The Decline Of Coordinated Effects Enforcement And How To Reverse It, D. Daniel Sokol, Sean P. Sullivan Jan 2025

The Decline Of Coordinated Effects Enforcement And How To Reverse It, D. Daniel Sokol, Sean P. Sullivan

Florida Law Review

Opposition to anticompetitive coordination once animated merger policy. But evidence now suggests that coordinated effects challenges are disfavored and rarely pursued. This stark change in enforcement is both puzzling and troubling. Coordinated effects challenges are antitrust law’s best and often only opportunity to combat anticompetitive coordination in concentrated markets. Why are coordinated effects theories not being vigorously pursued? This Article exposes the decline in coordinated effects enforcement and the threat it poses to the maintenance of competitive markets. It does so in three steps. First, it surfaces the special role that coordinated effects enforcement plays in the antitrust framework. Second, …

Exploring Neuromyths In Counselor Education: A Neuro-Informed Cognitive Behavioral Therapy Approach, James R. Spears, Natasha Villalobos, Whitney Zahar-Rich, Priscilla R. Prasath, Willie Ray

Teaching and Supervision in Counseling

Although advances in neuroscience validate the therapeutic practices and professional identity of counselors, educators struggle to infuse accurate neuroscience knowledge into the classroom. Utilizing a quasi-experimental, repeated measures design, this study examined the effectiveness of a neuro-informed lecture in reducing neuromyth endorsement among graduate students enrolled in the counseling theories course. Participants (n = 62) completed a demographics questionnaire and identical neuroscience pre- and post-surveys. The intervention group (n = 32) received the lecture-based intervention, while those in the comparison group (n = 30) did not. Results revealed significant improvement in neuroscience knowledge scores for those receiving the lecture (pre: …

“I Feel As Though I Would Not Be Able To Empathize”: Intersectionality And Counselor Intergroup Anxiety, Krista M. Malott, Edward Wahesh, Tina Paone, Amber S. Haley, Alexis Mcclatchy Jan 2025

“I Feel As Though I Would Not Be Able To Empathize”: Intersectionality And Counselor Intergroup Anxiety, Krista M. Malott, Edward Wahesh, Tina Paone, Amber S. Haley, Alexis Mcclatchy

Teaching and Supervision in Counseling

Researchers applied a thematic analysis in this study to examine the nature of master-level counseling students’ (N = 19) intergroup anxiety (IA), a form of bias characterized by an anxious response to others based on negative views of that person’s identity (Stephan, 2014). Students cited stronger IA reactions toward persons with multiple identity traits (i.e., intersectionality). Traits chosen varied widely, some being dominant (e.g., White, male, able-bodied), and others, minoritized in nature (e.g., Black, Muslim, disabled). Thematic explanations for IA reactions varied, including a fear of client judgement, prior negative experiences with persons of certain traits, limited knowledge of clients’ …

Forging Ahead In Florida: Teaching And Supervision Strategies In The Face Of Legislative Restrictions And Medical Bans, Ali Cunningham Abbott, Taylor Irvine, Lauren Shure, Hannah Bayne, Robert Freund, Hannah Bowers

Teaching and Supervision in Counseling

As a nation and a profession, we have witnessed a spark in the momentum and uplifting of social justice movements and advocacy concerning the ongoing oppression of Black, Indigenous, and People of Color (BIPOC) as well as sex and gender-expansive (SGE) people in our community. In response, Florida and other states face an onslaught of restrictive medical bans and legislative bills surrounding how counselors and educators address race, sexuality, and gender in treatment and training programs. Florida has notably been at the forefront of adopting this legislation, not only regulating instructor-led discussion around racism, same-sex relationships, and gender identity in …

Two Justifications For The Major Questions Doctrine, Cass R. Sunstein Jan 2025

Two Justifications For The Major Questions Doctrine, Cass R. Sunstein

Florida Law Review

There are two justifications for the major questions doctrine. The first justification, vigorously offered by Justice Neil Gorsuch, might be described as Lockean; it sees the doctrine as an effort to preserve legislative primacy and to reduce the policymaking authority of the executive branch. On the Lockean view, the major questions doctrine is a clear-statement principle, and it is in evident tension with textualism. The second justification, vigorously offered by Justice Amy Coney Barrett, might be described as Wittgensteinian; it sees the doctrine as an effort to capture Congress’s likely instructions. The Wittgensteinian justification fits comfortably with textualism, and it …

Liquidation And The Fourteenth Amendment, Susan D. Carle Jan 2025

Liquidation And The Fourteenth Amendment, Susan D. Carle

Florida Law Review

In Dobbs v. Jackson Women’s Health Organization and New York State Rifle & Pistol Ass’n v. Bruen, the Supreme Court adopted a new standard for interpreting the Fourteenth Amendment. This standard, which this Article refers to as maximum-specificity public meaning analysis, seeks to determine original public meaning at a very concrete level of specificity based on the laws in effect on the date of the Amendment’s ratification. As Justice Barrett observed in her concurrence in Bruen, however, that approach will give rise to many difficult questions. James Madison’s concept of liquidation may provide a useful though limited supplement …

Canceling Appellate Precedent, Lisa A. Tucker, Michael Risch Jan 2025

Canceling Appellate Precedent, Lisa A. Tucker, Michael Risch

Florida Law Review

In recent years, since soon after Justice Amy Coney Barrett assumed her seat on the United States Supreme Court, the Court has erased more than thirteen politically and legally significant opinions written by the federal appeals courts. In deciding to vacate rather than simply deny certiorari, the Court has eliminated—with one sentence orders that offer no explanation—fully briefed, argued, and reasoned opinions on issues such as abortion, the Voting Rights Act, President Trump’s travel ban, and the Emoluments Clause. Consequently, progressive victories in those areas no longer stand. The Supreme Court used its power to “vacate” lower court rulings, which …

