Cases On Procedure, Annotated. Code Pleading, Edson R. Sunderland Jan 1913

Cases On Procedure, Annotated. Code Pleading, Edson R. Sunderland

Books

“In the present volume on Code Pleading, the editor has aimed to present the subject, in all of its more important features, as a complete working system of pleading. The code has frequently been treated as the mere ‘antithesis’ of common law pleading, and this has resulted in throwing the subject completely out of balance by unreasonably extending the discussion of those elements which are ‘characteristic’ of the code, while unduly restricting or entirely ignoring those principles which the code shares with the common law….

“The student should be able to obtain a clear conception of the system as a …

The Department Of Law And The State, Henry M. Bates

Articles

We are living in a period of extraordinary unrest. The spirit of criticism is prevalent, and no belief or creed, no institution is exempt from this questioning spirit of the time. Among social institutions perhaps none is being more relentlessly subjected to attack than the law as administered in our courts and practiced by our lawyers. It is true that much of the criticism leveled at legal institutions is unreasonable and is based upon ignorance or prejudice, but there remains a residuum of complaint which is well founded. In the very nature of things law and its administration always have …

The Teaching Of Practice And Procedure In Law Schools, Edson R. Sunderland Jan 1913

The Teaching Of Practice And Procedure In Law Schools, Edson R. Sunderland

Articles

Procedure is merely the means of co-ordinating effort, of harmonizing differences, of offering every one equality of opportunity in offense and defense before the law. Without it there would be confusion, favoritism, and injustice. If the subject were viewed in this fundamental way, and were studied conscientiously as an incident and aid to the development and determination of the merits of controversies, the criticisms now so fiercely directed against it would largely disappear. In its use it is indispensable, in its abuse only does it cause trouble. A professional conscience to curb that abuse, and professional learning and skill to …

The present volume is intended to develop and disclose the rational basis for the main principles of practice employed in the trial of civil actions at law. By this means it is hoped that the book will help the student to analyze and understand the methods by which courts solve problem of practice, to appreciate the comparative value, importance and bearing of the different …

The Art Of Legal Practice, Edson R. Sunderland Jan 1912

The Art Of Legal Practice, Edson R. Sunderland

Articles

In one respect the law is the most perplexing subject with which a man can deal. It shifts and changes so rapidly that only a nimble and diligent student can keep abreast of it. One is likely to wake up any morning and find that the legislature has repealed a good part of what he knows, and he is in constant danger of having his most carefully formed opinions completely upset by a new decision of the Supreme Court. These violent changes are not due to any new discoveries, such as constantly enliven the scientific world, but merely to the …

The Four Year Course In The Department Of Law, Henry M. Bates

This, in effect, provides that every student in the Law Department from now on shall have had at least one year in the Literary Department, or its equivalent elsewhere, and places the course of the Law Department practically upon the four year basis of the other schools in the University.

The Law And Its Study, William J. Hoynes Jan 1912

The Law And Its Study, William J. Hoynes

Journal Articles

The author seeks to give a sweeping discussion the study of law starting with the primitive sources of law and how laws and governance has developed among the great societies of old. Here, the author asserts that these societies studied the power of nature from which they developed their own laws or cultivated a conception natural law. Such societies mentioned are those from which we consider the foundations of legal form and jurisprudence; Babylon, ancient Israel, Egypt, classical Greece and Rome. Then the author offers a brief analysis of the nature of modern legal education, describing the practical and cultural …

A New Development In Legal Education, Charles M. Hepburn Jan 1911

A New Development In Legal Education, Charles M. Hepburn

Charles Hepburn (1918-1925)

The inauguration of the American Institute of Law promises a very important advance into new fields of legal education. The movement was started some months ago by the American Law Book Company. Encouraged by the success of its Cyclopedia of Law and Procedure, which is largely the work of law school teachers, the American Law Book Company has taken the initiative in moving for the establishment of a high grade institution for legal education In its widest relations, to be organized by, and conducted under, the control of law school men and active practitioners interested in the cause of legal …
