How has the European Union transformed its policy arsenal to counter coercion? This work introduces geo-legality—a condition wherein legal-normative authority counters external coercion—examining how the EU has redefined its self-defense amid contemporary rivalry between great powers (such as itself and China). Analyzing China’s 2021–2022 economic coercion against Lithuania, following Lithuania’s acceptance of a “Taiwanese Representative Office,” I demonstrate how targeted pressure catalyzed Brussels’ institutional innovation, including the Anti-Coercion Instrument, WTO litigation (DS-610), enhanced investment screening, and reforms to the Blocking Statute. This study examines alternative ways of conceptualizing sovereignty through European Union involvement in the issue areas of conflict management, capacity-building, and human rights promotion in four independence-seeking regions: Western Sahara, Somaliland, Abkhazia, and Transdniestria. Document analysis and in-depth key informant interviews were used to develop a theory of European Union involvement in independence-seeking regions.

The theory of European Union involvement proposed in this study rejects state-centric notions of sovereignty as the only mode of understanding sovereignty and holds that independence-seeking regions (ISRs) enact various sovereignties through their existence. There is widespread consensus amongst scholars that sanctions—the deliberate withdrawal of customary trade and financial relations—do not work. Despite this perception, states are deploying sanctions at an increasing rate. This Article explains this paradox by arguing the predominant notion of sanctions’ utility employed by scholars is unduly constrained, narrowly focusing on the ability of such measures to modify the behavior of sanctioned parties while disregarding the alternative benefits this instrument can deliver.
