gamage, Brian Galle, Yulia Kuchumova
Tax Base Diversification As An Enforcement Tool, David Gamage, Brian Galle, Yulia Kuchumova

We examine when it is optimal to employ sales or VAT-type taxes as complements to a labor income tax. We find a Ramsey-type result in which each tax instrument should be imposed in inverse proportion to the combined elasticity of real and avoidance responses to the respective tax. Contrary to some prior results, we find that sales-type taxes are optimally non-zero across a variety of settings, and in particular when the (weighted) elasticity of taxable income with respect to the wage tax is greater than the cross-elasticity of taxable income with respect to the sales tax. We argue this parameter …

303 Creative, Exclusive Private Enforcement, And Blue-State Revenge, Charles W. "Rocky" Rhodes, Howard W. Wasserman
Faculty Publications
Red states have made exclusive private enforcement schemes targeting locally unpopular but constitutionally protected conduct a cornerstone of culture-war legal strategy. Laws such the Texas Heartbeat Act (“S.B. 8”) in 2021 and anti-“WOKE” laws forego public enforcement in favor of private enforcement; this precludes federal rights-holders from vindicating their rights through pre-enforcement offensive litigation in federal court against the government or government officials responsible for enforcing the law. This threatens rights-holders with defending a state-court wave of costly and burdensome litigation to adjudicate the law’s constitutional validity.
Blue states and liberal scholars and advocates have sought a progressive counterpart targeting …
Scratching Behavior Of Copper-Niobium Nanolaminates, Matthew C. Peterson
Scratching Behavior Of Copper-Niobium Nanolaminates, Matthew C. Peterson
Graduate Research Theses & Dissertations
Metal nanolaminates are known in material science for their unique mechanical properties and high strength due to their interface behavior. Cu/Nb nanolaminates specifically are studied for their uses in electronics due to their good conductivity and superior tensile strength compared to copper conductors, as well as their radiation resistance in radioactive environments. Currently, most molecular dynamics (MD) simulations of Cu/Nb simulations are axially loaded. This work attempts to characterize the scratching behavior of Cu/Nb nanolaminates with varying indenter size, temperature, speed, and layer thickness. The coefficient of friction (CoF), friction force, normal force, and material removal were then compared. A …

Exploring Approaches To Address Racial Discrimination, Stigma, And Provider Communication In Sickle Cell Disease Pain Management Through Interprofessional Education And Collaboration, Ronisha Edwards-Elliott
Graduate Research Theses & Dissertations
This dissertation presents research across three publishable manuscripts that investigate why structural and systemic racism persist among patients with sickle cell disease (SCD) seeking pain management, and how interprofessional collaboration and education can help reduce disparities through shared learning, accountability, and standardized care (Chapters Two through Four). A scoping review identifies current interventions and strategies aimed at sharing the pain experiences and feelings of being unheard by SCD patients (Chapter Two). Findings of the scoping review revealed that although interventions and strategies exist and have been tested, the lack of implementation or buy-in from healthcare professionals has allowed racial discrimination …
The Effects Of A History Of Child Trauma On Breastfeeding Outcomes, Emily Flynn
The Effects Of A History Of Child Trauma On Breastfeeding Outcomes, Emily Flynn
Graduate Research Theses & Dissertations
Breastfeeding provides significant health benefits for both parent and child, yet many parents discontinue earlier than recommended. While childhood sexual abuse has been associated with breastfeeding difficulties, limited research has examined the broader effects of other forms of childhood maltreatments on breastfeeding outcomes. This cross-sectional study examined the relationship between a history of childhood trauma and breastfeeding outcomes, with social support explored as a potential moderator. Participants (n = 194) were birthing parents of children under the age of five, recruited from online parenting communities. Measures included the Adverse Childhood Experience International Questionnaire (ACE-IQ), a breastfeeding duration item, and a …
