The Clerkship-Academia Continuum, Merritt E. Mcalister, Katherine Mims Crocker Jul 2021

The Clerkship-Academia Continuum, Merritt E. Mcalister, Katherine Mims Crocker

Popular Media

In the spring 2021 edition of Judicature (Vol. 105 No. 1), Florida International University Law Professor Howard Wasserman published data analyzing the number of current law professors who have served in clerkships and for which judges those professors clerked. His study offered a compelling picture of “academic feeder judges,” or those on the bench whose clerks tended to matriculate professionally in large numbers within the halls of the academy.

We asked two law professors, Merritt McAlister at the University of Florida, and Katherine Mims Crocker of William & Mary Law School, to reflect on Wasserman’s findings and to offer a …

Feminism’S Transformation Of Legal Education And Unfinished Agenda, Jamie Abrams Jun 2021

Feminism’S Transformation Of Legal Education And Unfinished Agenda, Jamie Abrams

Contributions to Books

Feminism has had a broad influence in legal education. Feminist critiques have challenged the substance of legal rules, the methods of law teaching, and the culture of legal education. Following decades of advocacy, feminist pedagogical reforms have generated new fields, new courses, new laws, new leaders, and new feminist spaces. There are many reasons to celebrate the accomplishments of our feminist pioneers and champions. Yet, COVID-19 has also exposed all the vulnerabilities and tenuousness of feminist gains too. Critical work remains for faculty, administrators, and students to carry the work forward with a vigilant purpose and determination.

Introduction: Lenses, Methods, And Approaches In Intellectual Property Research, Irene Calboli, Maria Lillà Montagnani

Faculty Scholarship

The relevance of Intellectual Property (IP) Law in our society has increased dramatically over the last several years. Globalization, digitization, and the rise of post-industrial information-based industries have all contributed to a new prominence of IP Law as one of the most important factors in driving innovation and economic development. At the same time, the significant expansion of IP rules has impacted many areas of public policy such as public health, the environment, biodiversity, agriculture, and information, in an unprecedented manner. No longer relegated to a cohort of few specialized experts, IP Law is now at the front and centre …

Teaching Civil Obligations (Or What I Learned About Law, Legal Thinking And Teaching), Alan Hutchinson Jun 2021

Teaching Civil Obligations (Or What I Learned About Law, Legal Thinking And Teaching), Alan Hutchinson

Dalhousie Law Journal

In most of my decades-long teaching and professorial career, I primarily taught Torts, but never Contracts. However, last year, I agreed to teach jointly a postgraduate class of 35 students on “Civil Obligations.” It was a decision that conformed to one of the more unsettling tropes of my life— “act in haste, repent at leisure.” My role in this arrangement was, after a general opening about the nature of civil obligations and the interface of Contract and Tort, to assume responsibility for the Contracts component of the course. This presented itself as a considerable task, but I thought that it …

Law School In A Pandemic: Student Perspectives On Distance Learning And Lessons For The Future, Gallup, Accesslex Institute Jun 2021

Law School In A Pandemic: Student Perspectives On Distance Learning And Lessons For The Future, Gallup, Accesslex Institute

Commissioned Research

When COVID-19 forced colleges and universities across the United States to send their students home and transition to a distance learning model for the duration of the Spring 2020 term, many faculty and staff had only the time afforded by an extended spring break to shift their curricula to online courses. But even if these faculty were given a full two weeks to prepare, that window would have been just a fraction of the four to six months some universities suggest dedicating to the development of a fully online course — to say nothing of the impact the pandemic may …

Critique-Inspired Pedagogies In Canadian Criminal Law Casebooks: Challenging "Doctrine First, Critique Second" Approaches To First-Year Law Teaching, Sarah-Jane Nussbaum Jun 2021

Critique-Inspired Pedagogies In Canadian Criminal Law Casebooks: Challenging "Doctrine First, Critique Second" Approaches To First-Year Law Teaching, Sarah-Jane Nussbaum

Dalhousie Law Journal

This article is a critical evaluation of Canadian criminal law casebooks. The author explores the aims, practices, and challenges of these teaching texts by examining their relationship to critique-inspired pedagogical methods. A number of English-language Canadian criminal law casebooks add a welcome feature to the Canadian common law teaching landscape: all but one of six recently published casebooks teach doctrine and critique together. The research builds on an emerging scholarship of Canadian legal education by demonstrating evidence of critical political commitments and critique-inspired teaching methods within Canadian criminal law education. Yet casebook editors and other professors who utilize critical methods …

Understanding The Nuances: Diversity Among Asian American Pacific Islanders, Vinay Harpalani May 2021

Understanding The Nuances: Diversity Among Asian American Pacific Islanders, Vinay Harpalani

Faculty Scholarship

Asian American Pacific Islander (AAPI) Heritage Month recognizes the collective contributions of all AAPIs, but it is also an opportunity to move beyond the collective and highlight the nuanced differences between various AAPI groups. Lumping together all of these groups, without appreciation for their unique histories, experiences, and challenges, can obscure important differences, which in turn reinforces stereotypes. For example, although the “model minority” stereotype depicts AAPIs as high academic achievers from relatively privileged socioeconomic backgrounds, this is only accurate for a subset of the AAPI population. Higher education institutions in particular should highlight the vast diversity among AAPIs, as …

Radical Imagination: Fostering Community In Legal Education, Adrienne Baker May 2021

Radical Imagination: Fostering Community In Legal Education, Adrienne Baker

Student Scholarship

Study after study alerts us to concerns about law student wellbeing. Statistics are staggering, and law students are more likely to become anxious, depressed, and turn to substance abuse. Self-care is framed as an antidote, but the individual responsibility is still placed on the student. Rather, the issue is better resolved upstream.

Law schools must transgress and transform; they must reimagine their function. This article reflects on law school pedagogy and simple ways to build community in the classroom as well as school-wide administrative suggestions to promote law student wellbeing.

The Soft-Shoe And Shuffle Of Law School Hiring Committee Practices, Carliss N. Chatman, Najarian R. Peters May 2021

The Soft-Shoe And Shuffle Of Law School Hiring Committee Practices, Carliss N. Chatman, Najarian R. Peters

Scholarly Articles

It is in the spirit of Ida B. Wells that we seek to turn the light upon the systemic racism of hiring practices. We believe these practices are indicators of the systemic failures on campuses and in workplaces that prevent them from being antiracist. We seek to use this Essay as a “tool for exposing, analyzing, and challenging the majoritarian stories of racial privilege.”

Our specifc intention is to recognize the largely performative nature of claiming to be committed to an idea while substantively and concretely ensuring the opposite. This Essay is written with specific experiences, patterns, and practices in …
