“This Artwork Is Always On Sale”: The Need For A U.S. Resale Royalty Right For Digital Visual Artists In This Technological Age, And Proof Of Concept Through The Blockchain And Nfts Explosion, Janae Camacho
Washington Journal of Law, Technology & Arts
With the explosion of the internet, social media, non-fungible tokens (“NFTs”), and blockchain technology, there has been a shift in how people consume and commercialize art, thus resulting in the increased use of digital visual mediums to create, purchase, and receive payment for visual artwork. This increase has renewed the question of whether the United States should implement a resale royalty right for visual work artists. This question is of concern, especially in this digital age where it has become more difficult for digital visual artists to receive equitable compensation for their work, like that of their musical and written …

‘Can You See What I See?’: An Art Project Promoting Living Well With Dementia, Jennifer K. Fortuna
The Open Journal of Occupational Therapy
Caroline Hyland, an illustrator and former occupational therapist based in Dublin, Ireland, provided the cover art for the Winter 2023 edition of The Open Journal of Occupational Therapy (OJOT). “Can You See What I See?” is an acrylic painting on black textured paper. The piece was inspired by Caroline’s grandmother Kathleen Duhig, her love of flowers, and the song “The Dutchman.” Kathleen and three of her sisters lived with dementia. This painting, and several others, are featured in a book Caroline wrote to support living well with dementia. By combining her artistic talents and training as an occupational therapist, Caroline …
Mindful Artmaking In Elementary Classrooms: A Path To Emotional Regulation, Christine Gober
Mindful Artmaking In Elementary Classrooms: A Path To Emotional Regulation, Christine Gober
Mindfulness Studies Theses
Abstract
In an era dominated by technological advancements and mounting external pressures, the emotional and mental well-being of the younger generation is a growing concern. This research paper explores the intricate relationship between mindfulness, art-making, and emotional regulation within the context of elementary classrooms. The modern world, filled with a plethora of stimuli, has escalated stress levels among individuals, especially children, leading to a surge in mental health issues. Mindfulness, deeply rooted in ancient traditions, teaches individuals to stay present, fostering a non-judgmental awareness of their thoughts and emotions. Art-making, on the other hand, serves as a medium for emotional …
Examining Ableism In Music Therapy Education And Clinical Training: Student And Educator Perspectives, Rebecca Warren
Examining Ableism In Music Therapy Education And Clinical Training: Student And Educator Perspectives, Rebecca Warren
Expressive Therapies Dissertations
Ableism is the discrimination against disabled people and favoring of nondisabled people. Ableism can pervade societal expectations, medical systems, educational systems, and culture. Within higher education, ableism can prevent disabled students from succeeding in programs with unique requirements, like music therapy. College music therapy programs combine aspects of music, psychology, and clinical training. While music therapy students frequently will work with disabled clients, there is a lack of consideration for disabled music therapy students and disabled music therapists. The purpose of this phenomenological study was to examine ableism in music therapy education and training. Participants completed a creative writing response …
Seeing And Unlearning Whiteness: A Mindfulness Workshop For Racial Justice, Emily Haranas
Seeing And Unlearning Whiteness: A Mindfulness Workshop For Racial Justice, Emily Haranas
Mindfulness Studies Theses
Racism is a deeply embedded, foundational aspect of American society. However, because the privilege of Whiteness insulates White individuals from the workings of systemic injustice and oppression and enables them to choose the conditions of their accountability in the movement for racial justice, many remain painfully blind to this fact. As such, there is a significant need for those who have been racialized White to develop a critical awareness of the powers and privileges ascribed to their racial identity. The working premise of this thesis is that mindfulness can assist White individuals in unlinking the socialized habits of mind that …

Unlocking Creativity In The Visual Arts: Using Mindfulness And Open Awareness Meditation To Access Creative Insight, Erin Gocinski
Mindfulness Studies Theses
An artist's creativity is a vital resource, so it is important to nourish this internal phenomenon and develop helpful techniques when they experience a creative block. Researchers have discovered that mindfulness and meditation positively affect artists' ability to access creative insight. The research reviewed in this rationale paper demonstrates beneficial experiences for artists who are trying to foster creativity or move beyond a creative block. After reviewing research, there were common threads linking the reasons for artists’ creative blocks and the positive impacts of mindfulness and meditation. The creative project is a handbook designed for artists and provides information, meditative …
Enhancing The Quality Of Life For Senior Citizens: A Facilitator’S Guidebook For Mindful Music And Movement, Shannon Sexton
Enhancing The Quality Of Life For Senior Citizens: A Facilitator’S Guidebook For Mindful Music And Movement, Shannon Sexton
Mindfulness Studies Theses
Music appreciation and enjoyment enhance well-being throughout the lifespan. The challenges and constraints that people experience as they age can lead to lack of access to music, decreased physical activity, and fewer avenues for creative expression. Group music and movement interventions created for older populations offer opportunities for social connection and improved quality of life. Mindful practices add further benefit when combined with these interventions. Current available programs are scarce and most often do not encompass mixed modalities. In addition, the benefits of these programs do not show long-term sustainability. The purpose of this thesis is to explore the effects …
The Influence Of The Abraham Accords On The Visual Coverage Of The Israeli-Palestinian Conflict In Arab Media: A Comparative Analysis, Mona Alsaba
Theses and Dissertations
This study examines the influence of the official signing of the Abraham Accords on the Arab media visual coverage of the Israeli-Palestinian conflict. This study operationalized visual frames in terms of the human-interest vs technical frame and peace vs war frame, and explored the use of graphic portrayal as a framing device, in order to compare between the Arab media visual framing of the Israeli-Palestinian conflict before and after the official signing of the Abraham Accords to examine the impact of foreign policy on the coverage among news outlets of different Arab countries. A comparative analysis was conducted relying on …
Nonobvious Design, Mark Bartholomew
Nonobvious Design, Mark Bartholomew
Journal Articles
To earn patent protection, a claimed product design must be “nonobvious.” Yet while nonobviousness has been described as “the heart” and “cornerstone” of the utility patent system, in the design patent context, the term has become next to useless. Instead of actually policing nonobviousness in design, modern courts grant patent rights to any work that is not an exact replica of another. The problem, judges maintain, is that comparing one visual design against another demands the use of aesthetic judgment and aesthetic judgment is an instinctual, subjective process incapable of legal definition. Recent neuroscientific studies of aesthetic judgment dispel some …
