In democracy jurisprudence, the Roberts Court wears two faces. Its most recent duo of cases illustrates the inconsistency. In Rucho v. Common Cause, the Court ruled that even grossly partisan gerrymanders are nonjusticiable in federal courts. Yet, in Moore v. Harper, the Court rejected granting unreviewable authority to state lawmakers to regulate federal elections—for now. This combination of rulings is not ideological moderation or judicial restraint, as the Court claims. These recent cases are emblematic of broader unpredictability and selectivity in election law. The Madisonian political philosophy upon which the U.S. Constitution rests did not supply the nation with a well-developed theory of electoral procedures. Instead, Madisonian philosophy concentrated on the separation of powers and other elements of constitutional architecture, including federalism, in order to prevent factions from subverting the common good. Subsequent history has demonstrated that Madisonian constitutional architecture, while necessary, is not sufficient for democratic government to operate in the interest of the people as a whole, rather than on behalf of a faction and its own interests. In recent years, plaintiffs have frequently invoked the Civil Rights Act’s “Materiality Provision” as a basis for challenging state election laws. The Provision prevents states from denying a person’s right to vote based on certain types of immaterial errors or omissions in his voter registration application or other election-related filings. Historically, the Provision played an important role in combatting Jim Crow measures used to systematically disenfranchise African Americans. Today, it continues to protect voters from disenfranchisement based on minor, hypertechnical, “picayune” mistakes unrelated to their eligibility to vote. Originalism has a democracy problem. Among prevailing theories of constitutional interpretation—pragmatism, common-law constitutionalism, popular constitutionalism, and Elysian representation-reinforcement—originalism uniquely creates a legal environment in which antidemocracy is viable. That is, it uniquely imperils democratic structures, practices, and norms that are essential to modern democratic self-government. This fundamental flaw is most apparent when considering the relationship between election law (a conspicuously non-originalist area of law) and originalism. Accordingly, this Article uses election law as a heuristic for illustrating one of originalism’s central deficiencies. Voters are special. They are the foundation of our constitutional democracy. Everything starts with the voters.

State constitutions, too, are special, as the recent surge in scholarship on state constitutions demonstrates.

This Article bridges the gap between various strands of scholarship on state constitutions, the right to vote, and democracy, making several novel claims about the way in which state constitutions protect voters. First, this Article canvasses all fifty state constitutions to conclude that they contain multiple levels of protection for the right to vote through numerous clauses that, in combination, elevate the status of voters in the constitutional structure. …

Finasteride has been used to treat male pattern baldness and benign prostate hyperplasia and could potentially treat female pattern baldness and polycystic ovary syndrome. The impact on reproduction in female patients who are taking or have taken finasteride is unknown. Using drosophila melanogaster as a model, this study was designed to investigate the impact of finasteride on female fly reproduction and their offspring. The female flies in this study will be fed dosage equivalents of 0.5 mg, 1 mg, and 5 mg of finasteride, along with a control group of females who consume no finasteride. The flies will be allowed …

The Stop Campus Hazing Act was signed into law late in December of 2024. The law represents a significant step in national efforts to prevent hazing by improving hazing reporting and prevention efforts on college campuses.

UHSP has always taken hazing seriously and has worked to raise awareness about hazing and prevent hazing in any form on our campus. The Stop Campus Hazing Act adds another layer to our prevention efforts by requiring the enhancement of transparency, and prioritizing prevention efforts.

Cyanate esters are key thermosetting resins for composite materials that require structural integrity and resistance to elevated temperatures. Because cyanate ester composites require relatively high processing temperatures, they are susceptible to the formation of process-induced residual stresses, which compromise their overall strength and durability. Students continue to function below grade level proficiency in math and thus, the need for effective intervention. The purpose of this study was to develop and examine the efficacy of a targeted number sense intervention for second grade students. Specifically, the study examined the benefits of an intervention, analyzed number sense as an essential foundational skill, and determined if proficiency in number sense leads to math proficiency. Employing a quasi-experimental design, an intervention was implemented in 14 weeks for students who demonstrated a deficit in number sense and outcomes were assessed using multiple measures. Trees in U.S. cities are unevenly and inequitably distributed. To address this challenge, planners increasingly use digital tools to prioritize areas and communities for tree projects. The goal is to achieve tree equity wherein all populations have access to the benefits of urban trees. Here we identify limitations and opportunities in the operationalization of the tree equity concept via digital platforms.
