Leveraging The Dialectical Theory In Case Study Analysis: Genzyme's Ethical Dilemma, Andrei Duta Sep 2012

Leveraging The Dialectical Theory In Case Study Analysis: Genzyme's Ethical Dilemma, Andrei Duta

The Journal of Business, Entrepreneurship & the Law

This paper provides the theoretical framework for a case study that I share with students in my courses. The dialectical theory is used to analyze ethical conundrums pertaining to Genzyme, a successful bio-tech corporation based in Boston, Massachusetts that manufactures treatments for serious diseases such as kidney problems, immune diseases, and cancer. We discuss questions such as: is Genzyme acting unethically when averaging extremely high profit margins on drugs for rare diseases? Is the company taking advantage of the lack of pharmaceutical choices that patients have when addressing their ailments? The dialectical theory provides the framework and vocabulary for discussing, …

The Inherent Instability Of The Financial System, Kim De Glossop Sep 2012

The Inherent Instability Of The Financial System, Kim De Glossop

The Journal of Business, Entrepreneurship & the Law

The article explores one of the causes of the financial crisis of 2008 and of financial crises generally. The argument of the paper is that rather than tend toward equilibrium, financial and asset markets have a tendency to become unstable after prolonged periods of stability. The main driver of this process is the expansion of credit. Debt feeds its way into higher asset prices which in turn justify the accumulation of more debt to purchase further assets, and so on. The basis for the idea is Hyman Minsky's Financial Instability Hypothesis, itself a reinterpretation of The General Theory of Employment, …

Managing The Impact Of New Media On The Employment Relationship, Susan A. O'Sullivan-Gavin, John H. Shannon

The Journal of Business, Entrepreneurship & the Law

Attention to privacy issues in the workplace has increased over the past two decades as use of electronic mail and text messages has made these means of communication commonplace. Beyond text messages and emails, employees can access the internet at their place of employment at many different entry points. This access can be through company issued desktops or laptops, mobile phones, mobile internet devices (MIDs), Smartphone technology (photography; video and voice recording capabilities; file transfer and storage), off-site internet connections, Wi-Fi access or hot spots. Employees can access and/or post information on various sites including blogs, wikis, RSS feeds, instant …

Reforming Executive Compensation: What Do We Know And Where Do We Go?, Priyanka Rajagopalan Sep 2012

Reforming Executive Compensation: What Do We Know And Where Do We Go?, Priyanka Rajagopalan

The Journal of Business, Entrepreneurship & the Law

In this Article, I study a fascinating problem - what are the legal, political and economic implications of regulating executive bonuses? While the Administration's recent consideration of proposals to tax bonuses of AIG executives has sparked a great deal of media speculation and attention, there has been little legal scholarship discussing the various possible consequences of this and other methods of regulating executive compensation. Especially given the growing interest in executive compensation and the possible benefits and costs of regulation in this arena, I believe this paper will make a significant scholarly contribution to the existing literature on corporate governance …

"You Had Me At Hello" Or "Let Them Go?": Law Firm Selection, Retention, And Defection In The Investment Banking Industry, Karl D. Shehu Sep 2012

"You Had Me At Hello" Or "Let Them Go?": Law Firm Selection, Retention, And Defection In The Investment Banking Industry, Karl D. Shehu

The Journal of Business, Entrepreneurship & the Law

Drawing upon the theoretical concepts of reputation and social networking, this article's main objective is to assess how investment banks choose external law firms. Using qualitative methods, I show that investment banks, to varying degrees, rely on internal counsel, procurement specialists, and boards of directors to decide which firm to select. When choosing a specific law firm for the first time, corporate decision-makers are likely to evaluate law firms based on intangible factors like reputation and the word-of-mouth referrals of their colleagues. In subsequent selections of a law firm, these factors are transplanted by past results. Firm expertise and cost …

Preserving Human Capital: Using The Noncompete Agreement To Achieve Competitive Advantage, Griffin Toronjo Pivateau Sep 2012

