Reframing Federalism — The Affordable Care Act (And Broccoli) In The Supreme Court, Wendy K. Mariner, Leonard H. Glantz, George J. Annas

Faculty Scholarship

The U.S. Supreme Court decision to uphold most of the Affordable Care Act (ACA), including the insurance-coverage requirement, allows historic reforms in the health care system to move forward. Because the justices were split four to four on whether the ACA was constitutional, Chief Justice John Roberts was able to write the lead opinion that commanded five votes for whatever outcome he determined was constitutional. The chief justice's leadership in upholding almost all of the ACA was unanticipated, as was much of his legal reasoning. It was widely assumed that the interpretation of the Commerce Clause by the Court would …

Nature, Culture, And Social Engineering: Reflections On Evolution And Equality, Linda C. Mcclain Sep 2012

Nature, Culture, And Social Engineering: Reflections On Evolution And Equality, Linda C. Mcclain

Faculty Scholarship

This book chapter explores evolution and morality by considering the appeal to nature, and in particular to how evolution has shaped female and male brains differently, to explain evident sex differences and the persistence of sex inequality. It uses as illustrative the popularizing accounts of male and female brains found in Louann Brizendine, The Female Brain and The Male Brain, and the portrayal in such accounts of fundamental male and female differences in human mate selection and parenting. Drawing on the work of scientist and philosophers, the chapter critiques these accounts for engaging in an increasingly popular “neurosexism.” Such neurosexism …

Weakest-Link Attacker-Defender Games With Multiple Attack Technologies, Daniel G. Arce, Dan Kovenock, Brian Roberson

Economics Faculty Articles and Research

In this article, we examine a model of terrorism that focuses on the tradeoffs facing a terrorist organization that has two qualitatively different attack modes at its disposal. The terrorist organization's objective is to successfully attack at least one target. Success for the target government is defined as defending all targets from any and all attacks. In this context, we examine how terrorist entities strategically utilize an efficient but discrete attack technology e.g., suicide attacks when a more conventional mode of attack is available, and the optimal anti-terrorism measures.

Past Consideration Or Unconnected Consideration, Yihan Goh, Man Yip Sep 2012

Past Consideration Or Unconnected Consideration, Yihan Goh, Man Yip

Research Collection Yong Pung How School Of Law

It is trite law that a valid and enforceable contract must be supported by consideration. The recent Court of Appeal case of Rainforest Trading Ltd v State Bank of India Singapore [2012] 2 SLR 713 is a further addition to the local jurisprudence on consideration, specifically the issue of past consideration. This note considers the specific issue of past consideration and argues that its label should be discarded in favour of a more realistic one that correctly emphasises its underlying concerns.

Internships And The Making Of Future Lawyers, Seow Hon Tan

Research Collection Yong Pung How School Of Law

As law firm internships provide law students with their first substantial encounters with lawyers, in situations where they are especially eager to impress, a project was undertaken to examine the impact of private law firm internships on the professional identities of future lawyers. Fifty-two volunteers from the Singapore Management University, which mandates 10 weeks of internships with approved partners, were surveyed. Most had done corporate or civil litigation work at local firms in Singapore. The findings of this research project were presented at the fifth International Legal Ethics Conference, held in Canada in July.

Restructuring Science, Reengaging Society, Danielle L. Lake

Faculty Peer Reviewed Articles

Much of Paul Rabinow’s work is centered on the need for restructuring science, but does not argue for the means by which we should do so. The following paper suggests various ways in which the sciences can be restructured so as to reengage society. Bryan Norton’s bridge concepts are suggested as a means to work past the narrow thinking which accompanies hyper-specialization and a lack of integration. Secondly, the need to acknowledge and examine the role of values in knowledge construction is highlighted. Next, I suggest the restructuring of our social systems needs to be accompanied by a restructuring of …

OBJECTIVE: To determine if interindividual differences in plasma concentrations of 25-hydroxyvitamin D(3) (25(OH)D(3)) have pathophysiologic significance, we evaluated a cohort of female monkeys, seeking to identify associations with clinically relevant cardiovascular risk factors, including age, abdominal obesity (waist circumference), and high-density lipoprotein cholesterol (HDL-C).

METHODS: One hundred fifty-five female vervet monkeys (Chlorocebus aethiops sabaeus) aged 3-25 years consumed a typical western diet for 7-8 weeks that provided a woman's equivalent of approximately 1000 IU/day of vitamin D(3). Measurements of vitamin D(3) and HDL-C concentrations, as well as waist circumference, were obtained.

RESULTS: Among young monkeys (aged 3-5 years), compared to …

Common Respiratory Issues In Ambulatory Obstetrics., Kelly M Orzechowski, Richard C Miller Sep 2012

Common Respiratory Issues In Ambulatory Obstetrics., Kelly M Orzechowski, Richard C Miller

Department of Obstetrics and Gynecology Faculty Papers

This article reviews the diagnosis and management of the most common respiratory conditions complicating pregnancy--asthma and influenza. We also review strategies for smoking cessation in pregnancy as, in addition to exacerbating all other pulmonary conditions, smoking is the most modifiable risk factor for poor pregnancy outcome. Moreover, the obstetrician frequently encounters each of these conditions in the ambulatory setting. A thorough knowledge of the normal pregnancy-induced physiological respiratory changes combined with a comprehensive understanding of how to manage these conditions, will provide the obstetrician with the armamentarium needed to optimize health outcomes for mothers and their fetuses.

