Applying Social Movement Theory To Nonhuman Rights Mobilization And The Importance Of Faction Hierarchies, Corey Lee Wrenn Oct 2012

Applying Social Movement Theory To Nonhuman Rights Mobilization And The Importance Of Faction Hierarchies, Corey Lee Wrenn

Animal Rights Movement Collection

This paper offers an exploratory analysis of social movement theory as it relates to the nonhuman animal rights movement. Individual participant motivations and experiences, movement resource mobilization, and movement relationships with the public, the political environment, historical context, countermovements, and the media are discussed. In particular, the hierarchical relationships between factions are highlighted as an important area for further research in regards to social movement success. Specifically, the role of counterframing in subduing radical mobilization and the potential aggravating factor of status contamination is explored.

Tailored behavior change programs have proven effective at decreasing health risk factors, but the impact of such programs on participant well-being has not been tested. This randomized trial evaluated the impact of tailored telephone coaching and Internet interventions on health risk behaviors and individual well-being. Exercise and stress management were the primary health risks of interest; improvements in other health risk behaviors were secondary outcomes. A sample of 3391 individuals who reported health risk in the areas of exercise and stress management were randomly assigned to 3 groups: telephonic coaching that applied Transtheoretical Model (TTM) tailoring for exercise and minimal …

The Price They Pay: Protecting The Mother-Child Relationship Through The Use Of Prison Nurseries And Residential Parenting Programs, Anne E. Jbara Oct 2012

The Price They Pay: Protecting The Mother-Child Relationship Through The Use Of Prison Nurseries And Residential Parenting Programs, Anne E. Jbara

Indiana Law Journal

Over the past century, while advocates of prison nurseries have applauded their individual and societal benefits, opponents have criticized their touchy-feely undertones, arguing that children do not belong behind bars. New York instituted the first modern prison nursery program in 1901 at its Bedford Hills facility, and the nursery has existed ever since. The federal government and a number of other states have followed suit in developing programs that, to varying degrees, give mothers and infants an opportunity to remain together until the infant reaches a particular age. The requirements for such programs vary by state but generally only permit …

How Nations Share, Allison Christians Oct 2012

How Nations Share, Allison Christians

Indiana Law Journal

Every nation has an interest in sharing the gains they help create by participating in globalization. Citizens should be very interested in discovering how well their governments fare in claiming an adequate share of this international income stream, since a government that cannot or will not exert its taxing jurisdiction internationally is potentially missing out on a very large and very productive source of revenue. Yet it is all but impossible for citizens to observe exactly how, or how well, their governments navigate this aspect of economic globalization. The vast majority of international tax law plays out in practice through …

Federal Constitutions, Global Governance, And The Role Of Forests In Regulating Climate Change, Blake Hudson Oct 2012

Federal Constitutions, Global Governance, And The Role Of Forests In Regulating Climate Change, Blake Hudson

Indiana Law Journal

Federal systems of government present more difficulties for international treaty formation than perhaps any other form of governance. Federal constitutions that grant subnational governments virtually exclusive regulatory authority over certain subject matter may constrain national governments during international negotiations—a national government that cannot constitutionally bind subnational governments to an international agreement cannot freely arrange its international obligations. While federal nations that grant subnational governments exclusive regulatory control obviously place value on stringent decentralization and the benefits it provides in those regulatory areas, the difficulty lies in striking a balance between global governance and constitutional decentralization in federal systems. Recent scholarship …

Reforming The Good Moral Character Requirement For U.S. Citizenship, Kevin Lapp Oct 2012

Reforming The Good Moral Character Requirement For U.S. Citizenship, Kevin Lapp

Indiana Law Journal

This Article explores the impact of the convergence of criminal law and immigration law on the most valued government benefit in the land: citizenship. Specifically, it examines how criminal history influences the opportunity to naturalize through the good moral character requirement for U.S. citizenship.

