How Can The Internal Revenue Service Improve Its Alternative Dispute Resolution Programs To Deliver Better Benefits?, Armando Gonzalez
How Can The Internal Revenue Service Improve Its Alternative Dispute Resolution Programs To Deliver Better Benefits?, Armando Gonzalez
Cardozo Journal of Conflict Resolution (CJCR) Blog
Most individuals and businesses file their tax return(s) and forget about the Internal Revenue Service (“IRS”) until it’s time to repeat the process the following year. However, sometimes disputes may arise “when a taxpayer fails to agree with an IRS finding, refuses to file a tax return, or refuses to comply with an IRS request for information.” To address some of these disputes, the IRS offers six alternative dispute resolution (“ADR”) programs through its Independent Office of Appeals, where mediation is leveraged to avoid costly litigation and lengthy appeals.

The Future Of The Criminal Legal System: How Should A Multidoor Criminal Courthouse Operate?, Cardozo Journal Of Conflict Resolution
The Future Of The Criminal Legal System: How Should A Multidoor Criminal Courthouse Operate?, Cardozo Journal Of Conflict Resolution
2023 Event Invitations
As the push for criminal legal reform continues around the world and the impact of progressive prosecutors or bail reform is still being unpacked, the future of the criminal legal system is up for debate. Much like the creation of the multidoor civil courthouse—with options for negotiation, mediation, and other processes—what should a multidoor criminal courthouse look like in the future? How should evolving processes of restorative justice, problem solving courts, diversion sentencing, bail reform, and plea bargaining be structured and integrated in the future? What should the role of judges, prosecutors, defense attorneys, crime victims, defendants and the public …

From Maritime Pushbacks To Naval Blockade: How Europe Is Drowning In Legal Pitfalls, Martine Bjørnstad
Cardozo International & Comparative Law Review (CICLR) Blog
As if haunted by the past, the headlines are once again filled with cautionary tales of Europe’s unsecure borders and looming migration crisis. The arrival of 11,000 migrants on the Italian island of Lampedusa in early September, amidst deadlocked negotiations over the European Union’s New Pact on Migration and Asylum, has again sparked debate in Europe about how to tackle illegal immigration from North Africa. The proposed solution that has perhaps drawn the most attention is that of a naval blockade.

Law’S Sexual Infections, Kyle Kirkup
Law’S Sexual Infections, Kyle Kirkup
Dalhousie Law Journal
In 2019, the House of Commons Standing Committee on Justice and Human Rights published its study on the criminalization of HIV non-disclosure in Canada. The report recommended removing HIV non-disclosure from sexual assault laws in Canada. This constituted a welcome development for many HIV advocates. Yet other recommendations proved more controversial. In order to counter the exceptional targeting of HIV, the Committee proposed an offence for the non disclosure of all infectious diseases. This article uses the proposal to develop three arguments. First, the idea of creating an offence for all infectious diseases finds its origins in criminal laws dating …
Mixing Mathematics And Morality: Precarity And Moral Hazard In Employment Insurance And Personal Insolvency Law, Anna J. Lund
Mixing Mathematics And Morality: Precarity And Moral Hazard In Employment Insurance And Personal Insolvency Law, Anna J. Lund
Dalhousie Law Journal
This article examines how financially precarious Canadians face particular challenges to accessing the benefits of employment insurance and personal insolvency because these two systems include features designed to guard against moral hazard. However, these design features do not adequately account for how an increasing number of Canadians are precariously employed and precariously indebted. This article synthesizes the research on precarious employment in Canada, and uses it to suggest how one might conceptualize precarious indebtedness. It then traces how the Canadian employment insurance and personal insolvency systems treat characteristics of financial precarity as evidence of misconduct. As a result, precariously employed …

Symposium On A Pluralist Theory Of Constitutional Justice, Floersheimer Center For Constitutional Democracy
Symposium On A Pluralist Theory Of Constitutional Justice, Floersheimer Center For Constitutional Democracy
2023 Event Invitations
Illiberalism and populism challenge liberal constitutionalism and its nexus to distributive justice in its three dimensions of material welfare, identitarian recognition and democratic representation. A Pluralist Theory of Constitutional Justice by University Professor Michel Rosenfeld (Oxford University Press 2022) develops a pluralist approach leading to the “justice essentials” designed to meet the above challenge and to reinvigorate liberal constitutionalism.
