Indian Tribes And Human Rights Accountability, Wenona T. Singel Aug 2012

Indian Tribes And Human Rights Accountability, Wenona T. Singel

San Diego Law Review

In Indian country, the expansion of self-governance, the growth of the gaming industry, and the increasing interdependence of Indian and non-Indian communities have intensified concern about the possible abuse of power by tribal governments. As tribes gain greater political and economic clout on the world stage, expectations have risen regarding the need for greater government accountability in Indian country. Despite these expectations, Indian tribes are largely immune from external accountability with respect to human rights. In fact, tribes have effectively slipped into a gap in the global system of human rights responsibility. The gap exists in the sense that tribal …

Find The Cost Of Freedom: The State Of Wrongful Conviction Compensation Statutes Across The Country And The Strange Legal Odyssey Of Timothy Atkins, Justice Brooks, Alexander Simpson Aug 2012

Find The Cost Of Freedom: The State Of Wrongful Conviction Compensation Statutes Across The Country And The Strange Legal Odyssey Of Timothy Atkins, Justice Brooks, Alexander Simpson

San Diego Law Review

Although compensation statutes like California’s have admirable goals, Tim Atkins’s case fell through some substantial cracks that prompted the Authors to write this Article. As two of the many lawyers who have worked on Tim’s case over the years, it has been an incredibly frustrating journey to see him denied compensation after all that has been done to prove his innocence. California’s statute is flawed and is being misinterpreted, just as other compensation statutes are flawed and misinterpreted around the country. This Article looks at those statutes and contextualizes the problems using Tim’s legal odyssey as a framework. Specifically, this …

The Constitutional Jurisprudence Of Justice Kennedy On Speech, Charles D. Kelso, R. Randal Kelso Aug 2012

The Constitutional Jurisprudence Of Justice Kennedy On Speech, Charles D. Kelso, R. Randal Kelso

San Diego Law Review

Justice Kennedy's basic principles in free speech cases are supporting political freedom, supporting individual autonomy, and protecting freedom to teach, learn, and innovate. Given these principles, his opinions in free speech cases protect free speech from government regulation unless the government can provide strong reasons for any restrictive action and show that the means it has chosen to carry out its purposes are closely tailored to its goals. At a minimum, judicial review is by strict scrutiny for content-based regulations and intermediate review for content-neutral time, place, and manner regulations. In some cases, Justice Kennedy has indicated a preference for …

Comparing Single-Sex And Reformed Coeducation: A Constitutional Analysis, Nancy Chi Cantalupo Aug 2012

Comparing Single-Sex And Reformed Coeducation: A Constitutional Analysis, Nancy Chi Cantalupo

San Diego Law Review

One of the most enduring educational debates of the past three decades has dealt with the legality and advisability of sex-segregated education. This debate can often look confusing, given a large number of debaters and the diversity of their perspectives and agendas. More than this diversity, however, the debate is confusing because the debate has been structured as a contest between the "innovation" of sex-segregated education and status quo coeducation. Missing from the debate is a comparison between reformed coeducation and a single-sex alternative, a comparison that is markedly more useful in determining what ought to be done about the …

Adolescent Identity Versus The First Amendment: Sexuality And Speech Rights In The Public Schools, Steven J. Macias Aug 2012

Adolescent Identity Versus The First Amendment: Sexuality And Speech Rights In The Public Schools, Steven J. Macias

San Diego Law Review

This Article examines the legal tensions that currently exist between public schools' attempts to protect gay students from bullying and harassment and antigay students' First Amendment rights to engage in allegedly harassing speech. First, it looks at the popular conception of the relationship between childhood or adolescence and sexuality by considering the political and legal fallout of the same-sex marriage debate. Then this Article turns to a conception of public schooling that would allow for the constitutionally permissible regulation of antigay-identity speech. Next, through the use of critical theory, this Article explains why First Amendment defenses to gay harassment have …

