This Article examines ethical issues posed by imperfections in legal texts. More particularly, it addresses "legal loopholes," carefully defining the term and then exploring whether there is anything wrong with exploiting loopholes for private gain. Focusing on corporate settings, the analysis considers both the obligation of a business leader to support reasonably just social institutions and the professional obligation of corporate counsel advising on such issues. Although the notion of a legal loophole enjoys widespread colloquial use, the term is typically used quite loosely and without critical reflection. Today's companies face an incredible array of intellectual property issues, particularly when conducting business online. Forrester Research expects U.S. e-commerce retail sales to grow by over 10% per year and reach $278.9 billion in 2015. As e-commerce business increases and utilizes new technologies, e-commerce companies are likely to see a surge in IP issues and litigation. This Article discusses several of the more significant IP issues that an e-commerce company is likely to encounter and provides several strategies for dealing with such issues.

Part II of this Article begins by chronicling the origin of the economic loss rule; the present-day economic loss rule can be viewed as deriving from two fairly distinct areas. Part II then focus on the adoption of the economic loss rule in Texas and examines the contours of the doctrine under modern Texas law. Part III describes the cause of action for negligent misrepresentation as recognized in Texas, then surveys cases which purport to apply the economic loss rule to negligent misrepresentation claims. When resolving cases, appellate courts must quickly decide how much respect to give precedent decisions and the analytical approaches they embody. While the logical and philosophical justifications for reliance on precedent have been frequent topics in jurisprudential studies, this Article takes a unique perspective that will reinforce the role of precedent by emphasizing its necessary pride of place in any outcome that can be considered substantively just. Arguing against more decisionist models of adjudication and building upon prior pragmatic and Dworkinian justifications for the special role of precedent, this Article suggests first that appellate judges must approach their profession with …

Background: Animal studies suggest that some perfluoroalkyl acids (PFAAs), including perfluorooctanoate (PFOA), perfluorooctane sulfonate (PFOS), and perfluorononanoic acid (PFNA) may impair thyroid function. Epidemiological findings, mostly related to adults, are inconsistent.

Objectives: We investigated whether concentrations of PFAAs were associated with thyroid function among 10,725 children (1–17 years of age) living near a Teflon manufacturing facility in the Mid-Ohio Valley (USA).

Methods: Serum levels of thyroid-stimulating hormone (TSH), total thyroxine (TT4), and PFAAs were measured during 2005–2006, and information on diagnosed thyroid disease was collected by questionnaire. Modeled in utero PFOA concentrations were based on historical information on PFOA releases, …

Protectionism Indices For Non-Tariff Measures: An Application To Maximum Residue Levels, Yuan Li, John C. Beghin

We propose aggregation indices of Non-Tariff Measures (NTMs) to quantify their protectionism relative to international standards. We apply the indices to national Maximum Residue Limit (MRL) regulations affecting agricultural and food trade and using a science-based criteria embodied in Codex Alimentarius international standards. The approach links two streams of the NTM literature, one concerned with the aggregation of various NTMs into operational indices for econometric and modeling purposes, and the other attempting to evaluate the protectionism of NTMs. The data used in the application come from a large international dataset on veterinary and pesticide MRLs and CODEX MRL standards for …

We examine estimation of the parameters of Susceptible-Infective-Recovered (SIR) models in the context of least squares. We review the use of asymptotic statistical theory and sensitivity analysis to obtain measures of uncertainty for estimates of the model parameters and the basic reproductive number (R0 )—an epidemiologically significant parameter grouping. We find that estimates of different parameters, such as the transmission parameter and recovery rate, are correlated, with the magnitude and sign of this correlation depending on the value of R0. Situations are highlighted in which this correlation allows R0 to be estimated with greater ease than its constituent parameters. Implications …

In May 1797, Benjamin West—President of the Royal Academy, Historical Painter to the Court of King George III, and Surveyor of the King's Pictures—exhibited a small genre painting titled A Drayman Drinking at the annual exhibition of the Royal Academy in London. It was one of seven paintings West exhibited that year, and the only one overlooked by the reviewer for the Times. The critic's oversight may have stemmed from the unprecedented number of paintings on view (nearly twelve hundred, four hundred more than were hung the previous year) and the resulting overcrowding of the principle exhibition room. Prostate Cancer Biochemical Recurrence Rates After Robotic-Assisted Laparoscopic Radical Prostatectomy, Serge Ginzburg

Background and Objectives:

To determine prostate cancer biochemical recurrence rates with respect to surgical margin (SM) status for patients undergoing robotic-assisted laparoscopic radical prostatectomy (RALP).

Methods:

IRB-approved radical prostatectomy database was queried. Patients were stratified as low, intermediate, and high risk according to D’Amico's risk classification. Postoperative prostate-specific antigen (PSA) values were obtained every 3 mo for the first year, then biannually and annually thereafter. Biochemical recurrence was defined as ≥0.2ng/mL. Patients receiving adjuvant or salvage treatment were included. Positive surgical margin was defined as presence of cancer cells at inked resection margin in the final specimen.
