Trial Handbook For Maine Lawyers, Joel C. Martin Apr 2020

Trial Handbook For Maine Lawyers, Joel C. Martin

Maine Law Review

Lawyers Cooperative Publishing has issued trial handbooks for practitioners in some twenty-three states. One now appears for Maine lawyers, under the supervision of Bob Stolt of the Maine Bar. Trial Handbook for Maine Lawyers is a single-volume compendium of Maine precedent and practice as they relate to trials. Excluding the discovery matters that precede the trial and the appeal that may follow it, the book focuses on the actual conduct of the trial, from jury selection to verdict and judgment. In between, it covers the necessary matters: opening statements, the order and burden of proof, examination of witnesses, evidence, damages, …

Join With Me, Won't You? Civic Engagement, Covid-19, And The Millennial Generation Of Law Professors, Joseph A. Schremmer

Faculty Scholarship

My goals in this essay are to place legal education’s COVID-19 crisis into this broader context and illuminate the unique opportunity that millennial law professors have to create the conditions for more robust community participation within and outside of our law schools. Part I summarizes the decline of civic engagement and social capital in preceding decades and its consequences for law, public discourse, and quality of life. Part II outlines how this deficit of social capital exacerbates the challenges facing law schools and professors in delivering legal education and constructing community during the coronavirus pandemic. Part III explores the unique …

Get in Good Trouble: A Collection of Essays by Millennial Law Scholars Introduction by Verónica C. Gonzales-Zamora with essays by Kinda Abdus-Saboor, Ernestine Chaco, Marcus Gadson, Verónica Gonzales-Zamora, Camilo Romero, Lysette Romero Córdova, Morenike Saula, Joseph Schremmer, and Hon. Roshanna Toya. Afterword by Marcus Gadson. In response to the global pandemic, legal education in the United States shifted almost immediately to new tools and methods of delivery. Unsure of the lasting impact of these shifts, law faculty and law students around the country remain in limbo preparing for different scenarios when instruction resumes. Millennial law professors and scholars, with decades …

"Mommy Track" On Steroids: How The Pandemic Is Further Derailing "Moms Of Law", Lysette Romero Córdova

Faculty Scholarship

As students or professors with children to raise, we inherently experience law school differently from our male and childless peers—and not in a good way. Even before the pandemic hit, the Moms of Law were at a disadvantage because we must divide our time and attention between the demands of law school and parenting. Thus, while the pandemic has created challenges for everyone involved in legal education, the inequitable impact on those raising young children has brought new meaning to the term “mommy track.” Part I of this essay describes the mommy track experience and how the inequity that it …

The Legal Scholar's Guide Book Reviews, Jamie Abrams Apr 2020

The Legal Scholar's Guide Book Reviews, Jamie Abrams

Scholarly Articles in Law Reviews & Journals

Success in law school and in the legal profession often involves mastering and navigating the plethora of unwritten rules and norms that govern institutions and communities. Differences in access to those unwritten rules can privilege and advance some while disadvantaging others. A second-generation law student, for example, is far more likely to know about the professional value of law review than a first-generation law student. Law scholarship is particularly plagued by an insularity that can yield a problematic echo chamber within elite institutions and privileged communities. Thus, the more legal scholarship can be explicitly demystified, taught, and mentored, the more …

Total Scholarly Impact: Law Professors Citations, Michael P. Vandenbergh, J. B. Ruhl, Sarah Dunaway

Vanderbilt Law School Faculty Publications

In this article, we demonstrate that the citation counts and other author information available through the Web of Science database has made non-law citations possible to assemble and assess in a manner similar to the Sisk et al. methodology and the Hein legal citation study by Paul J. Heald and Ted Sichelman. A true apples-to-apples comparison, however, is not possible at this time given differences in the respective databases and search engines, as we explain in more detail in Part II.

