The English Court of Appeal in Beximco v. Shamil Bank chose to apply only English law in a breach of contract case, even though the choice of law clause in the contract at issue also selected Islamic law. The court cited three main reasons for this decision. First, article 3(1) of the Rome I Convention “contemplates” that a contract can be governed only by the “law of a country,” and there is no mention of the application of a “non-national system of law such as Sharia law.” Second, Islamic law does not consist of “principles of law” but instead a …

The music of female characters in the great masterpieces of opera often demonstrates resistance to and undermines the abuse they have historically received in opera plots. The Mexican folktale that my opera, The Tragedy of La Llorona, draws inspiration from plays on many of the same tropes historically found in female characters in opera including madness, sexuality, and lack of agency. This Special Issue of Philosophies is devoted to dialogue between feminist care ethics and mainstream philosophical figures and concepts. As care ethics has evolved from its origins in the 1980s, it is clear that it does not always fit neatly within traditional philosophical categories. Yet, the philosophical implications of the ethics of care are robust and extend beyond ethics as such, with care theorists positing ontological, epistemological, and political significance to its approach. In this article, we describe a project in which philosophy, in combination with methods drawn from mental modeling, was used to structure dialogue among stakeholders in a region-scale climate adaptation process. The case study we discuss synthesizes the Toolbox dialogue method, a philosophically grounded approach to enhancing communication and collaboration in complex research and practice, with a mental modeling approach rooted in risk analysis, assessment, and communication to structure conversations among non-academic stakeholders who have a common interest in planning for a sustainable future. UNLV Composer Dr. Jennifer Bellor collaborated with Christine Banna, animator from the Rochester Institute of Animation to create ONEIRA, a sci-fi animation music video Christine Banna created to pair with Jennifer Bellor’s composition, Oneira. Written for the electronic MalletKAT, vibraphone, and two marimbas, and recorded by the percussion quartet, Clocks in Motion, this 11-minute work is inspired by virtual worlds and dreaming. This track is also featured on Bellor’s most recent album, also titled ONEIRA, which was released by Aerocade Music August 19, 2022.

This study seeks to analyze the optical performance of power in three of Shakespeare’s plays: Richard II, Julius Caesar, and Macbeth. Using a political framework via Kantorowicz’s King’s Two Bodies and Maus’s Inwardness and Theater in the English Renaissance, this paper explores the interior and exterior personas as they pertain and interact with public and private spaces. This paper will track Shakespeare’s contribution to this developing “modern” shift in the understanding of appearance and its role in the presentations of power in these three plays. In this paper, I seek to highlight the benefits and necessity of reframing our critical approach to ecopoetry. In order to do so, I attempt to define “ecopoetry,” as well as terms like “nonhuman animal” and “anthropocentrism.” Historically, critics have routinely romanticized the nonhuman natural world, rendering it something two-dimensional, like a painting or landscape, rather than an encompassing environment. As a result, critics have often failed to consider the legitimacy of the animals who populate the nonhuman natural world. Instead, these animals are typically romanticized and metaphorized, ultimately furthering anthropocentric hierarchies and distancing us from them. When anthropocentric thought …

This study is an examination of white hegemonic masculinity and its effect on tyrannized black male figures in Toni Morrison’s Beloved . These disenfranchised figures suffered psychological trauma through the perpetuation of marginalized and subordinate masculinities within the “blues epistemological” apparatus by means of self-realization. Blues epistemology is a term that Clyde Woods describes as “a longstanding African American tradition of explaining reality and change. This form of explanation finds its origins in the processes of African American cultural construction within, and resistance to, the antebellum plantation regime” (25). It is widely theorized that the advent of the “Anthropocene Age” (under this or any other name) is bringing one form of human temporality to an end while it initiates another (Simon 2021). Spain has been the global leader in organ donation and transplantation since 1992, an achievement that has become a source of national pride, in a country where national symbols are heavily contested. In this dissertation I examine the changing meanings that organ donation and transplantation have acquired in contemporary Spain, focusing specifically on their implications for different aspects of Spanish nationalism. To do so, I employ a modified version computational grounded theory, a mixed-methods approach that combines topic modeling with interpretive analysis, to identify and interpret the narratives around organ donation and transplantation circulated by the Spanish press between 1954 …

This dissertation consists of retranslations of three essays by Walter Benjamin: “On the Program of the Coming Philosophy,” “The Task of the Translator” and “La traduction—le pour et le contre.” Each section and interlinear retranslation-commentary builds on the previous, moving from 1) Benjamin’s “transcendental yet speculative” philosophical foundation for experience, to 2) the importance of a performative Darstellung [performative presentation] which places criticism/philosophy/translation between science and poetry, 3) the conception of translation for Benjamin in 1923 within the frame of said philosophy and Darstellung, juxtaposed with his conception of translation in 1936, after his materialist aesthetic turn. Background: The Ancient Mesopotamian civilization, the earliest known, emerged in the fourth millennium BCE. While the advent of medicine is established, there is little understanding of surgery's origins. We sought to describe the characteristics and medical acumen of the surgeons of the first civilization.
Methods: Source documents and commentary on Mesopotamian medicine were systematically analyzed for evidence of surgery and physician descriptions.
Results: Early tablets reveal evidence of the incisional drainage of a scalp abscess and empyema, advanced wound care, fracture alignment, and possible caesarians without evidence of wound suturing, emergency procedures, trephination, or circumcision. While the asû and āšipu …

