Party Sophistication And Value Pluralism In Contract, Meredith R. Miller Jan 2013

Party Sophistication And Value Pluralism In Contract, Meredith R. Miller

Touro Law Review

In a previous article, Contract Law, Party Sophistication and the New Formalism, 75 Missouri L. Rev. 493 (2010), I documented a trend in United States case law and scholarship that fashions a dichotomy between sophisticated and unsophisticated parties. That article set out to explain the trend as a theoretical compromise between formalism and realism in the face of a renewed formalism.

However, as I noted in the previous article, the “new formalism” may not be formalism at all because it retains normative concerns. Indeed, the shift in legal thought may be more appropriately and simply characterized as embracing pluralism. This …

The Significance Of Genetics Across Disciplines: Genetic Counseling & Testing, Rachel Bertsch Jan 2013

The Significance Of Genetics Across Disciplines: Genetic Counseling & Testing, Rachel Bertsch

Honors Projects

Genetics is a rapidly expanding field that encompasses a variety of disciplines, especially within the health care field. Since the advent of the Human Genome Project, the abilities of genetic research has greatly increased, allowing us to create genetic tests that can search many genes and find mutations indicating disease or risk for future diseases or disorders. The widespread use of genetic testing has necessitated more genetic counseling to assist in explaining and returning test results to patients and their families. Additionally, genetic testing brings up outside considerations that are important to think about. Direct to consumer genetic testing, the …

The Necessity For The Reconfiguration Of Shakespeare Education In Secondary Schools, Kristen Buder Jan 2013

The Necessity For The Reconfiguration Of Shakespeare Education In Secondary Schools, Kristen Buder

Honors Projects

Current resources, such as "No Fear Shakespeare," translate Shakespeare's works in to modern English. These resources have become a reference for students. Although these resources are common, they do not offer the educational value that complex literary works should. In order to address the common misuse of these resources, the following study examines the history of the study of Shakespeare, as well as the educational value of the use of Shakespeare adaptations in secondary classrooms. Through studying the Ohio State Grade Level Standards and the Common Core learning anchors, this argument for the inclusion of adaptation seems well supported. Not …

Song Of The Lonely Mountain, Allison Davis Jan 2013

Song Of The Lonely Mountain, Allison Davis

Honors Projects

The primary goal of this “creative form” project was to arrange a piece for my senior recital that would be entertaining as well as serve an educational purpose for all involved. In this case, the piece was Song of the Lonely Mountain, the music of which is featured in the modern film The Hobbit: An Unexpected Journey based off of the popular novel written by J.R.R. Tolkien. Along with arranging and performing the piece itself, another goal was to recruit performers who had not necessarily played the instruments they would be assigned to in order to teach them new …

An Introduction To The Law Of Unjust Enrichment, Alvin W. L. See Jan 2013

An Introduction To The Law Of Unjust Enrichment, Alvin W. L. See

Research Collection Yong Pung How School Of Law

The principle that no one shall be unjustly enriched at the expense of another has been invoked to rationalise the right to restitution in a number of cases which fall outside the provinces of contract and tort. This has eventually led to the recognition of an independent legal discipline known as the law of unjust enrichment. It is among the most debated private law subjects today despite its remarkably recent origin. In Malaysia, despite the increase in judicial reference to the language of unjust enrichment to justify an award of restitutionary relief, there is generally a lack of understanding about …

Educating For The Future: Teaching Evidence In The Technological Age, Denise H. Wong Jan 2013

Educating For The Future: Teaching Evidence In The Technological Age, Denise H. Wong

Research Collection Yong Pung How School Of Law

The advent of the technological age has had significant effect on litigation practice, none more so than in the area of evidence gathering and presentation in court. A significant proportion of evidence that is gathered for both criminal and civil matters is now electronic in nature, and this necessitates a change in the way that lawyers think and advise on evidential issues. It is argued here that rather than simply focusing on principles relating to the admissibility of evidence in court, the traditional course on evidence law should be modified to equip students with an intellectual framework that conceives of …

Current Legal Developments China: Prevention Of Invasive Species From Ballast Water In China, Nengye Liu