Becoming A Doctrine, Allison Orr Larsen Jan 2025

Becoming A Doctrine, Allison Orr Larsen

Florida Law Review

On the last day of the 2021–22 Term, the Supreme Court handed down a decision on “the major questions doctrine” and granted certiorari to hear a case presenting “the independent state legislature doctrine”—neither of which had been called “doctrines” there before. This raises a fundamental and underexplored question: how does a doctrine become a doctrine? Law students know the difference between doctrinal classes and seminars, but how does an idea bantered about in a seminar (say, about agencies deciding major questions) become a “doctrine” complete with judicial tests, steps, and exceptions? Taking an analogy to medicine, when does …

Supreme Court Litigators In The Age Of Textualism, Aaron-Andrew P. Bruhl Jan 2025

Supreme Court Litigators In The Age Of Textualism, Aaron-Andrew P. Bruhl

Florida Law Review

The Supreme Court’s approach to statutory interpretation has moved in a textualist direction over the last several decades, but there is little systematic information on how litigators’ briefing practices have changed during this era of textualist ascendancy. This Article examines thirty-five years’ worth of party briefs (over 8,000 briefs total), explores the briefs’ use of interpretive tools (including differences across categories of attorneys), and compares the briefs to the Court’s opinions. This examination yields several valuable findings. Although the briefs show a textualist shift, they differ from the Court’s opinions in a few ways. The magnitude of the textualist shift …

International Journal of Exercise Science

International Journal of Exercise Science 18(4): 206-214, 2025. The objective was to explore the prevalence of exercise dependence (ED) risk among regular HIFT exercisers. Secondary objectives include exploring the prevalence of injuries within this population and examining the potential association between ED risk and injury prevalence. This cross-sectional study was conducted in a city in southern Brazil and included HIFT practitioners. ED was evaluated using the Exercise Dependence Scale-Revised (EDS-R). The primary outcome was the prevalence of ED risk. The final analysis included 64 HIFT practitioners, of whom the majority were female (n = 35; 54.7%). The mean EDS-R …

The Influence Of Environmental Knowledge On Pro-Environmental Lifestyles Of Ui Vocational Students Domiciled In The Jabodetabek Area, Sartika Ekadyasa, Arius Krypton

Jurnal Vokasi Indonesia

The environmental crisis demands the younger generation, especially students, to play an active role in implementing an environmentally friendly lifestyle. This study aims to determine the influence of environmental knowledge on the pro-environmental lifestyle of students in the Jabodetabek area. Using a quantitative survey method on 100 students, the data was analyzed through simple linear regression. The results showed that environmental knowledge significantly influenced pro-environmental lifestyle (p < 0.05), while family support and access to environmentally friendly facilities also played important roles. These findings support the importance of environmental education at the college level to shape sustainable behavior.

The Canyon Revisited-A Rephotography Of The Grand Canyon 1923/1991, By Donald L. Baars And Rex C. Buchanan, Allen Cichanski

The Geographical Bulletin

What an interesting and remarkable little book based on a very clever premiseto duplicate as closely as possible in 1991 the extensive photographic record of the 1923, Birdseye-USGS Expedition through the Grand Canyon. From the time of the first expedition through the Grand Canyon in 1868 by John Wesley Powell until 1923, only 29 explorers had endured the hardships of boat travel down the Colorado through the full length of the Canyon. A far greater number of climbers have reached the summit of Mt. Everest as of today! Are there many or even any places left on Earth today that …

A Geography Of Pennsylvania By E. Willard Miller, Editor., Reed F. Stewart Jan 2025

A Geography Of Pennsylvania By E. Willard Miller, Editor., Reed F. Stewart

The Geographical Bulletin

Pennsylvania is a fascinating place, or a collection offascinating places, and one can study its geographies and learn a great deal about the United States and, indeed, about the world. This large book gives one the opportunity to do just that and to learn a great deal about geographic thinking, analysis, reasoning, opinions, and conclusions. It is factual, systematic, in at least two senses of that term, and regional.

Rainfall Distribution Along Coastal Guyana, 1901-1980, Robert Ramraj Jan 2025

Rainfall Distribution Along Coastal Guyana, 1901-1980, Robert Ramraj

The Geographical Bulletin

Data over an 80-year period from Georgetown, Guyana were analyzed to determine rainfall patterns along the coastal plain. Data revealed that two distinct wet and two dry seasons occur annually and that a high probability exists that annual rainfall almost never surpasses nor lags behind that of the previous year for more than two consecutive years. Additionally, it is concluded that rainfall was heavier during 1941-1980 than during the previous 40 years, and that interannual and interdecadal variability existed during the study period . Apart from their practical application in planning and water resource management, studies of this nature can …

A Home For The Homeless? Residents' Perceptions Of The Armitage Homeless Camp., Cindy L. Mendoz Jan 2025

A Home For The Homeless? Residents' Perceptions Of The Armitage Homeless Camp., Cindy L. Mendoz

The Geographical Bulletin

Responding to a shortage in local shelter space and a preference for alternative forms of shelter, homeless people in Lane County, Oregon, took shelter unlawfully at the Armitage Homeless Camp (AHC). This paper examines the residents' sense of place, concepts of home, and perceptions of the camp in an attempt to gauge the meaning and value of AHC from the perspective of urban campers. Data were collected from November to May, 1993, through participant observation, interviews, and surveys in the forms of questionnaires, cognitive mapping, and selfdirected photography. The data suggest that the campers identified with the environment and community …