Since 1790, naturalization applicants have been required to prove their good moral character. Enacted to ensure that applicants were fit for membership and would not be disruptive or destructive to the community, the character requirement also allowed for the reformation and eventual naturalization of those guilty of past misconduct. This Article shows that recent changes in …

The False Promise Of The Converse-1983 Action, John F. Preis Oct 2012

The False Promise Of The Converse-1983 Action, John F. Preis

Indiana Law Journal

The federal government is out of control. At least that’s what many states will tell you. Not only is the federal government passing patently unconstitutional legislation, but its street-level officers are ignoring citizens’ constitutional rights. How can states stop this federal juggernaut? Many are advocating a “repeal amendment,” whereby two-thirds of the states could vote to repeal federal legislation. But the repeal amendment will only address unconstitutional legislation, not unconstitutional actions. States can’t repeal a stop-and-frisk that occurred last Thursday. States might, however, enact a so-called “converse-1983” action. The idea for converse-1983 laws has been around for some time but …

Step Aside, Mr. Senator: A Request For Members Of The Senate Judiciary Committee To Give Up Their Mics, Paul E. Vaglicia Oct 2012

Step Aside, Mr. Senator: A Request For Members Of The Senate Judiciary Committee To Give Up Their Mics, Paul E. Vaglicia

Indiana Law Journal

In 1995, a law professor at the University of Chicago Law School dubbed the Supreme Court confirmation hearings “vapid and hollow” and added that they, as implemented, “serve little educative function, except perhaps to reinforce lessons of cynicism that citizens often glean from government.” Ironically, this same law professor, Elena Kagan, later endured the confirmation hearings as a nominee and currently sits as the 112th Justice of the U.S. Supreme Court. While she may be one of the few to ever reach a seat on the High Court, she is not alone in her assessment of the Supreme Court’s lackluster …

A Remedy Foreclosed? Mortgage Foreclosure And The Fair Debt Collection Practices Act, Richard D. Gage Oct 2012

A Remedy Foreclosed? Mortgage Foreclosure And The Fair Debt Collection Practices Act, Richard D. Gage

Fordham Law Review

During the Global Financial Crisis, millions of homeowners received foreclosure notices. Many of these notices were sent by attorneys, and informed consumers of an impending mortgage foreclosure. Courts are split on whether foreclosures must conform with the Fair Debt Collection Practices Act (FDCPA). In order to be subject to the FDCPA, an entity must meet the statutory definition of “debt collector.” Courts struggle with whether foreclosure attorneys fall under this definition. This Note examines this conflict, and suggests a fact-sensitive framework for evaluating whether foreclosure attorneys are debt collectors.

Through Smoke And Mirrors: Constructing Identity Between The Myths Of Black Inferiority And A Post-Racial America, Gwyneira Yvette Dixon Ledford Oct 2012

Through Smoke And Mirrors: Constructing Identity Between The Myths Of Black Inferiority And A Post-Racial America, Gwyneira Yvette Dixon Ledford

College of Graduate Studies: Theses & Dissertations

This dissertation is an inquiry into my life. It is an exploration of my lived experience as an African American female negotiating through traditions in Southern culture and societal pressures to create a positive identity. Using autobiographical narrative (Connelly, He, & Phillion, 2008, Pinar, 2008) as a methodology and Black Feminist Thought (Collins, 2000), double consciousness (DuBois, 1903), and the Nigrescence Theory of black identity development (Cross, 1991) as the theoretical framework, I examine my experiences from childhood to adulthood. Through these narrations, I note paradigm shifts in my thinking that identify the psychological struggles between feeling racially inferior and …

Two Sides Of The Megalopolis: Educating For Sustainable Citizenship, Alexander Pope, Timothy Patterson Oct 2012

Two Sides Of The Megalopolis: Educating For Sustainable Citizenship, Alexander Pope, Timothy Patterson

Education Faculty Publications

Despite widespread focus on literacy and math at the expense of other subjects, citizenship and environmental education have an important role in American public education. Citizenship and environmental education are broadly tasked with helping students develop the knowledge, skills, and attitudes needed to shepherd the body politic and natural world, respectively, into the future. For educators and administrators concerned with instructional efficiency, educational farm visits offer one means of pairing these two approaches into a unified learning experience. This paper presents findings from a qualitative case study analysis of two such programs, incorporating interviews with and observations of visiting students, …

Analysis Of Bank Performance In California And The Rest Of The Twelfth Federal Reserve District, Stoyu I. Ivanov Oct 2012

Analysis Of Bank Performance In California And The Rest Of The Twelfth Federal Reserve District, Stoyu I. Ivanov

Mountain Plains Journal of Business and Technology

"In this study I examine the performance and sensitivity of performance to macro factors of banks headquartered in California and banks headquartered in the rest of the states in the Twelfth Federal Reserve District. I find that prior to the financial crisis which started in the fourth quarter of 2007 the non-California banks outperformed California banks; however, towards the end of the financial crisis California banks outperformed non-California banks. I also find higher macro factor sensitivities of nonCalifornia banks indicating more macro risk carried by these institutions. The higher risk explains the superior performance in expansions and underperformance in recessions …