Differential Expression Patterns Of Proteins Involved In Epidermal Proliferation And Differentiation In Canine Atopic Dermatitis, Sirin Theerawatanasirikul, Achariya Sailasuta, Roongroje Thanawongnuwech, Tossaporn Nakbed, Komkrid Charngkaew, Gunnaporn Suriyaphol

The Thai Journal of Veterinary Medicine

The pathological alterations in skin keratinocyte proliferation and differentiation in canine atopic dermatitis(CAD) were investigated in 20 small breed dogs with CAD (10 of which displayed lesional CAD skin and 10 nonlesionalCAD skin) and 11 healthy control animals. Biopsy of lesional CAD skin showed orthokeratotichyperkeratosis. Immunohistochemistry (IHC) of Ki-67, a cellular marker for proliferation, showed a higher epidermalcell proliferation rate in the CAD dogs (p< 0.05) which positively correlated with Canine Atopic Dermatitis Extent andSeverity Index, CADESI-03 (p< 0.01). IHC labeling indicated reduced expression of cornified envelope proteins, involucrin (IVL) and filaggrin (FLG) in both lesional and non-lesional skin (p< 0.05). In contrast, expression oflympho-epithelial Kazal-type inhibitor (LEKTI), which has been reported to inhibit proteases that cleave proFLG intoFLG, was increased in lesional skin compared to the normal controls (p< 0.05). The IHC results showed a positivecorrelation between CADESI-03 and LEKTI expression and a negative correlation between CADESI-03 and IVLexpression. In conclusion, the present study demonstrates that epidermal hyperkeratosis in CAD is related todisturbance of both epidermal proliferation and cornified envelope differentiation. This is the first report of acorrelation of LEKTI with CAD.

Choroidal Neovascularization Regression On Fluorescein Angiography After Vegf Blockade., Diana V. Do, Lark Greenwald, Mohamed Ibrahim, Yasir J. Sepah, Quan Dong Nguyen

Journal Articles: Ophthalmology

BACKGROUND: Intravitreal vascular endothelial growth factor (VEGF) inhibitors stabilize vision in a majority of patients with neovascular age-related macular degeneration (AMD) and can improve vision in almost 40% of patients. However, some individuals who respond to anti-VEGF treatment still lose vision due to the formation of geographic atrophy (GA). While optical coherence tomography is often the primary imaging modality used, fluorescein angiography (FA) can provide useful information on GA development after choroidal neovascularization (CNV) regression.

METHODS: A retrospective chart review was conducted to evaluate the changes seen on FA over a 47-month period for 3 patients with neovascular AMD treated …

In Australia, amendments to the Legal Profession Act require that incorporated legal practices (ILPs) take steps to assure compliance with provisions of the Legal Profession Act 2004. Specifically, the legislation provides that the ILP must appoint a legal practitioner director to be generally responsible for the management of the ILP. The ILP must also implement and maintain “appropriate management systems" to enable the provision of legal services in accordance with the professional obligations of legal practitioners. Because the new law did not define “appropriate management systems” (AMS) the Office of Legal Services Commissioner for New South Wales worked with representatives …

Friends, Family, Or Fools: Entrepreneur Experience And Its Implications For Equity Distribution And Resource Mobilization, Reddi Kotha, Gerard George

Research Collection Lee Kong Chian School Of Business

Who helps entrepreneurs raise the resources they need and how much equity does an entrepreneur distribute in return? We use a sample of 611 entrepreneurs in the U.S. to examine why some entrepreneurs are more likely than others to distribute ownership selectively to helpers. We find that entrepreneurs with specific industry experience and start-up experience are able to provide ownership more selectively and raise more resources from their helpers. We refine the categorization of social ties further to make a distinction between professional and familial ties to show that the ownership distribution and types of resource contributions vary by the …

Gambling On Genes: Ambiguity Aversion Explains Investment In Sisters' Children, Brishti Guha Sep 2012

Gambling On Genes: Ambiguity Aversion Explains Investment In Sisters' Children, Brishti Guha

Research Collection School Of Economics

Many men invest in their sisters’ children instead of their wives’. Existing theories addressing such behavior depend on the level of paternity probability in such men’s societies being implausibly low. I link this anthropologically observed investment behavior with the experimentally observed phenomenon that some individuals are ambiguity averse. Arguing that men’s decisions are made under ambiguity, I show that an increase in ambiguity aversion results in investment in sisters’, rather than wives’, children. I show that this can happen even under risk neutrality. I also consider the special cases of a SEU maximizer and of extreme ambiguity aversion in the …

Responding To Personality Tests In A Selection Context: The Role Of The Ability To Identify Criteria And The Ideal-Employee Factor, Ute-Christine Kelhe, Martin Kleinmann, Thomas Hartstein, Klaus G. Melchers, Cornelius J. Konig, Peter A. Heslin, Filip Lievens

Research Collection Lee Kong Chian School Of Business

Personality assessments are often distorted during personnel selection, resulting in a common "ideal-employee factor" (IEF) underlying ratings of theoretically unrelated constructs. However, this seems not to affect the personality measures' criterion-related validity. The current study attempts to explain this set of findings by combining the literature on response distortion with the ones on cognitive schemata and on candidates' ability to identify criteria (ATIC). During a simulated selection process, 149 participants filled out Big Five personality measures and participated in several high- and low-fidelity work simulations to estimate their managerial performance. Structural equation modeling showed that the IEF presents an indicator …