Antitrust As Regulation, Alan Devlin Aug 2012

Antitrust As Regulation, Alan Devlin

San Diego Law Review

Antitrust, properly understood, plays a modest role in constraining commercial behavior. With respect to unilateral conduct, it does not prohibit monopoly or the fortuitous or quality-based acquisition of the same. It generally permits dominant companies to enjoy the fruits of their positions and does not speak to the propriety of excessive pricing. It does not impose service obligations on monopolists, nor does it generally limit their right to price discriminate amongst their consumers. It merely prohibits monopolists' artificial creation of impediments to competition--so-called exclusionary practices. With respect to concerted behavior, the law allows a vast swathe of private agreements, even …

Pliva Shields Big Pharma From Billions, Cuts Consumers' Rights, Dana Taschner Aug 2012

Pliva Shields Big Pharma From Billions, Cuts Consumers' Rights, Dana Taschner

San Diego Law Review

This Article explores the emergence of the LRA test, as well as its dangers, and explains how an equivalent norm underlies recent monopolization cases. The Author concludes that the law should not require business practices to maximize social welfare to pass muster under the antitrust laws. As tools of public policy directed at unilateral market behavior, antitrust and regulation have long played distinct, though complementary, roles. Natural-monopoly regulation has as its immodest goal the maximization of consumer welfare by simultaneously imposing universal service obligations and spurring the efficiencies associated with competition through the imposition of various behavioral constraints. That such …

The Informational And Institutional Theories Of Off-Label Promotion, Miguel A. Lopez Aug 2012

The Informational And Institutional Theories Of Off-Label Promotion, Miguel A. Lopez

San Diego Law Review

This Article contends that there are two distinct theories of the offense of off-label promotion—the informational theory and the institutional theory. One is concerned with controlling the flow of medical knowledge and the other is concerned with protecting regulatory legitimacy. Different kinds of evidence are key under each theory. I argue that although the Federal Food, Drug, and Cosmetic Act (FD&C Act) and its accompanying regulations emphasize the informational theory, federal prosecutors rely more heavily on the legal arguments that underpin the institutional theory of enforcement. A corollary to this contention is that the informational theory of off-label promotion does …

The Characterization Of Riordan Arrays And Sheffer-Type Polynomial Sequences, Tian-Xiao He Aug 2012

The Characterization Of Riordan Arrays And Sheffer-Type Polynomial Sequences, Tian-Xiao He

Scholarship

Here we present a characterization of Sheffer-type polynomial sequences based on the isomorphism between the Riordan group and Sheffer group and the sequence characterization of Riordan arrays. We also give several alternative forms of the characterization of the Riordan group, Sheffer group and their subgroups. Formulas for the computation of the generating functions of Riordan arrays and Sheffer-type polynomial sequences from the characteristics are shown. Furthermore, the applications of the characteristics to lattice walks and recursive construction of Sheffer-type polynomial sequences are also given.

Inhibition Of Burkholderia Multivorans Adhesion To Lung Epithelial Cells By Bivalent Lactosides, Ciara Wight, Rosaria Leyden, Paul V. Murphy, Máire Callaghan, Trinidad Velasco-Torrijos, Siobhan Mcclean Aug 2012

Inhibition Of Burkholderia Multivorans Adhesion To Lung Epithelial Cells By Bivalent Lactosides, Ciara Wight, Rosaria Leyden, Paul V. Murphy, Máire Callaghan, Trinidad Velasco-Torrijos, Siobhan Mcclean

Articles

Burkholderia cepacia complex (Bcc) is an opportunistic pathogen in cystic fibrosis patients which is inherently resistant to antimicrobial agents. The mechanisms of attachment and pathogenesis of Bcc, a group of 17 species, are poorly understood. The most commonly identified Bcc species in newly colonised patients, Burkholderia multivorans, continues to be acquired from the environment. Development of therapies which can prevent or reduce the risk of colonization on exposure to Bcc in the environment would be a better alternative to antimicrobial agents. Previously, it has been shown that Bcc strains bound to many glycolipid receptors on lung epithelia. Using a …

Ais-Based Coordinated And Adaptive Control Of Generator Excitation Systems For An Electric Ship, Chuan Yan, Ganesh Kumar Venayagamoorthy, Keith Corzine