Nevertheless, our study does serve as a demonstration project, showing that, with additional refinement of databases and search capacities, …

Give Me Liberty, Or Give Me Breath: A Call For Economic Justice, Verónica C. Gonzales Apr 2020

Give Me Liberty, Or Give Me Breath: A Call For Economic Justice, Verónica C. Gonzales

In Part I of this essay I interpret this unique moment in history through a retelling of the folk story La Llorona in order to identify the monsters and ghosts of the past and the present. Domino Renee Perez describes her own critical reflection of La Llorona as reinforcing 'a valuable lesson about power and authority' because her family’s 'storytelling circle was more than simply an arbitrary setting; it was a safe place for them to create, however problematically, a world of words, where they faced the dangers and challenges of life, embodied by a woman, and survived.' The lore …

Dean's Perspective: The Bar Exam: It's Time For Indiana To Adopt A Uniform Bar Exam, Austen L. Parrish

Articles by Maurer Faculty

For most of us, the Bar Exam conjures up memories of grueling prep courses, intensive studying, and a couple of long days of exhaustive tests. In a way, the exam is the final rite of passage from law student to law practitioner. The exam is intended to test minimal professional competency, evaluating an applicant's legal reasoning and ability to apply general legal principles to various fact patterns.

Recently, bar exams throughout the United States have come under scrutiny. Nationwide pass rates have declined significantly. The same has been true for Indiana. Even though pass rates for first-time takers at the …

Adding Legal Research To The Bar Exam: What Would The Exercise Look Like?, Patrick J. Meyer Mar 2020

Adding Legal Research To The Bar Exam: What Would The Exercise Look Like?, Patrick J. Meyer

Akron Law Review

Various authors have criticized the current bar exam format for not testing law practice skills. This is in spite of the ground-breaking MacCrate Report, the seminal publication of the practice-ready movement, which nearly 30 years ago listed ten fundamental practice skills. One of these ten Fundamental Lawyering Skills is legal research, which is still not tested on bar exams. The focus of this article will be on deficiencies pertaining to a lack of legal research readiness in the practice of law. My proposal is to add an interactive legal research exercise to the Multistate Performance Test (MPT), requiring applicants …

Celebrating Robert Cochran And The Future Of "Embodied" Christian Legal Scholarship, Barbara Armacost Mar 2020

Celebrating Robert Cochran And The Future Of "Embodied" Christian Legal Scholarship, Barbara Armacost

Pepperdine Law Review

The occasion for this Article is a festschrift for Professor Robert (“Bob”) Cochran. I celebrate Bob’s significant scholarly contributions to the maturing of Christian Legal Scholarship. He applied a Christian perspective to legal issues, hosted conferences, mentored Christian Legal Scholars, and edited books of essays featuring Christian perspectives on law. Bob’s work in this area had a huge influence on the flourishing of Christian Legal Scholarship. This Article considers the future of Christian Legal Scholarship. It enters an ongoing conversation (disagreement) between law Professors David Skeel and David Caudill. In a 2008 article, Skeel defined Christian Legal Scholarship so narrowly …

The Practice Of Law As Christian Discipleship, Nathan S. Chapman Mar 2020

The Practice Of Law As Christian Discipleship, Nathan S. Chapman

Pepperdine Law Review

“Can the ordinary practice of law be a religious calling?” In a number of scholarly books and articles, as a teacher, and as a mentor, Robert Cochran has answered this question with a resounding “yes.” This Essay, part of a festschrift published in Bob’s honor by the Pepperdine Law Review, engages with his work to propose a framework of Christian ethics for reconceiving the practice of law as a form of Christian discipleship. It argues that Christians should understand the practice of law as participation in government-as-judgment, participation that is always fraught with the risks of deceit, injustice, and abuse …

The Beatitudes, Lawyers, And Bob Cochran, Amelia J. Uelmen Mar 2020

The Beatitudes, Lawyers, And Bob Cochran, Amelia J. Uelmen

Pepperdine Law Review

Written on the occasion of a celebration of the work and scholarship of Bob Cochran, this reflection draws on his scholarship and also on his teaching and work to build vibrant communities of commitment, service, and scholarship at the intersection of religion, law, and professional life. Working with the text of the Beatitudes from the Gospel of Matthew, the essay highlights the value of how Bob Cochran has aimed not only to “do good,” but also to “be good” in a world and in a profession where it seems increasingly difficult to do so. His legacy offers a powerful inspiration …
