Restoring Confidence In Educational Technologies, Ariel Newman Jan 2023

Restoring Confidence In Educational Technologies, Ariel Newman

Faculty Works

This article explores how adaptable digital learning tools, originally designed for K-12 education, can enhance engagement and comprehension in law school classrooms. In response to lingering skepticism toward educational technology following the pandemic, the article advocates for a strategic approach that integrates interactive and student-centered methods rather than reverting entirely to traditional instruction. Newman emphasizes the importance of leveraging digital tools that align with the learning preferences of Generation Z students, fostering more dynamic and effective legal education. By rethinking how technology is used in law schools, educators can create more engaging and responsive learning environments that better prepare students …

Legal Reasoning Case Files, 2nd Ed. (2023), Kris Franklin Jan 2023

Legal Reasoning Case Files, 2nd Ed. (2023), Kris Franklin

Books

This text provides real-world case files designed to reinforce foundational legal reasoning skills. Students work through practical problems, each of which is set in the context of a different basic law school subject. Commentary throughout the text guides students toward more sophisticated comprehension of the factual and legal materials, and more nuanced legal analysis, all while introducing common forms of practice-based writing.

Each chapter then takes the rules introduced in the case file and illustrates ways they might be applied to an essay examination question and multiple-choice question. Additional practice questions and suggestions for classroom exercises are included in the …

The History Of Religious Hiring At American Catholic Law Schools, John M. Breen, Lee J. Strang Jan 2023

The History Of Religious Hiring At American Catholic Law Schools, John M. Breen, Lee J. Strang

Faculty Publications & Other Works

A mission-driven institution requires personnel who are competent for the realization of the mission. The following article examines the practice of Catholic law schools hiring Catholics as law professors throughout the over 150-year history of Catholic legal education in the United States. The history shows that Catholic law schools alternately sought to hire Catholics as law professors or to hire individuals without regard to their religious affiliation as these schools’ self-understanding of mission changed over time.

Race And Entrepreneurship: Reclaiming Narratives, Priya Baskaran, Alicia E. Plerhoples Jan 2023

Race And Entrepreneurship: Reclaiming Narratives, Priya Baskaran, Alicia E. Plerhoples

Georgetown Law Faculty Publications and Other Works

This essay makes the case for engaging in counter-narratives and inclusive storytelling within the transactional clinic curriculum. The authors leverage lessons from Critical Race Theory to amplify the voices and experiences of underrepresented entrepreneurs and marginalized communities in both clinic seminar and selected casework. In doing so, we challenge hegemonic narratives of entrepreneurship and expose our law students to the presence and impact of interlocking systems of subordination that minimize the existence and contributions of entrepreneurs of color. We challenge our law students and ourselves to become more creative and thoughtful lawyers to a more inclusive and diverse set of …

Stop The Count; The Historically Discriminatory Nature Of The Bar Exam Requires Adjustments In How Bar Passage Rates Are Reported, If At All, Nachman Gutowski Jan 2023

Stop The Count; The Historically Discriminatory Nature Of The Bar Exam Requires Adjustments In How Bar Passage Rates Are Reported, If At All, Nachman Gutowski

Scholarly Works

Despite its ugly history and persistent disparate impact on racial and minority groups, the Bar Exam is still a required step for (nearly) every jurisdiction in a law school graduate’s quest to become an attorney. Deficiencies abound in the exam’s inability to effectively evaluate the minimum competency of what newly minted attorneys should possess. It is left to the local jurisdiction to collect, analyze, and determine what mode to release and calculate results. There has been a recent shift in focus, and change of scope, in the American Bar Association Ultimate Bar Passage, Standard 316. Nevertheless, the local authorities provide …

Beyond Response: Reimagining The Legal Academy's Role In Disaster Recovery And Preparedness, Latisha Nixon-Jones

Scholarly Works

This Article proposes expanding the legal academy's role in responding to disasters and emergencies, specifically through creating disaster clinics that take a community-based lawyering approach. The Article is one of the first to identify the need for community-based disaster legal clinical education that goes beyond the immediate response phase. It also proposes creating a disaster legal pipeline from the clinic through post-graduation employment. The Article furthers the literature's discussion of the need for sustained disaster legal education. As the global pandemic caused by COVID-19 coronavirus continues to impact vulnerable populations and the frequency of natural disasters continues to increase, this …

Nestlé V. Doe: A Death Knell To Corporate Human Rights Accountability?, Phillip Ayers Jan 2023

Nestlé V. Doe: A Death Knell To Corporate Human Rights Accountability?, Phillip Ayers

Seattle University Law Review

The Supreme Court in Nestlé v. Doe held that foreign plaintiffs who claimed to be victims of overseas tortious conduct by corporate defendants had no jurisdiction to sue in federal courts using the Alien Tort Statute. This Comment looks at the history of the Alien Tort Statute, from its inspiration, long dormancy, and recent reinvigoration beginning in the 1980s. The Comment then explores the background of Nestlé and its issues with child slavery in its cocoa supply chain. From there, the Comment analyzes the Nestlé v. Doe decision, and posits an alternative outcome. Finally, this Comment looks for a new …
