Teaching Justice-Connectivity, Michael Pinard
Teaching Justice-Connectivity, Michael Pinard
Faculty Scholarship
This Essay conveys the importance of building in law students the foundation to recognize the various systems, institutions, and conditions that often crash into the lives of their clients, as well as the residents of the communities that are just outside law schools’ doors. It does so through proposing a teaching model that I call Justice-Connectivity. This model aims for students to understand and be humbled by the ways in which different institutions, systems, and strands of law converge upon, oppress, isolate, and shun individuals, families, and communities. The ultimate teaching lesson is that individuals, families, and communities are often …
Progress Is A Chameleon, Melanie D. Wilson
Progress Is A Chameleon, Melanie D. Wilson
Scholarly Articles
Progress is a chameleon. Its hue changes with our perspective, which is influenced by our race, gender, socio-economic status, religious affiliation, sexual orientation, age, and ancestry, among other influences. The amount of progress we perceive also varies from person to person and depends on the type of law we practice and whether we work in a small town or big city. Perhaps most importantly, how we view the rapidity of change in the legal profession — as stagnant, developing, or somewhere in between — is impacted by our unique experiences, our psychology, the length of time we have been lawyers, …

"One Rule of Law Project in Post-Soviet Russia" is published as Chapter 9 of the book At Home Abroad: Friendship First - A Look at Rule of Law Projects and Other International Insights, (ed. Joseph Nadeau, New York: Austin Macauley Publishers LLC, 2019). This book provides personal insights into an international cooperative effort to promote the rule of law in emerging democracies around the world. Professor Scherr's chapter examines the cultural context within a study of the rule-of-law project that was conducted between 1999 and 2004 in Vologda, Russia.
Legal Education Unbundled (And Rebundled), Megan Carpenter
Legal Education Unbundled (And Rebundled), Megan Carpenter
Law Faculty Scholarship
This essay calls for an unbundling of legal education, much like the kind of unbundling we have seen in the cable, music, and print news media. It suggests that the standard legal education "bundle"-the generalized JD-is just one of many forms of legal education that can be packaged appropriately for today's legal education market needs.

John And June Mary Makdisi: An Intellectual And Moral Journey, Siegfried Wiessner, Roza Pati
Intercultural Human Rights Law Review
John and June Mary Makdisi have been our friends and treasured colleagues for many a year. It is with exceptional delight that we present these lines and this volume of intellectual contributions of friends, in the global university tradition of an hommage, a Festschrift celebrating their professional and personal contributions to our St. Thomas Law family on the occasion of their retirement. This Festschrift is also a vessel of admiration, respect, gratitude, warm wishes and prayers for God's grace and blessings for the magic of their new journey.

Law School In A Different Voice: Legal Education As A Work Of Mercy, Pamela A. Wilkins
Law School In A Different Voice: Legal Education As A Work Of Mercy, Pamela A. Wilkins
Articles
What might it mean for a law school to share this Mercy charism? More broadly, what would it mean for a law school to share the spiritual DNA of a female order, seeing the world from historically female perspectives and motivated by historically female concerns? More broadly still, in this #metoo era, in which women make up the majority of American law students, should it simply be business as usual at religiously affiliated law schools, or should we seize the opportunity to consider seriously, and in the light of faith, women’s perspectives on legal education, law, and justice?

Uniting The Head, Hands, And Heart: How Specialty Externships Can Combat Public Interest Drift, Alexi Freeman, Katherine Steefel
Uniting The Head, Hands, And Heart: How Specialty Externships Can Combat Public Interest Drift, Alexi Freeman, Katherine Steefel
Sturm College of Law: Faculty Scholarship
Many students come to law school because they want to use their law degrees “for good,” to help people, have an impact on society, or create social change. As has been extensively documented, these plans often dissipate at some point during their three years. Public interest drift, as this phenomenon is commonly referred, is a crisis caused by numerous factors. It requires a full-fledged, multi-faceted effort to push back against it. In this article, we propose the development of public interest specialty externship programs as one tool to combat drift. These programs offer students the ability to extern at a …

Can Accessibility Liberate The "Lost Ark" Of Scholarly Work?: University Library Institutional Repositories Are "Places Of Public Accommodation”, 52 Uic J. Marshall L. Rev. 327 (2019), Raizel Liebler, Gregory Cunningham
UIC Law Review
For any body of knowledge – an ark of power or a corpus of scholarship – to be studied and used by people, it needs to be accessible to those seeking information. Universities, through their libraries, now aim to make more of the scholarship produced available for free to all through institutional repositories. However, the goal of being truly open for an institutional repository is more than the traditional definition of open access. It also means openness in a more general sense. Creating a scholarship-based online space also needs to take into consideration potential barriers for people with disabilities. This …

Exploring The Role Of Emotions In Clinical Legal Education: Inquiry And Results From An International Workshop For Legal Educators, Catherine F. Klein, Kate Seear, Lisa Bliss, Paul Galowitz

Clinical legal education provides a unique opportunity to engage with emotions. This article describes and reflects on an interactive workshop that examined the nature, meaning and significance of emotions in clinical legal education. Through a variety of incorporated staged activities, employing the teaching methods of scaffolding as well as backward design, participants explored aspects of the emotional dimensions of the relationships between clinical teachers/supervisors and their students, along with the relationship between students and their clients. Participants extracted ideas for how educators should approach emotions when they surface in legal clinics. This article provides a detailed overview regarding the rationale …

The Future Of Clinical Legal Scholarship, Michele E. Gilman
The Future Of Clinical Legal Scholarship, Michele E. Gilman
All Faculty Scholarship
The legal academy is questioning the future of legal scholarship given its costs and perceived disconnect from law practice. However, the future of clinical legal scholarship is typically left out of these debates, although it offers a powerful rejoinder to these recurring critiques – it is deeply engaged with real-world problems, and it has demonstrable impacts. In addition, clinical scholars are an overlooked conduit for disseminating scholarship outside the ivory tower. Doctrinal faculty are unaware how much clinical faculty can ensure their work has an impact beyond SSRN citation counts. As law schools consider how to implement the new accreditation …

Can Mindfulness Help Law Students With Stress, Focus, And Well-Being: An Empirical Study Of 1ls At A Midwestern Law School, Richard C. Reuben, Kennon M. Sheldon

Recent calls for law students, lawyers, judges, and others in the legal profession to try mindfulness training to reduce stress and enhance wellbeing beg the question of whether mindfulness will "work" for those in the uniquely rigorous environment of law. There is no empirical research on mindfulness effects for lawyers - unlike the medical field, where research has found beneficial effects of mindfulness training for doctors, nurses, and other health care providers. To fill this gap in the literature, we conducted an empirical study of forty-seven first year, first semester law students at the University of Missouri School of Law …

This Article focuses on those Autistics who have the ability, in terms of intellect credential, and measurable skill, to enter the workplace. In particular, this Article addresses Autistics who are academics and teach at the collegiate level, specifically in the American legal classroom. I have chosen a narrow subset of a broad community to make a targeted argument for employment protection which can help expand the law for the entire Autistic community. While we are different than neurotypically developed persons, "[m]any with [Autism Spectrum Disorder (ASD)] have a high attention to detail and the ability to sustain intense concentration in …