Preserving Human Capital: Using The Noncompete Agreement To Achieve Competitive Advantage, Griffin Toronjo Pivateau

The Journal of Business, Entrepreneurship & the Law

Organizations today face numerous challenges: worldwide competitors, changes in information technology, increased reliance on knowledge workers, and a shifting economic environment. Faced with the difficulty of securing advantage by traditional means, management has increasingly focused on employees as a key asset and driver of productivity. Many organizations have adopted the human capital theory, which holds that employees form an asset of the organization. Organizations will seek to maximize their human capital as a differentiator. Presumably, an organization that invests in its human capital will find itself rewarded with increased productivity and higher returns. But here is where the problem develops. …

Human Geography And Behavior Analysis: An Application Of Behavior Analysis To The Explanation Of The Evolution Of Human Landscapes, William Norton Sep 2012

Human Geography And Behavior Analysis: An Application Of Behavior Analysis To The Explanation Of The Evolution Of Human Landscapes, William Norton

The Psychological Record

Human geography is a social science concerned primarily with data-based analyses and the utilization of various theoretical constructs mostly developed in other social science disciplines. A discussion of the character of human geography supports the suggestion that human geographic analyses of landscapes will benefit from employment of additional theories, specifically from a judicious interpretation and application of work in behavior analysis. Human landscape-making behavior can be explained using the concepts and principles of behavior analysis as developed in psychology and as applied in sociology and anthropology. For human geographers, this suggestion is at variance with most other recent conceptual contributions …

Is A Final Theory Conceivable?, Donald W. Zimmerman Sep 2012

Is A Final Theory Conceivable?, Donald W. Zimmerman

The Psychological Record

Some physicists believe that a final theory, which will unify separate branches of theoretical physics, including quantum field theory and general relativity, is imminent. The physicists who expect such a theory typically assume that ultimate natural laws will be expressed by the same mathematical formalism which is associated with present-day physics. This view is questionable, because mathematics itself evolves and is not currently in a finished form. Historically, a succession of discoveries in physics has unveiled new laws of nature, each stage being made possible by the development of new mathematics. Evolutionary biology and interbehavioral psychology, ordinarily overlooked by the …

Perception Of Movement And Dancer Characteristics From Point-Light Displays Of Dance, Sheila Brownlow, Amy R. Dixon, Carrie A. Egbert, Rebecca D. Radcliffe Sep 2012

Perception Of Movement And Dancer Characteristics From Point-Light Displays Of Dance, Sheila Brownlow, Amy R. Dixon, Carrie A. Egbert, Rebecca D. Radcliffe

The Psychological Record

Dance is one type of movement that expresses emotion, however perceptions of dance movements and the corresponding trait inferences of the dancer have received no attention in the literature. This study examined how people determine dancer trait and emotion characteristics from point-light displays of dance, and whether dance experience affects differential attunements to dance movements. Dancers performed one “sad” and one “happy” dance while being filmed in point light, which is a technique used to isolate movement cues from other person information (such as race, sex, height). Experienced dancers and dance novices served as participants and judged the dances on …

Relative Predictive Power Of The Optimism Versus The Pessimism Index Of A Chinese Version Of The Life Orientation Test, Julian C. L. Lai Sep 2012

Relative Predictive Power Of The Optimism Versus The Pessimism Index Of A Chinese Version Of The Life Orientation Test, Julian C. L. Lai

The Psychological Record

To examine the dimensionality of the Life Orientation Test (LOT) (a measure of optimism) in Hong Kong Chinese, a Chinese version of the LOT, a physical symptoms checklist, and the Chinese Affect Scale were administered in two separate samples of 230 undergraduates and 173 working adults. Exploratory factor analysis showed that the LOT was split between the optimism and the pessimism indices in both samples, but these two factors were not correlated differentially with either symptom reports or affective measures. On balance, the two indices do differ in one important aspect. The predictive power of the complete LOT was conferred …

