Teaching Bias In The Current Cultural Climate: Sample Exercises For A Legal Writing Class, Ben Fernandez

The American Bar Association now requires law schools to provide "education to law students on bias, cross-cultural competency, and racism." But how can a law professor navigate these challenges in the current cultural climate fraught with polarizing divisiveness? In this present-day charged atmosphere, law students may be particularly sensitive to statements they perceive as offensive and may seek accountability for such remarks. Implicit bias and micro-aggressions can reveal biases that are unconscious and unintentional. How then can a law professor make students feel comfortable discussing these important and relevant topics in class?

We administered a survey to law students at three Canadian law schools in the Atlantic region at the end of the Fall 2020 term. The survey asked students to compare their learning of each of the Federation of Law Societies of Canada (FLSC)-mandated competencies, as well as several others taken from the Law Society of New Brunswick (LSNB) competency profile, in the Fall 2020 (online) term versus previous terms of study. The survey also solicited testimonies on students’ socialization into the legal community during their unexpected online law school experience. There has been a big push to revamp legal education. Many have argued that after years of doing things the same way, it is time to change. While there is validity for the need for reform, educators should embrace the one thing legal education has gotten right: anonymous or blind grading. This Essay makes the case that blind grading should not only remain in legal education, but every law school course should adopt it, including writing and clinical courses. Only through blind grading can law schools better succeed in the ABA mandated goals of diversity, equity, and inclusion. Grades are …

At the 2023 Association of American Law Schools Tax Section meeting, professors discussed their impressions of a decline in the number of JD students studying tax. Their impressions were consistent with declines that have been documented in similar fields. Between 2011 and 2021, U.S. accounting programs saw an 18% drop in students, while new CPA candidates declined 39% from 2010 to 2022. In the United Kingdom, the number of law schools that teach tax has diminished by 43% since 2002. The Indonesian Journal of Socio-Legal Studies
While customary law typically is not the sole legal system regulating people's daily lives, it still plays a big role in shaping the behavior of countless individuals worldwide. For this reason, law schools in many countries teach customary law courses, but these courses often present customary law as a sterile set of principles and norms detached from studying social reality. This approach associates customary law with traditional communities whose members live in relative isolation from the world, ignoring the fact that customary law operates in a legally pluralistic universe, interacting with religious and state law systems, and that it adapts …

One of the places I find the most joy in teaching legal writing is problem development—writing compelling factual scenarios that give students interesting legal issues to work through is rewarding and fun. The best prompts will motivate students to really jump into their role representing their client and encourage them to think about the “big picture”—how the law ties into social, political, and economic structures in society at large. The gig economy consists of individuals, known as gig workers, who perform on-demand labor through digital platforms, such as apps or websites. This structure provides gig workers flexible employment opportunities and autonomy over their hours. However, employers often incorrectly label gig workers as independent contractors, allowing employers to avoid paying federal and state taxes while also withholding worker protections typically required by federal law. Mislabeling gig workers persists due to the lack of state regulations defining the scope of employment relationships in the emerging gig industry, and the enforcement of arbitration clauses between workers and employers hinders the enactment of …

Since its establishment under Law Number 2 of 2009 concerning The Indonesian Export Financing Institution (LPEI), the Indonesian Export Financing Institution has gained additional capital participation nine times between 2010 and 2021 by the passage of government regulations. The rules for extra capital in the legislation on its establishment only take the form of regulations in the event that the capital of the Indonesian Export Financing Institution is decreased by a particular amount, but the additional capital that has been carried out thus far is not meant to replace the capital deficiency. For over five years, United Airlines (“United”) flight attendants, represented by their union, the Association of Flight Attendants (“AFA-UA”), have faced stalled contract negotiations with United management. The AFA-UA is calling for wage increases and improved schedule flexibility. The starting pay rate for a United flight attendant maxes out at about $25,992 per year, and some employees have to rely on food stamps and alternative housing options because they cannot afford to pay rent. Unwilling to work under these conditions any longer, the AFA-UA voted 99.99% in favor to authorize a strike on August 24, 2024.

The United States “cannot be both the world’s leading champion of peace and the world’s leading supplier of weapons of war”. The United States Conventional Arms Transfer (“CAT”) Policy establishes the executive branch’s priorities and reasoning for the export of conventional arms to other nations. At its inception in 1979, CAT Policy was a “policy of self-imposed restraint” with regards to arm sales and transfers to any nation. It has since evolved, with each subsequent administration having its own view of the role the United States should play in championing peace. In early September, the Kathryn O. Greenberg Immigration Justice Clinic (IJC) released Held Incommunicado: The Failed Promise of Language Access in Immigration Detention, the first report of its kind, focusing on how language access was denied to those who have limited English proficiency being held in U.S. Immigration and Customs Enforcement (ICE) detention facilities. The denial of language access the report uncovered includes multiple instances of ICE not providing translators and interpreters, impeding detained peoples' ability to request medical care and legal assistance, and demonstrates that the agency failed to meet its own guidelines.
