Written for a symposium addressing the need to construct a positive policy and research agenda for international intellectual property law, this article explores ways to improve the design and delivery of intellectual property training and educational programs. The article draws on the author's experience as the rapporteur for the International Roundtable on WIPO Development Agenda for Academics.

Not So Obvious After All: Patent Law's Nonobviousness Requirement, Ksr, And The Fear Of Hindsight Bias, Glynn S. Lunney Jr, Christian T. Johnson

Before the creation of the Federal Circuit in 1982, nonobviousness served as the primary gatekeeper for patents. When patent holders sued for infringement and lost, more than sixty percent of the time, they lost on the grounds that their patent was obvious. With the advent of the Federal Circuit, nonobviousness became a much less difficult hurdle to surmount. From 1982 until 2005, when patent holders sued for infringement and lost, obviousness was the reason in less than fifteen percent of the cases. Rethinking Transboundary Ground Water Resources Management: A Local Approach Along The Mexico-U.S. Border, Gabriel E. Eckstein

Despite more than forty years of promises to the contrary, neither Mexico nor the United States have shown any inclination to pursue a border-wide pact to coordinate management of the border region’s transboundary ground water resources. As a result, these critical resources – which serve as the sole or primary source of fresh water for most border communities on both sides – are being overexploited and polluted, leaving the local population with little recourse. Imminently unsustainable, the situation portends a grim future for the region.

Ground Flaxseed (Linum uitatissimum) is a lipid supplement that is commonly fed to dairy cows. It is believed that supplemental lipid can change the Fatty Acid (FA) composition in the milk, and decrease methane production. Twenty lactating organic Jersey cows, housed at the UNH Organic Dairy Research Farm (ODRF), were randomly assigned to five replicated 4 × 4 Latin squares to investigate the effects of increasing dietary levels of ground flaxseed (0, 5, 10, or 15% of the diet dry matter) on animal fperformance (e.g., dry matter intake, milk production, milk composition), ruminal metabolism, and enteric methane emissions. There has been a significant amount of research done on the effect that advertising in the fashion and beauty industry has on women. By creating advertisements with unrealistic images of beauty, it has resulted in anxiety, low self-esteem, and low self-confidence in many women. Most of these negative emotions stems from unhappiness among body and appearance. Less research has been performed relating to cosmetics and how this can have an influence on women, and how women can use cosmetics to manipulate their appearance. This descriptive study focuses on the approaches college students (ages 20 -24) use when solving systems of linear equations problems that have multiple choice answers. Participants were from a midsize public university in the northeast. Four approaches were considered – three forwards approaches: 1) substitution, 2) elimination, and 3) graphing, and one backwards approach: plugging in the x and y values from each multiple choice option. Participants solved systems of linear equations problems and answered questions based on their methods in a structured clinical interview. Each participant also filled out a questionnaire. This summer, the IRS issued long-awaited guidance on the deductibility of charitable contributions made to a single-member limited liability company (“SMLLC”) that is wholly-owned by a charitable organization exempt from federal income tax as a organization described in Section 501(c)(3). Previously, in a 2001 private letter ruling, the IRS confirmed that a SMLLC wholly-owned by a U.S. charity did not need to submit a separate application for recognition of federal income tax exemption, but declined to rule on whether contributions made to the SMLLC would be deductible under Section 170 as charitable contributions. After two initial studies on geotourism in Montana (Boley, 2009; Boyle, 2012) confirmed the presence of geotravelers in the third quarter of both the Crown of the Continent region and throughout the state of Montana, research interest turned to visitors during the remainder of the quarters, or seasons. This study looked statewide at all visitors and, more narrowly, vacationers, in the “shoulder” and winter season (quarters 1, 2, 4) to determine their geotourist tendencies.

The left restriction semigroups have arisen in a number of contexts, one being as the abstract characterization of semigroups of partial maps, another as the ‘weakly left E-ample’ semigroups of the ‘York school’, and, more recently as a variety of unary semigroups defined by a set of simple identities. We initiate a study of the lattice of varieties of such semigroups and, in parallel, of their two-sided versions, the restriction semigroups. Although at the very bottom of the respective lattices the behaviour is akin to that of varieties of inverse semigroups, more interesting features are soon found in the …

Random Fields At A Nonequilibrium Phase Transition, Hatem Barghathi, Thomas Vojta

We study nonequilibrium phase transitions in the presence of disorder that locally breaks the symmetry between two equivalent macroscopic states. In low-dimensional equilibrium systems, such random-field disorder is known to have dramatic effects: it prevents spontaneous symmetry breaking and completely destroys the phase transition. In contrast, we show that the phase transition of the one-dimensional generalized contact process persists in the presence of random-field disorder. The ultraslow dynamics in the symmetry-broken phase is described by a Sinai walk of the domain walls between two different absorbing states. We discuss the generality and limitations of our theory, and we illustrate our …

Drugs exert desired and undesired effects based on their binding interactions with protein target(s) and off-target(s), providing evidence for drug efficacy and toxicity. Pioglitazone and rosiglitazone possess a common functional core, glitazone, which is considered a privileged scaffold upon which to build a drug selective for a given target—in this case, PPARγ. Herein, we report a retrospective analysis of two variants of the glitazone scaffold, pioglitazone and rosiglitazone, in an effort to identify off-target binding events in the rat heart to explain recently reported cardiovascular risk associated with these drugs. Using the tris(3,5-diphenylpyrazol-1-yl)borate (Ph2Tp) supporting ligand, a series of mono- and dinuclear ferrous complexes containing hydroquinonate (HQate) ligands have been prepared and structurally characterized with X-ray crystallography. The monoiron(II) complexes serve as faithful mimics of the substrate-bound form of hydroquinone dioxygenases (HQDOs) – a family of nonheme Fe enzymes that catalyze the oxidative cleavage of 1,4-dihydroxybenzene units. Reflecting the variety of HQDO substrates, the synthetic complexes feature both mono- and bidentate HQate ligands. The bidentate HQates cleanly provide five-coordinate, high-spin Fe(II) complexes with the general formula [Fe(Ph2Tp)(HLX)] (1X), where HLX is …

Experimental Documentation Of The Structural Consequences Of Hydrogen-Bonding Interactions To The Proximal Cysteine Of A Cytochrome P450, Piotr J. Mak, Yuting Yang, Sangchoul Im, Lucy A. Waskell, James R. Kincaid

Resonance Raman spectroscopy is used to document, for the first time, a 6 cm−1 decrease of the Fe-S stretch by introducing an H-bond donor into the proximal pocket of a cytochrome P450, which interacts with the key cysteine thiolate axial ligand. The anticipated trans-effect on bound exogenous ligands is also confirmed and evidence is obtained supporting intimate interaction of the new histidyl-imidazole fragment with the heme periphery.
