Proportionality In Interpreting Constitutions: A Comparison Between Canada, The United Kingdom And Singapore And Its Implications For Vietnam, Jack Tsen-Ta Lee
Proportionality In Interpreting Constitutions: A Comparison Between Canada, The United Kingdom And Singapore And Its Implications For Vietnam, Jack Tsen-Ta Lee
Research Collection Yong Pung How School Of Law
Few rights that are guaranteed by constitutions and bills of rights are expressed to be absolute. In many jurisdictions, the legislature is permitted to impose restrictions on rights for specified reasons and under particular conditions. However, constitutional or bill of rights text often do not expressly indicate how the courts should determine that applicants’ rights have been legitimately restricted. To this end, courts in jurisdictions such as Canada and the United Kingdom have adopted the European doctrine of proportionality. Essentially, this requires them to balance opposing types of public interests – the interest sought to be protected by the rights …
Transit Deserts: The Gap Between Demand And Supply, Junfeng Jiao, Maxwell Dillivan
Transit Deserts: The Gap Between Demand And Supply, Junfeng Jiao, Maxwell Dillivan
Research Collection College of Integrative Studies
The term “transit desert” is a new concept that looks at the gap between level of transit service (supply) and needs of a particular population (demand). These populations are often referred to as “transit dependent,” people that are too young, too old, or too poor or who are physically unable to drive. “Transit deserts” in this case are defined as areas that lack adequate public transit service given areas containing populations that are deemed transit-dependent. This study aims to analyze and establish a clear method for calculating and quantifying gaps between transit demand and supply using Geographic Information Systems (GIS). …

Malware continues to thrive on the Internet. Besides automated mechanisms for detecting malware, we provide users with trust evidence information to enable them to make informed trust decisions. To scope the problem, we study the challenge of assisting users with judging the trustworthiness of software downloaded from the Internet. Through expert elicitation, we deduce indicators for trust evidence, then analyze these indicators with respect to scalability and robustness. We design OTO, a system for communicating these trust evidence indicators to users, and we demonstrate through a user study the effectiveness of OTO, even with respect to IE’s SmartScreen Filter (SSF). …

Design And Comparison Of Immersive Interactive Learning And Instructional Techniques For 3d Virtual Laboratories, Shuo Ren
Computational Modeling & Simulation Engineering Theses & Dissertations
Virtual reality (VR) as a learning environment plays an important role m engineering education. Utilizing the VR learning environment as a supplement to engineering-based laboratories is especially beneficial for students to prepare for the physical experiment and to grasp the experiment objectives and procedures. Such a methodology can also play a significant role in distance education.
This work presents the methodology design for the physical-to-virtual transformation of two undergraduate mechanical engineering laboratory experiments, namely the "Jet Impact Force on Vanes (Jet Force Lab)" and the "Elastic Test of a Beam in Pure Bending (Beam Bending Lab)" at Old Dominion University. …

Foreword: Academic Influence On The Court, Neal K. Katyal
Georgetown Law Faculty Publications and Other Works
The months leading up to the Supreme Court’s blockbuster decision on the Affordable Care Act (ACA) were characterized by a prodigious amount of media coverage that purported to analyze how the legal challenge to Obamacare went mainstream. The nation’s major newspapers each had a prominent story describing how conservative academics, led by Professor Randy Barnett, had a long-term strategy to make the case appear credible. In the first weeks after the ACA’s passage, the storyline went, the lawsuit’s prospects of success were thought to be virtually nil. Professor (and former Solicitor General) Charles Fried stated that he would “eat a …
Defending Those People, Abbe Smith
Defending Those People, Abbe Smith
Georgetown Law Faculty Publications and Other Works
Many practitioners and scholars have written perceptively about the motivations of criminal defenders. Some have written eloquently. I have my own body of work on this and related questions.
This essay is about why the author has devoted her professional career--her life--to defending people most of society would just as soon banish and forget. After nearly thirty years of criminal law practice, her reasons are such a part of her that they are nearly inarticulable. The author is a criminal defender in her soul. She also has been teaching and writing about criminal defense for almost as long as she …

University of Nebraska-Lincoln Libraries: Faculty Publications
In late March it was my privilege and pleasure to attend the American Physical Society Professional Skills Development Workshops for Women Physicists. The workshop was sponsored by the National Science Foundation, and scholarships were available to offset the cost of attendance. Throughout the workshop we were challenged to improve our skills in negotiation, communication, and leadership, but more importantly, we forged relationships that will benefit each other for years to come. Attendees of the workshop came from a variety of professional backgrounds ranging from grant-funded freelancers to post-doctoral researchers or associates at major laboratories, and educators from community colleges and …

Osteogenesis imperfecta is a genetic disorder of bone fragility; however, the effects of this disorder on bone material properties are not well understood. No study has yet measured bone material strength in humans with osteogenesis imperfecta. Small bone specimens are often extracted during routine fracture surgeries in children with osteogenesis imperfecta. These specimens could provide valuable insight into the effects of osteogenesis imperfecta on bone material strength; however, their small size poses a challenge to their mechanical characterization. In this study, a validated miniature three-point bending test is described that enables measurement of the flexural material properties of pediatric cortical …

Enhancing The Engineering Curriculum: Defining Discovery Learning At Marquette University, Jay R. Goldberg, Mark L. Nagurka
Biomedical Engineering Faculty Research and Publications
This paper summarizes the results of our investigation into the feasibility of increasing the level of discovery learning in the College of Engineering (COE) at Marquette University. We review the education literature, document examples of discovery learning currently practiced in the COE and other schools, and propose a Marquette COE-specific definition of discovery learn-ing. Based on our assessment of the benefits, costs, and tradeoffs associated with increasing the level of discovery learning, we pre-sent several recommendations and identify resources required for implementation. These recommendations may be helpful in enhancing engineering education at other schools.

