Qualified Mortgages & Government Reverse Redlining: How The Cfpb's Qualified Mortgage Regulations Will Handicap The Availability Of Credit To Minority Borrowers, Patrick T. O'Keefe

Fordham Journal of Corporate & Financial Law

Imprudent underwriting and mortgage origination in the years leading up to the Global Financial Crisis of 2007 and 2008 was determined to be one of its predominant causes. As a result, partly in an effort to protect consumers and ensure that lending institutions did not relapse into poor mortgage origination practices, Congress passed the Dodd-Frank Wall Street Reform and Consumer Protection Act. This Note examines the qualified mortgage rule promulgated by the Consumer Financial Protection Bureau pursuant to the Dodd-Frank Act. This rule is intended to ensure that borrowers receive loans that are not unfair, deceptive, or abusive, and to …

All The World Is Shining, And Love Is Smiling Through All Things: The Collapse Of The "Two Ways" In 'The Tree Of Life', Vernon W. Cisney

Philosophy Faculty Publications

Chapter Summary: From the blackness emerges a subtly scripted epigraph from the biblical book of Job, silently posing a question to the viewer on behalf of the almighty: "Where were you when I laid the earth's foundation...while the morning stars sang together and all the sons of God shouted for joy?" Following thirty-five chapters of Job's story, filled with relentless criticism on the part of Job's "friends" in response to Job's ongoing poetically formulated and impassioned lamentations, and the demands he places before God - demands for justice and an explanation for his suffering - at last the voice of …

Geologic History Of West Virginia, John J. Renton, Thomas Repine Jan 2016

Geologic History Of West Virginia, John J. Renton, Thomas Repine

Readings and Notes

The exposed rocks and those that underlie the surface of West Virginia record approximately 300M years of Earth history. This may sound like a very long period of time, but in reality, it only represents about 7% of the total age of Eai1h. Before we undertake a discussion of the geologic history of West Virginia, there are some basic topics we should review in order to fully appreciate what will follow. To that end, the following topics will be discussed: 1) The Origin of Earth, 2) The Response of Rocks to Stress, 3) Some Basic Characteristics of Sedimentary Rocks, 4) …

Images Of History: Kant, Benjamin, Freedom, And The Human Subject, Richard Thomas Eldridge Jan 2016

Images Of History: Kant, Benjamin, Freedom, And The Human Subject, Richard Thomas Eldridge

Philosophy Faculty Works

Developing work in the theories of action and explanation, Eldridge argues that moral and political philosophers require accounts of what is historically possible, while historians require rough philosophical understandings of ideals that merit reasonable endorsement. Both Immanuel Kant and Walter Benjamin recognize this fact. Each sees a special place for religious consciousness and critical practice in the articulation and revision of ideals that are to have cultural effect, but they differ sharply in the forms of religious-philosophical understanding, cultural criticism, and political practice that they favor. Kant defends a liberal, reformist, Protestant stance, emphasizing the importance of liberty, individual rights, …

The Abrahamic Pilgrimage Story In Sermons: An Ontological-Narrative Foundation Of Asian American Life In Faith, Sunggu Yang Jan 2016

The Abrahamic Pilgrimage Story In Sermons: An Ontological-Narrative Foundation Of Asian American Life In Faith, Sunggu Yang

Faculty Publications - George Fox School of Theology

Sang Hyun Lee and many other Asian American scholars have found that the Abrahamic pilgrimage story has been an ontological-narrative backbone of Asian American faith constructs. This article further explores their previous research by suggesting three distinct theological narrative styles of the given Abrahamic pilgrimage saga: the allegorical- typological narrative style, the illustrative narrative style, and the eschatologicalsymbolic narrative style. However, though distinct, the styles are closely associated with one another. I will show sermon excerpts by Asian American preachers that are good examples of the theological-spiritual embodiment of the three styles.

Eternal Goods (Chapter Five Of Discerning The Good In The Letters And Sermons Of Augustine), Joseph Clair Jan 2016

Eternal Goods (Chapter Five Of Discerning The Good In The Letters And Sermons Of Augustine), Joseph Clair

Faculty Publications - George Fox School of Theology

For Augustine, eternal goods are the virtues and goods of genuine friendship as they will exist in eternity—as the full expression of love for God and neighbor-love. This chapter considers such goods in their plurality and temporality. That is, it treats them as human beings are able to comprehend and pursue them—and sometimes even obtain and experience them—in this life. To do so, this chapter revisits Augustine’s letters to Ecdicia and Macedonius to take a closer look at where each succeeded and failed in their pursuit of higher, eternal goods. Augustine’s vision of obtaining eternal goods involves a process in …

