Reforming Lawyers Into Irrelevance?: Reconciling Crisis And Constraint At The Office Of Legal Counsel , Peter Margulies

Pepperdine Law Review

A Predator drone attack in Pakistan and the "enhanced interrogation techniques" that the Bush administration used on suspected terrorists have at least one thing in common: legal advice. While advice given the Obama administration on drones has received only a partial airing, disclosure that lawyers in the Justice Department’s Office of Legal Counsel (OLC) authorized coercive interrogation after 9/11 has ignited a wide-ranging debate on reform and accountability. However, the volume of calls for reform has exceeded consideration of the competing values at stake. Some reformers stress the need to combat a climate of impunity with formal sanctions such as …

Overreach On The High Seas?: Whether Federal Maritime Law Preempts California's Vessel Fuel Rules , Bradley D. Easterbrooks Sep 2012

Overreach On The High Seas?: Whether Federal Maritime Law Preempts California's Vessel Fuel Rules , Bradley D. Easterbrooks

Pepperdine Law Review

This Comment addresses whether California’s Vessel Fuel Rules, which require all foreign and U.S. flagged vessels traveling within twenty-four miles of California's coastline to use low-sulfur content fuels, is preempted by the Supremacy Clause of the U.S. Constitution. More specifically, this Comment addresses whether the Clean Air Act, the International Convention for the Prevention of Pollution from Ships (MARPOL), the Submerged Lands Act, and/or general principles of federal maritime law prohibit the California Air Resources Board from enforcing its Vessel Fuel Rules against vessels engaged in maritime commerce in navigable waters, particularly waters beyond the three-mile band beyond the California …

Experience-Based Opinion Testimony: Strengthening The Lay Opinion Rule , Anne Bowen Poulin Sep 2012

Experience-Based Opinion Testimony: Strengthening The Lay Opinion Rule , Anne Bowen Poulin

Pepperdine Law Review

Determining whether experience-based opinion should be evaluated as lay or as expert opinion has proven particularly challenging to the courts. The Federal Rules of Evidence were amended in 2000, adopting specific, more stringent requirements for expert testimony and hardening the line between lay and expert opinion. Expert opinion testimony is admissible only if based on reliable methodology, whereas lay opinion must be rationally derived using everyday reasoning. The decisions applying the rules do not strike the right balance in regard to experience-based opinion. Too often, courts either accept claims of experience-based expertise at face value or admit experience-based opinion as …

“Offsetting” Crisis? - Climate Change Cap-And-Trade Need Not Contribute To Another Financial Meltdown , Victor B, Flatt Sep 2012

“Offsetting” Crisis? - Climate Change Cap-And-Trade Need Not Contribute To Another Financial Meltdown , Victor B, Flatt

Pepperdine Law Review

In 2009, the promise of a comprehensive federal cap and trade bill to address climate change fell apart. At least in part, this was due to the fears that exotic 'carbon' financial instruments might cause more financial crises. As California launches it economy wide carbon trading system, and other regional systems and the even possibly the EPA consider cap and trade, it is important to revisit what, if anything, about carbon denominated financial instruments might lead to financial market problems. The most problematic of the instruments, offsets, can be designed to lessen financial risk from underlying asset failure.

Access To Consumer Remedies In The Squeaky Wheel System , Amy J. Schmitz Sep 2012

Access To Consumer Remedies In The Squeaky Wheel System , Amy J. Schmitz

Pepperdine Law Review

This article explores the “Squeaky Wheel System” (“SWS”) in business-to-consumer (“B2C”) contexts, referring to merchants’ reservation of purchase remedies and other contract benefits for only the relatively few “squeaky wheel” consumers who have the requisite information and resources to persistently seek assistance. The article uncovers how this system fosters contractual discrimination and hinders consumers’ awareness and access with respect to contract remedies. It also adds empirical insights from my recent e-survey, and offers suggestions for using the internet to empower consumers of all economic and status levels with efficient and accessible means for learning about their purchase rights and asserting …

Cyberinfants , Cheryl B. Preston Sep 2012

Cyberinfants , Cheryl B. Preston

Pepperdine Law Review

Teens have emerged as a significant market segment, especially with respect to online goods and services. This increased market presence is likely to foreground the contract infancy doctrine, which permits a person under age eighteen to void a contract with a few exceptions. This article provides solid foundations for a discussion of where the doctrine fits in the face of a rising youth market and the digital revolution. Part II covers the general parameters of the infancy doctrine and dispels the notion that the doctrine will not be applicable to online services. This part critiques the one case that has …

Examining The Guidelines For Assessment And Instruction In Statistics Education In Relation To Teaching Styles Priorities In Introductory Statistics Courses., Kristin Woods

Faculty Articles & Research

The American Statistical Association (2005) describes a need to "reexamine and review many introductory statistics courses to help achieve the important learning goals for students" (p. 10). The goal of introductory statistics courses is to produce students who are statistically educated. Statistics educators for many years have been concerned with reforming the introductory course in statistics, a "non-calculus based, often terminal, introductory applied statistics course" (Garfield, 2000, p. 2). The Guidelines for Assessment and Instruction in Statistics Education (GAISE) are six recommendations that have evolved out of this need for reform. These recommendations have the intent to help students attain …

Reflections On Kony 2012, Rosa Brooks

Georgetown Law Faculty Publications and Other Works

In spring 1997, few people outside Uganda had heard of the Lord’s Resistance Army (LRA). The LRA arose in the late 1980s out of the ashes of Alice Lakwena’s Holy Spirit Movement, and over the next decade, LRA raids killed thousands of villagers in Northern Uganda. Hundreds of thousands were displaced, and an estimated 10,000 children were forcibly abducted by the LRA and brutally coerced into becoming killers, sex slaves or both. But in the spring of 1997, the LRA had yet to make CNN.

Measurement Of Alcohol Craving, David J. Kavanagh, Dixie J. Statham, Gerald F.X. Feeney, Ross Mc D. Young, Jon May, Jackie Andrade, Jason P. Connor

School of Psychology

Despite considerable research activity and application in treatment, the construct of craving remains poorly understood. We propose that cravings and urges are cognitive-emotional events in time, characterised by frequency, duration, intensity and salience. Commonly used measures of alcohol craving are reviewed, and their strengths and weaknesses identified. Most measures confound craving with behaviors, or with separable cognitive phenomena such as expectancies, intentions, or perceived behavioral control. These confounds have limited our advances in understanding the determinants and consequences of craving. Based on the criteria applied in this review, among the better performing multi-item measures are the Penn Alcohol Craving Scale …

The Power Of Administrative Ethics: Moving Beyond Moralism And Instrumentalism, Ciarán O’Kelly, Melvin J. Dubnick Sep 2012

The Power Of Administrative Ethics: Moving Beyond Moralism And Instrumentalism, Ciarán O’Kelly, Melvin J. Dubnick

Faculty Publications

This paper makes the case for an approach to administrative ethics that regards it as a form of political power within contexts of organization and organizational change (reform). After articulating the logic of this perspective, it is applied to two cases of reform (No Child Left Behind in the US and National Health Service reform in the UK) where reformers have used the power of metrics and high-stakes accountability to force change — and in the process have altered the respective ethical landscapes.