Gambling With The Bronx Bombers: Betting On, Against, And With The Yankees, Ronald J. Rychlak
UNLV Gaming Law Journal
The New York Yankees, arguably the most hallowed name in all of professional sports, has probably had more money wagered on the outcome of its games than any other team in any sport. Although few people today may be aware of it, the team itself has a long history of association with gamblers and gambling. The first owners of the Yankees were notorious gamblers; the team’s first captain was indicted in the 1919 “Black Sox” scandal; one Yankees’ pitcher was suspected of having thrown another Series game; one owner had ties to underworld figures in Las Vegas; another owner was …
A New Feminism? Gender Dynamics In Morocco’S February 20th Movement, Zakia Salime
A New Feminism? Gender Dynamics In Morocco’S February 20th Movement, Zakia Salime
Journal of International Women's Studies
The February 20th movement shows new modes of engagement with feminism, despite a striking absence of feminist organizations from the protest movement. Nevertheless, and in sharp contrast with most accounts that posit the irrelevance of feminism for Moroccan youth’s identifications and political subjectivities, I argue that feminism has not only penetrated the social imaginary of a new generation of activists, but has also informed their practices. What kind of tension does this appropriation of feminism by the youth of February 20th bring about with traditional feminist circles? Does this high visibility of women in February 20th indicate the rise of …
Introduction Of Planar Compliant Joints Designed For Combined Bending And Axial Loading Conditions In Lamina Emergent Mechanisms, Samuel E. Wilding, Larry L. Howell, Spencer P. Magleby
Introduction Of Planar Compliant Joints Designed For Combined Bending And Axial Loading Conditions In Lamina Emergent Mechanisms, Samuel E. Wilding, Larry L. Howell, Spencer P. Magleby
Faculty Publications
This work introduces three joints to allow motion in lamina emergent mechanisms (LEMs) that were designed to have minimal parasitic motion under tension, compression, and a combination of tension and compression loading. Closed-form models of the joints were developed and combined with optimization algorithms for maximum flexibility in bending and then modeled using finite element analysis (FEA). The FEA results were used to predict the stiffness of the joints in bending, tension, and compression. As a baseline, lamina emergent torsional (LET) joints were designed to match the bending stiffness of each of the joints, so that the tensile-compressive performance could …

The endogenous opioid system is involved in modulating a number of behavioral and physiological systems, including the hypothalamic-pituitary-adrenal (HPA) axis. In humans, a functional variant in the OPRM1 gene (OPRM1 A118G) is associated with a number of outcomes, including attenuated HPA axis responses to stress. A nonsynonymous variant (OPRM1 C77G) in the rhesus macaque has been shown to have similar effects in vivo to the human variant. The current study investigated whether OPRM1 C77G influences HPA axis response to stress in rhesus macaques. We analyzed plasma adrenocorticotropic hormone (ACTH) and cortisol levels measured in response to three different stressors: 1) …

Texting While Driving Meets The Fourth Amendment: Deterring Both Texting And Warrantless Cell Phone Searches, Adam M. Gershowitz
Texting While Driving Meets The Fourth Amendment: Deterring Both Texting And Warrantless Cell Phone Searches, Adam M. Gershowitz
Faculty Publications
Recent laws criminalizing texting while driving are under-inclusive, ambiguous, and impose light punishments that are unlikely to deter. At the same time, the laws empower police to conduct warrantless searches of drivers’ cell phones. Texting while driving is dangerous and should be punished with stiff fines, possible jail time, license suspensions, and interlock devices that prevent use of phones while driving. However, more severe punishment will not eliminate police authority to conduct warrantless cell phone searches. This Article therefore proposes that legislatures allow drivers to immediately confess to texting while driving in exchange for avoiding a search of their phones. …

Multiculturalist Liberalism And Harms To Women: Lookin Through The Issue Of "The Veil", Anissa Helie, Marie Ashe
Multiculturalist Liberalism And Harms To Women: Lookin Through The Issue Of "The Veil", Anissa Helie, Marie Ashe
Publications and Research
Hélie & Ashe law review writing raises and responds to a reformulated and broadened version of Susan Okin’s 1999 inquiry, Is Multiculturalism Bad for Women? It identifies social and political developments, as well as legal and theoretical developments, that have occurred in the 21st century and that demand that reformulation.
Not limiting itself (as did Okin’s question) to interrogating the relationship between women’s equality interests and interests in “religious freedom” advanced by minority-religious groups, Hélie & Ashe is the broader inquiry, critical for liberal theory of the 21st century which has been greatly affected by the “ethos …

Body-And-Cad Geometric Constraint Systems, Kirk Haller, Audrey Lee-St.John, Meera Sitharam, Ileana Streinu, Neil White
Computer Science: Faculty Publications
Motivated by constraint-based CAD software, we develop the foundation for the rigidity theory of a very general model: the body-and-cad structure, composed of rigid bodies in 3D constrained by pairwise coincidence, angular and distance constraints. We identify 21 relevant geometric constraints and develop the corresponding infinitesimal rigidity theory for these structures. The classical body-and-bar rigidity model can be viewed as a body-and-cad structure that uses only one constraint from this new class. As a consequence, we identify a new, necessary, but not sufficient, counting condition for minimal rigidity of body-and-cad structures: nested sparsity. This is a slight generalization of the …