Electrical and Computer Engineering Faculty Research & Creative Works

An artificial immune system (AIS)-Based control of generator excitation systems for the U.S. Navy's electric ship is presented in this paper to solve power quality problems caused by high-energy loads such as direct energy weapons. the coordinated development of the AIS controllers mainly consists of two parts innate immunity (optimal) and adaptive immunity. the parameters of the controllers for the former, to provide optimal performance, are determined simultaneously using particle swarm optimization. for dramatic changes in the ship's power system, adaptive control based on the immune system feedback law is developed. the feedback law adapts the controllers' parameters only during …

Automatic Compositional Verification Of Timed Systems, Shang-Wei Lin, Yang Liu, Jun Sun, Jin Song Dong, Étienne André Aug 2012

Automatic Compositional Verification Of Timed Systems, Shang-Wei Lin, Yang Liu, Jun Sun, Jin Song Dong, Étienne André

Research Collection School Of Computing and Information Systems

Specification and verification of real-time systems are important research topics with crucial applications; however, the so-called state space explosion problem often prevents model checking to be used in practice for large systems. In this work, we present a self-contained toolkit to analyze real-time systems specified using event-recording automata (ERAs), which supports system modeling, animated simulation, and fully automatic compositional verification based on learning techniques. Experimental results show that our tool outperforms the state-of-the-art timed model checker.

Quantum Electrodynamic Corrections To The G Factor Of Helium P States, Mariusz Puchalski, Ulrich D. Jentschura Aug 2012

Quantum Electrodynamic Corrections To The G Factor Of Helium P States, Mariusz Puchalski, Ulrich D. Jentschura

Physics Faculty Research & Creative Works

The Landég factor describes the response of an atomic energy level to an external perturbation by a uniform and constant magnetic field. In the case of many-electron systems, the leading term is given by the interaction μ B(L- +2S- )•B- , where L- and S- are the orbital and spin angular momentum operators, respectively, summed over all electrons. For helium, a long-standing experimental-theoretical discrepancy for P states motivates a re-evaluation of the higher order terms which follow from relativistic quantum theory and quantum electrodynamics (QED). The tensor structure of relativistic corrections involves scalar, vector, and symmetric and antisymmetric tensor …

Adsorption Kinetics Of Pb(Ii) And Zn(Ii) Ions Unto Carbonized Groundnut Shells And Maize Cobs, Leke Luter, Aboi Julius, Henry T. Dekaa, B. A. Ikyenge, Ande Sesugh, Monday Uchenna Okoronkwo

Chemical and Biochemical Engineering Faculty Research & Creative Works

Maize cobs and groundnut shell adsorbents from agricultural by-products were carbonized and investigated for adsorption of two selected metals, Lead (Pb II) and Zinc (Zn II) from aqueous solutions of these metals. Kinetic studies of the adsorption processes were investigated employing Elovich and the intraparticle diffussion models. The results showed that, the adsorption capacities of these comparatively cheaper adsorbents and their efficiency for the removal of Pb(II) and Zn(II) ions from aqueous solution present them suitable for use in place of the costly commercial activated carbons.

Valuation Of Benchmark Provisions On It Services Contracts, Robert J. Kauffman, Ryan Sougstad Aug 2012

Valuation Of Benchmark Provisions On It Services Contracts, Robert J. Kauffman, Ryan Sougstad

Research Collection School Of Computing and Information Systems

Information technology (IT) services are often subject to downward price pressures due to improvements in technology and business processes in a competitive market. When clients enter into IT services contracts, they are faced with the future risk that their services will be overpriced relative to the broader IT services market. To mitigate this risk, clients often add benchmark provisions, whereby a neutral third party assesses the prevailing market price for services. It will support fair price adjustments if the market prices are lower than the current prices. We model the decision to benchmark in order to provide managerial information on …

Adapting Video Delivery Based On Motion Triggered Visual Attention, Hari Kalva, V. Adzic, Lai-Tee Cheok

Research Collection School Of Computing and Information Systems

Cues from human visual system (HVS) can be used for further optimization of compression in modern hybrid video coding platforms. We present work that explores and exploits motion related attentional limitations. Algorithms for exploiting motion triggered attention were developed and compared with MPEG AVC/H.264 encoder with various settings for different bitrate levels. For the sequences with high motion activity our algorithm provides up to 8% bitrate savings.