Interest Rate Elasticity Of Capitalization Rates, Dan W. Hess, Drew Macha Oct 2012

Interest Rate Elasticity Of Capitalization Rates, Dan W. Hess, Drew Macha

Mountain Plains Journal of Business and Technology

"The investment real estate market in the United States experienced tremendous growth and robust returns in the first half of this decade followed by a severe decline in the second half as evidenced by declining property values and sub-par returns. There were many causes for the decline in the real estate investment market. This paper explores one and asks the question: How susceptible are real estate returns to changes in interest rates in the broader economy? Or, put another way, what is the interest rate elasticity of capitalization rates? Utilizing methods from the valuation of fixed-income securities, this paper demonstrates …

Small Things And First Things – A Pedagogical Tool For Accounting Students, David S. Christensen, Greg Powell, David Rees Oct 2012

Small Things And First Things – A Pedagogical Tool For Accounting Students, David S. Christensen, Greg Powell, David Rees

Mountain Plains Journal of Business and Technology

Experiences early in life or career can shape character and set patterns of behavior. Just as making poor choices in “small things and first things” can adversely affect one’s character and lead to more egregious behavior, making correct choices can positively build the character of a person (Cheffers and Pakaluk 2007). This pedagogical tool provides two examples, one negative and one positive, to help students remember their own character-building experiences. WorldCom accountant Betty Vinson initially resisted an order to make a relatively minor inappropriate journal entry, but caved to management pressure. This set her on a slippery path of accounting …

The Importance Of Culture Change And Change Management In Successful Implementation Of Sap Enterprise Resource Planning Systems, William S. Thomas, Danielle Babb, John E. Spillan

Mountain Plains Journal of Business and Technology

"Enterprise Resource Planning (ERP) has enabled organizations to connect vendors, the organization, and customers in an almost seamless manner with real-time accurate communication and information. In an increasingly competitive environment, businesses are looking for ways to become more competitive within their marketplace. Many are turning to ERP solutions to facilitate multiple competitive priorities to stand above competing businesses or to create a new competitive advantage. Critical success factors and change management are the primary vehicles for the achievement of success in the adoption of these systems. This research studies how change management becomes a significant link to successful ERP implementation. …

Phylogeny Of A Neotropical Clade In The Gesneriaceae: More Tales Of Convergent Evolution, John L. Clark, Minde M. Funke, Aaron M. Duffy, James F. Smith

Biology Faculty Publications and Presentations

The Gesneriaceae is a family known for convergent evolution of complex floral forms. As a result, defining genera and resolving evolutionary relationships among such genera using morphological data alone has been challenging and often does not accurately reflect monophyletic lineages. The tribe Episcieae is the most diverse within Neotropical Gesneriaceae in terms of its number of species and morphological diversity. As a result, defining genera using floral characters has been historically troublesome. Here we investigate relationships among genera of the tribe using an array of chloroplast DNA, nuclear ribosomal genes, and low-copy nuclear genes to provide resolution for the monophyly …

Extension Of The Spatial Autocorrelation (Spac) Method To Mixed-Component Correlations Of Surface Waves, Matthew M. Haney, T. Dylan Mikesell, Kasper Van Wijk, Hisashi Nakahara

CGISS Publications and Presentations

Using ambient seismic noise for imaging subsurface structure dates back to the development of the spatial autocorrelation (SPAC) method in the 1950s. We present a theoretical analysis of the SPAC method for multicomponent recordings of surface waves to determine the complete 3 × 3 matrix of correlations between all pairs of three-component motions, called the correlation matrix. In the case of isotropic incidence, when either Rayleigh or Love waves arrive from all directions with equal power, the only non-zero off-diagonal terms in the matrix are the vertical–radial (ZR) and radial–vertical (RZ) correlations in the presence of Rayleigh waves. Such combinations …

Online Monitoring Perceptions Of North Texas Hr Managers, Gundars Kaupins, Malcolm Coco, Andrew Little, Decateur Reed

Management Faculty Publications and Presentations

With businesses losing billions to computer crime and employees wasting considerable time on their computers looking at sports updates, the latest fashion trends, and even less appropriate websites, businesses are cracking down by monitoring their employees. The efforts are to ultimately reduce scams, identify theft, computer crimes, fraud, sexual abuse, piracy, and threats. As a result, many businesses have resorted to online monitoring of their workplace computers.

In this context, we look at how human resources (HR) professionals see three aspects of online monitoring. First, how do they view the discipline managers provideemployees based on what they see about them …