In this original essay, we tāvāistically critique Tongan language, generally, and Tongan lea tafe/heke language drift/shift, specifically. We examine our subject matter of exploration within and across Tāvāism as a general philosophy of reality, in “time” and “space,” as both ontological and epistemological entities, identities, or tendencies. In “Structure: Lifeblood of the Lyric Essay,” Lesh Karan writes: “I had discovered a prose genre where the writer leans on form… to eloquently hold the inexpressible aboutness, to let meaning dance in the spaces between its juxtaposed parts.” The lyric essay engages us in a search for an elusive truth, and attempts to give definition to things that, while hanging heavy above us, may have been unclear until put to paper. In this essay, I argue that the presence of verse in a text initiates a mutually generative relationship between a text’s sonic and semantic qualities, and that critics’ tendency to praise great prose passages as “poetic” is a result of poetry’s historical connection to verse and the semantic elegance which said verse tends to inspire. I base this argument on Fredrich Nietzsche’s first book, The Birth of Tragedy, and explore, through it, various examples of prosimetrum - that is, works combining poetry and prose.

Throughout history, women have been overlooked, discounted, and ignored for their skills and abilities as competitive and professional athletes. Competitive shooting sports were popular in the United States; however, men excluded women from participating in many of these activities until the early 19th century, when America saw the rise of famous markswomen such as Annie Oakley, Calamity Jane, and Lillian Smith. These women challenged the masculinity of the sport of shooting and bested many of their male counterparts as they traveled and performed across the United States. Costumes are a crucial element in the representation of historical figures. Beyond reflecting aesthetic trends, clothing is closely intertwined with culture, economics, and the personal history of the individual who wore them. Fabric simulation allows for the digital creation and animation of garments too fragile or incomplete to be used directly in film or education. This thesis demonstrates the digital reconstruction of the clothing worn by H. L. Hunley crew member James Wicks. The H. L. Hunley is a submarine from the Civil War. This project focused on a watercolor from the mid- nineteenth century referred to as [Sailboats and Windmill] by Edward Tucker. The research concentrated on the popularity of watercolors in Britain in the 18th and 19th century along with the techniques and materials developed around this time. Visual examination along with multi-modal imaging techniques and scientific analysis utilizing X-ray fluorescence and Micro-Attenuated Total Reflection Fourier Spectroscopy aided understanding and identification of materials.

During the turbulent decades of the early twentieth century, women participated increasingly in the fight for Irish independence, with this level of participation increasing significantly following the 1913 Dublin Lockout, a labor strike which lasted about five months from late summer of 1913 into the early weeks of 1914. Though this was not a nationalist demonstration, many of the participants, both men and women, were also members of various nationalist organizations and would later go on to participate in the various nationalist uprisings in the following years. African Americans experience higher mortality from lung cancer and other smoking-related diseases than Caucasian Americans (Kochanek et al., 2016) despite engaging in cigarette and e-cigarette use significantly less or at comparable rates to other racial groups (CDC, 2015; Schoeborn, 2013). During adolescence, smoking prevalence is lower among African Americans than Caucasian Americans, but there is a “cross-over effect” whereby smoking rates become similar later in adulthood (Belgrave et al, 2010). The mechanisms driving this effect are poorly understood. The purpose of this thesis is to investigate slasher films and how they use gendered tropes to respond to and perpetuate cultural anxieties. The methodology primarily uses textual analysis that includes close attention to content, context, and discourse. The study reveals structural patterns and problems that emerge within slasher films, specifically within the Final Girl trope and the behaviors that govern it. In surveilling the Final Girl’s gender performativity, it is apparent that abjection, or a gut reaction to something that exists between two distinct boundaries or categories, is provoked when the Final Girl crosses a socially established gender boundary. …

The purpose of this study was to learn how music educators create inclusivity in their classroom and how to better do that without potentially alienating the students with disabilities. For this study, inclusivity is defined as providing an equal opportunity for participation and education in the classroom. It is also to bring more awareness to disabilities and how they can and should be managed in the classroom. The goal for this study is to aid in informing educators on how to enable students with disabilities to be included without feeling alienated or having undue attention drawn to them.

In Justin Maxwell's theatrical works, the stasis and stagnation of central characters are importantly made materially evident through costuming. For instance, in the play, Marie Antoinette's Head, the stagnation of civilization and society is explored while time zigzags over two thousand years. The movement of time and epochs is told through a colorful array of costumes, also indicating the growth and evolution of characters in each period. The protagonist, Leonardo, however, remains stuck in 1793. In another of Maxwell's works, the one-man, one-act play Exhausted Paint, the painter Vincent Van Gogh experiences a similar inert characterization. In both …