Collective Churn Prediction In Social Network, Richard J. Oentaryo, Ee-Peng Lim, David Lo, Feida Zhu, Philips K. Prasetyo Aug 2012

Collective Churn Prediction In Social Network, Richard J. Oentaryo, Ee-Peng Lim, David Lo, Feida Zhu, Philips K. Prasetyo

Research Collection School Of Computing and Information Systems

In service-based industries, churn poses a significant threat to the integrity of the user communities and profitability of the service providers. As such, research on churn prediction methods has been actively pursued, involving either intrinsic, user profile factors or extrinsic, social factors. However, existing approaches often address each type of factors separately, thus lacking a comprehensive view of churn behaviors. In this paper, we propose a new churn prediction approach based on collective classification (CC), which accounts for both the intrinsic and extrinsic factors by utilizing the local features of, and dependencies among, individuals during prediction steps. We evaluate our …

The Effect Of Poss Modified Montmorillonite On Elastomer Nanocomposites, Elana Celeste Lewis Aug 2012

The Effect Of Poss Modified Montmorillonite On Elastomer Nanocomposites, Elana Celeste Lewis

Master's Theses

The goal of this thesis was to define the structural factors that determine performance in clay/rubber nanocomposites when polyhedral oligomeric silsesquioxane (POSS) is used as a dispersant. POSS has been shown previously to enhance clay, metal oxides, and carbon nanotube dispersion in thermoplastics matrices, but their performance in rubber systems has not yet been explored. There is little fundamental understanding of how POSS interacts with clay and how these modified fillers react with rubber matrices. This thesis aims to develop a greater understanding of the mechanisms of POSS-clay modification through the examination of two different POSS-clay systems and their effect …

The Effects Of The Good Behavior Game With General Education High School Students, Rachel R. Mitchell Aug 2012

The Effects Of The Good Behavior Game With General Education High School Students, Rachel R. Mitchell

Master's Theses

The purpose of this study was to evaluate the effectiveness of the interdependent group contingency procedure known as the Good Behavior Game (GBG) on decreasing disruptive behaviors in general education high school students. The effectiveness of the GBG has been investigated in many studies as means of managing a variety of behaviors across many developmental levels; however, not all populations have been investigated. Although many studies exist that have utilized the GBG to alter behaviors across ages ranging from pre-school to adulthood, few studies exist in which the GBG has been used with a general education high school population. The …

Molecular Modeling And Experimental Studies On Ligand Recognition In The Lpa5 G Protein-Coupled Receptor, Jesica Rene Williams

Electronic Theses and Dissertations Archive

Lysophosphatidic acid (LPA) is a phospholipid growth factor mediating numerous biological effects such as platelet aggregation, mast cell activation, cell differentiation, cell migration, and cell survival by acting on specific LPA G protein-coupled receptors. Currently there are nine LPA receptors identified in the literature, LPA1-9. LPA1-3 are members of the endothelial differentiation gene (EDG) family and share approximately 50% sequence identity at the primary sequence level. LPA4-9 are structurally distinct from the EDG receptors with LPA5 sharing approximately 30% sequence identity with LPA4 at the primary sequence level. Due to the emerging role of LPA5 in human platelet activation, cancer, …

School of Medicine Publications

Machine learning has become a powerful tool for analysing medical domains, assessing the importance of clinical parameters, and extracting medical knowledge for outcomes research. In this paper, we present a machine learning method for extracting diagnostic and prognostic thresholds, based on a symbolic classification algorithm called REMED. We evaluated the performance of our method by determining new prognostic thresholds for well-known and potential cardiovascular risk factors that are used to support medical decisions in the prognosis of fatal cardiovascular diseases. Our approach predicted 36% of cardiovascular deaths with 80% specificity and 75% general accuracy. The new method provides an innovative …