Book Review: Come Back By Rudy Wiebe, Melanie Springer Mock Jan 2016

Book Review: Come Back By Rudy Wiebe, Melanie Springer Mock

Faculty Publications - Department of English

Excerpt: "Come Back is a beautifully written novel, manifesting Wiebe's immense skill with the written word. Those unfamiliar with Wiebe's style might find Come Back a more difficult read; the lack of a straightforward narrative and the intertwining of various voices may cause too much dissonance for some readers. Yet, as a two time winner of Canada's Governor General's Award (in 1973 and 1994), Wiebe clearly understands his craft, and his place in English letters has already been well established. Come Back adds to his esteem as perhaps the preeminent voice in Mennonite literature. The heartbreaking struggle of Hal …

Buddhism In Korean Film During The Roh Regime (1988-1993), Ronald S. Green Jan 2016

Buddhism In Korean Film During The Roh Regime (1988-1993), Ronald S. Green

Philosophy and Religious Studies

This article outlines and critically discusses South Korean Buddhist films made during the time of the Roh Tae-woo government (1988-1993), which can be called a semi-democratic and semi-dictatorial regime. This was a period of transition in film policy from the censorship of the earlier dictatorial regimes to the freedom of expression offered to directors by the later democratic administrations, unprecedented in Korean film history. During this period the technical skill of directors improved bringing about a corresponding improvement in the quality of Korean Buddhist films and thus international attention. Although the government allowed filmmakers considerably more freedom to express ideas …

Macro Self-Portraiture And The Feminine Grotesque, Emily C. Wages Jan 2016

Macro Self-Portraiture And The Feminine Grotesque, Emily C. Wages

Scripps Senior Theses

According to the Mirriam-Webster online dictionary, “grotesque” is defined as “a style of decorative art characterized by fanciful or fantastic human and animal forms often interwoven with foliage or similar figures that may distort the natural into absurdity, ugliness, or caricature.” Originating from the Old Italian grottesca, cave painting, feminine of grottesco of a cave, from the time of its conception, the grotesque has been inexorably linked to art and the female. The work of other female artists that explore themes of the feminine grotesque are discussed, including Katheryn Wakeman, Jenny Saville, and Maria Lassnig. In my current work, I …

Foucault Against Ethics: Subjectivity And Critique After Humanism, Patrick Gamez Jan 2016

Foucault Against Ethics: Subjectivity And Critique After Humanism, Patrick Gamez

Arts, Languages and Philosophy Faculty Research & Creative Works

This dissertation is in the first place an interpretation of the thought of Michel Foucault. Beyond interpretation, it also makes provides a qualified defense of his views on the significance of ethical theory, particularly in its “critical” forms, the shape of the space of reasons, and the role of subjectivity within it.

I take as my starting point an orthodox view of Foucault’s work, namely, that it can divided in terms of its content into three distinct periods. First, an “archaeological” phase spanning most of the 1960s. Second, a “genealogical” devoted to unearthing power-relations beneath purportedly progressive institutions. Finally, an …

Inroads To Outrounds: A Hofstedian Approach To Newcomer Integration Into The Culture Of Forensics, Chad Kuyper Jan 2016

Inroads To Outrounds: A Hofstedian Approach To Newcomer Integration Into The Culture Of Forensics, Chad Kuyper

National Forensic Journal

This study examines how newcomers to forensic competition in intercollegiate forensics integrate themselves into the larger community of competitors. Specifically, this study takes an intercultural approach and frames the forensic organization as a culture unto itself into which new arrivals must assimilate. To shed further light on this culture, this study determines where members of “forensic culture” are positioned on Hofstede’s cultural spectra. By modifying Hofstede’s original Values Module Survey and administering it to current competitors from around the country, insight can be gleaned into the cultural attitudes of the forensic organization, and the values that guide the practice of …

At The Creation: Seven Letters From Grenfell, 1897, James G. Keenan Jan 2016

At The Creation: Seven Letters From Grenfell, 1897, James G. Keenan

Classical Studies: Faculty Publications and Other Works

Probably the most famous single season for the excavation of papyri in Egypt was the one that took place in the winter of 1896-1897, under the direction of Bernard P. Grenfell (1869-1926) with the assistance of Arthur S. Hunt (1871-1934) at the ancient city of Oxyrhynchus, present-day al-Bahnasaų. The site fell within the geographical limits of the permit granted by the Antiquities Service to W.M.F. (Flinders) Petrie, but when it proved disappointing in its prehistoric and pharaonic remains, Petrie left it to Grenfell, who was there with Hunt in search of papyri, especially Christian and literary papyri in Greek1 . …
