Restoring Reputational Rights Through A Government Publication Of A Declaration Of Innocence, Michael M. Berger
Brigham Young University Journal of Public Law
In a society that has become increasingly interconnected through advancements in technology, the stig matizing consequences of a false criminal accusation or conviction ca n be devastating. Ironically, unlike the technological advancements societ y has experienced, the ability to protect one’s reputation from such harm requires using the same limited remedies that existed decades ago. With few effective remedies available, those who have been falsely accused or convicted of a crime are without adequate ways to restore their reputations. To fill this remedial void, the federal government should create a forum whereby an individual’s innocence might be published as government …

Climate‐Induced Changes In The Risk Of Hydrological Failure Of Major Dams In California, Iman Mallakpour, Amir Aghakouchak, Mojtaba Sadegh
Civil Engineering Faculty Publications and Presentations
Existing major reservoirs in California, with average age above 50 years, were built in the previous century with limited data records and flood hazard assessment. Changes in climate and land use are anticipated to alter statistical properties of inflow to these infrastructure systems and potentially increase their hydrological failure probability. Because of large socioeconomic repercussions of infrastructure incidents, revisiting dam failure risks associated with possible shifts in the streamflow regime is fundamental for societal resilience. Here we compute historical and projected flood return periods as a proxy for potential changes in the risk of hydrological failure of dams in a …

Phosphorus Improves Leaf Nutrient Concentrations In Wheat, Oat, And Cereal Rye, Jerri Lynn Henry, William E. Mcclain, Melissa A. Remley
College of Agriculture
Core Ideas: Increased P availability increases leaf P and Mg in wheat, oat, and rye. The grass tetany ratio is improved with greater P availability in these species. Unlike cereal rye and oat, wheat increases shoot growth with high P levels.
Winter annual species grown for forage are prone to mineral imbalances that could result in animal nutritional disorders, such as grass tetany. Adequate soil P has been found to be critical for the growth and adequate nutrient content of Mg, Ca, and K in other forages for grazing animals. This study examined the effect of P availability on growth …

Unintentional Bathtub Drowning Deaths Among Those Aged 65 Years And Older In Australia, Amy E. Peden, Richard C. Franklin, John H. Pearn M.D., Alison J. Mahony
International Journal of Aquatic Research and Education
When compared with other age groups, fatal drowning rates among seniors have stayed static. This study identifies causal factors in unintentional bathtub drowning deaths among people aged 65 years and over. This study is a 10-year (2003-2012) total population retrospective survey of all unintentional bathtub (baths, spa baths and showers) drowning deaths afflicting people aged 65 years and over. Data were sourced from the Australian National Coronial Information System. Risk factors and circumstantial variables were analysed including sex, age, activity prior to drowning, alcohol, drugs, pre-existing medical conditions, living circumstances, time until found, and performance of cardio-pulmonary resuscitation (CPR). There …

Incorporating Active Adjustment Into A Financing Based Model Of Capital Structure, Neal Maroney, Wei Wang, M. Kabir Hassan
Incorporating Active Adjustment Into A Financing Based Model Of Capital Structure, Neal Maroney, Wei Wang, M. Kabir Hassan
Business Faculty Publications
The conventional partial adjustment model, which focuses on leverage evolution, has difficulty identifying deliberate capital structure adjustments as it confounds financing decisions with the mechanical autocorrelation of leverage. We propose and estimate a financing-based partial adjustment model that separates the effects of financing decisions on leverage evolution from mechanical evolution. The speed of adjustment (SOA) is firm specific and stochastic, and active targeting of capital structure has a multiplier effect that depends on the size of financial deficit. Overall, we find expected SOA from active rebalancing
(30%) more than doubles what is expected from mechanical mean reversion alone (13%).
