This work concerns the use of temporary documentation by migrants in transit through Mexico, specifically an identification known as the Clave Única de Registro de Población (CURP.) In recent years, migrants have employed a strategy entailing applying for asylum in Mexico solely to obtain a temporary CURP, falsely believed to provide safe transit through Mexico. A majority of the Tibetans in India are stateless, meaning that they have citizenship to no internationally recognized country. India is not a signatory to the 1951 UN Refugee Convention and has no national refugee framework. Therefore, residents of India are either designated as foreigners or citizens. Tibetans—including those that were born in India—are labeled as “foreigners” in India. Stateless Tibetans in India have no permanent legal status, making them vulnerable to detention and deportation. Since its inception, the United Nations Convention Against Torture (UNCAT) conceived torture as a state crime. The Convention established a so-called “state-nexus” that effectively excludes torture committed by non-state actors.
