Maurice James Holland (1984-1985 Acting; 1986 Acting)

After leaving the Indiana University School of Law in 1986, Maury Holland became the dean at the University of Oregon School of Law. He stepped down as Oregon’s dean in 1992 and continued teaching until his retirement in 2008. Holland died in 2020.

On March 13, 2001, Holland delivered the following lecture to the Round Table of Oregon. The lecture profiles University of Oregon Law Alumni Yosuke Matsuoka, who received his law degree in 1910 and went on to serve as a Japanese diplomat and the country’s Minister of Foreign Affairs.

This essay examines current developments in International Relations theory in China. First it comments on Song Xinning's essay, agreeing that IR theory in China is limited by ideology, the dominance of policy-oriented research, and the state. But rather than seeing culture ('IR theory with Chinese characteristics') as a problem that can be solved by a more scientific approach to IR theory, the essay argues that the scientism of realism and IPE has similar problems. One of the many complexities of multinational coalition operations stems from differences in culture, military procedures, and command and control processes between the cooperating command centers. These differences can influence the interactions between decision makers of different command centers and can affect the outcome of the coalition operation. A coalition model, composed of individual models of the five-stage interacting decision maker model, was used in a virtual experiment. The subjective parameters included in the decision maker model can be any attribute that characterizes the heterogeneity of the decision makers. Systems of different command centers that are brought together in a coalition operation must have some level of interoperability in order to work together. Bares [2000] has introduced a formalism of three interoperability domains that describe the ability of the systems to define their own level of interoperability within the coalition by assessing their own and the other systems’ ability to interact on actions of the coalition. The European Union is carving out a sphere of potentially vast influence in the Euro-Mediterranean basin, while also cultivating special relationship further south in the Arabian Peninsula. The author argues here that a declaration of victory by the critics of the dormant foreign affairs doctrine would be premature. Notwithstanding the Court's citation of Ashwander v. TVA, the actual grounds of the decision in Crosby were in no meaningful sense less "constitutional" in nature than a decision based on the dormant foreign affairs power would have been. Moreover, even though the Court said that its decision was based on a straightforward application of "settled ... implied preemption doctrine," the Court's preemption analysis was anything but ordinary.