The Long-Term Habituation Of Sexual Arousal In Human Males: A Crossover Design, Joseph J. Plaud, George A. Gaither, Susan Amato Henderson, Mary K. Devitt Sep 2012

The Long-Term Habituation Of Sexual Arousal In Human Males: A Crossover Design, Joseph J. Plaud, George A. Gaither, Susan Amato Henderson, Mary K. Devitt

The Psychological Record

Short-term and long-term habituation of sexual arousal was investigated in a crossover design. Nine subjects completed six sessions semiweekly for 3 consecutive weeks. Sessions were scheduled at least 2 days but not more than 4 days apart. Each session consisted of 15 stimulus periods and 15 detumescence periods. Sexually explicit audio stimuli were administered. There were two conditions in the crossover design, which allowed each participant to serve as his own control. During one half of the sessions subjects were exposed to 15 different scripts (varied condition); during the remaining sessions subjects were exposed to the same script 45 times …

The Perception And Attribution Of Facial Asymmetry In Normal Adults, Rotem Kowner Sep 2012

The Perception And Attribution Of Facial Asymmetry In Normal Adults, Rotem Kowner

The Psychological Record

This study examined the effect of a target person’s facial asymmetry on observers’ attributions of emotion and personality, as well as appearance judgment. The first experiment investigated attributions to resting asymmetrical faces of 20 normal healthy young adults versus their symmetrical hemifacial composites. The second experiment used the same procedure with 24 expressive faces. The findings of no significant differences between the attributions to asymmetrical faces and their symmetrical hemifacial composites in both studies are explained by the very limited degree of asymmetry seen on young adults’ faces. Moreover, it is suggested that observers are not tuned to notice mild …

The Relationship Between Provocation Frequency And Human Aggresive Responding, Don R. Cherek, Donald M. Dougherty Sep 2012

The Relationship Between Provocation Frequency And Human Aggresive Responding, Don R. Cherek, Donald M. Dougherty

The Psychological Record

Six adults participated in an experiment designed to study the effects of provocation frequency, that is, point subtractions, on free-operant aggressive responding. Subjects were given two response options on separate buttons labeled “A” and “B.” Pressing Button A was maintained by a fixed-ratio 100 schedule of point presentation. A counter was incremented when a point was earned, and these points were later exchanged for money (one point = 10 cents). Subjects were instructed that the completion of each fixed-ratio 10 on Button B subtracted a point from a second subject (fictitious) also responding to accumulate money. Button B responses were …

Publications of the Provost's Office

"Abelard to Apple: The Fate of American Colleges and Universities" is a recent book by Richard A. DeMillo, an ex-CTO of HP and an ex-dean of the Georgia Tech College of Computing. The book paints a bleak picture for the future of most colleges and universities unless they are able to take advantage of some of the forces shaping higher education. Chapter 20 contains 10 specific recommendations on what to do (but not HOW to do it).

Are Dutch Patients Willing To Be Seen By A Physician Assistant Instead Of A Medical Doctor?, Luppo Kuilman, Roos M.B. Nieweg, Cees P. Van Der Schans, Jaap H. Strijbos, Roderick S. Hooker Sep 2012

Are Dutch Patients Willing To Be Seen By A Physician Assistant Instead Of A Medical Doctor?, Luppo Kuilman, Roos M.B. Nieweg, Cees P. Van Der Schans, Jaap H. Strijbos, Roderick S. Hooker

Prevention and Community Health Faculty Publications

Background

The employment of physician assistants (PAs) is a strategy to improve access to care. Since the new millennium, a handful of countries have turned to PAs as a means to bridge the growing gap between the supply and demand of medical services. However, little is known about this new workforce entity from the patient’s perspective. The objective of this study was to assess the willingness of Dutch patients to be treated by a PA or a medical doctor (MD) under various time constraints and semi-urgent medical scenarios.

Methods

A total of 450 Dutch adults were recruited to act as …