Research Collection Yong Pung How School Of Law

The introduction of invasive marine species by ships is one of the four most significant threats to the world's oceans.' Global shipping moves over 80% of the world's commodities and transfers approximately 3 to 5 billion tonnes of ballast water each year.^ Every day about 3,000 species of animals and plants are transported around the world in the ballast water of ships, or on their hulls.' Some invasive alien marine species can have serious ecological as well as social and economic impacts."*

Queer Housing Nacional Google Group: A Librarian’S Documentation Of A Community-Specific Resource, Shawn(Ta) Smith-Cruz Jan 2013

Queer Housing Nacional Google Group: A Librarian’S Documentation Of A Community-Specific Resource, Shawn(Ta) Smith-Cruz

Publications and Research

Beginning with a discussion of information access and its relationship to communities, this article is a first-person experience for creating a community-specific information resource, a queer housing listserv called Queer Housing Nacional. Written as a case study for how librarians may apply their skills to community as well as document the journey of this time capsuled listserv, one may find that this listserv may complicate librarianship’s promotion of open access, instead, encouraging closed participatory group structures, with collective distributions of power. Included are multiple email exchanges from the listserv, as well as Appendices of survey questions, notable responses, and …

The Use Of Public Computing Facilities By Library Patrons: Demography, Motivations, And Barriers, Kurt Demaagd, Han Ei Chew, Guanxiong Huang, M. Laeeq Khan, Akshaya Sreenivasan, Robert Larose

Research Collection Office of Impact

Public libraries play an important part in the development of a community. Today, they are seen as more than store houses of books; they are also responsible for the dissemination of online, and offline information. Public access computers are becoming increasingly popular as more and more people understand the need for internet access. Using a series of surveys conducted in 12 libraries across the state of Michigan, the current study is a step towards understanding why the computing facilities are widely used, and what are the motivations behind their use. In addition, barriers and other factors that hinder usage are …

Changes In The White-Black House Value Distribution Gap From 1997 To 2005, Eric Fesselmeyer, Kien T. Le, Kiat Ying Seah Jan 2013

Changes In The White-Black House Value Distribution Gap From 1997 To 2005, Eric Fesselmeyer, Kien T. Le, Kiat Ying Seah

Research Collection College of Integrative Studies

This paper examines the white-black house value gap across the entire value distribution. Instead of using standard conditional mean analysis and decomposition methods (via OLS regression), we estimate and decompose the changes in the white-black house value gap from 1997 to 2005 using quantile regression. We find that the racial gap in 1997 and 2005 is mostly explained by differences in housing characteristics of white- and black-owned houses but that the variation in the racial gap is explained by racial differences in implicit prices of housing characteristics. Our results show that analysis at the conditional mean masks variations at the …

Strategic Exploitation Of A Common Resource Under Environmental Risk, Eric Fesselmeyer, Marc Santugini Jan 2013

Strategic Exploitation Of A Common Resource Under Environmental Risk, Eric Fesselmeyer, Marc Santugini

Research Collection College of Integrative Studies

We study the effect of environmental risk on the extraction of a common resource. Using a dynamic and non-cooperative game in which an environmental event impacts the renewability and the quality of the resource, we show that the anticipation of such an event has an ambiguous effect on extraction and the tragedy of the commons. A risk of a reduction in the renewability induces the agents to extract less today while a risk of a deterioration in the quality has the opposite effect. Moreover, when environmental risk induces conservation, the tragedy of the commons is worsened. (C) 2012 Elsevier B.V. …

Measuring Differentials In Communication Research: Issues With Multicollinearity In Three Methods, Sonny Rosenthal Jan 2013

Measuring Differentials In Communication Research: Issues With Multicollinearity In Three Methods, Sonny Rosenthal

Research Collection College of Integrative Studies

Models of communication processes sometimes require the computation of the difference between two variables. For example, information insufficiency is the difference between what people know and what they think they need to know about an issue, and it can motivate information seeking and processing. Common methods that compute this differential may bias model estimates as a function of the correlation between the differentiated variables and other variables in the model. This article describes Citation the general form of Cohen and Cohen's (1983) analysis of partial variance for computing differentials and analyzes simulated data to contrast that method with two alternative …
