Undignified: The Supreme Court, Racial Justice, And Dignity Claims, Darren L. Hutchinson

The Supreme Court has interpreted the Equal Protection Clause as a formal equality mandate. In response, legal scholars have advocated alternative conceptions of equality, such as antisubordination theory, that interpret equal protection in more substantive terms. Antisubordination theory would consider the social context in which race-based policies emerge and recognize material distinctions between policies intended to oppress racial minorities and those designed to ameliorate past and current racism. Antisubordination theory would also closely scrutinize facially neutral state action that systemically disadvantages vulnerable social groups. The Court has largely ignored these reform proposals. Modern Supreme Court rulings, however, have invoked the …

Over 14,000 unaccompanied children came from Cuba to the United States during Operation Pedro Pan. Once they arrived they were faced with an entirely new living situation and were forced to adapt. One of the remaining similarities to their Cuban home was the Catholic Church. The Church played a significant role in shaping these children’s fluid concept of their ethnic, national, and religious identities. Previous scholarship has not addressed the role of the Church in the program or the issue of the fluidity of identity among these children. This thesis revolves around Chicana lesbian feminist Gloria Anzaldúa and one of her more important theories, El Mundo Zurdo. El Mundo Zurdo was a theory that focused on the marginalized people and the need for unity amongst them; however, up to this point, no historical analysis has been done on this theory. The first Adventist missionaries made their way into Russia in the late 1880’s, where they experienced imprisonment, exile, and sometimes both. The scope of my thesis concerns the Seventh-Day Adventist Church and how Adventist missionaries and leaders endeavored on the Russian Mission. Using the writings, letters, and correspondence of these missionaries, as well as the myriad Adventist periodicals, I explain and analyze the evolution of the Mission from its inception to the end of the Second World War. This paper explores the deterioration of institutionalized mental health care by conducting a case study on the reasons why moral treatment methods declined in the Utica Lunatic Asylum, later renamed Utica State Hospital. The Utica State Hospital serves as a concrete example of how the general causes of decline in the United States varied among individual asylums. In the late nineteenth century, mental health care in the United States evolved from the personal, therapeutic environment that moral treatment promoted, to one of systematic abuse and neglect. The Wwi Middle East: Western Intervention And Modern-Day Political Conflict, Pauline Park

This paper analyzes three conflicting agreements made by the Allied powers between 1915 and 1917: the Husayn-McMahon correspondence, the Sykes-Picot arrangements, and the Balfour Declaration. It reveals the agreements as demonstrative of deeper patterns of political power and strategy in the Middle East that persist today. This paper moreover compares the Middle East with the European colonization of Rwanda in the 1880s, and how the nation's internal division was caused by external global powers seeking political and economic gain. This analysis seeks to connect global events as part of a wider political agenda propagated by Western powers.

One Dead Freedman: Everyday Racial Violence, Black Freedom, And American Citizenship, 1863-1871, Jacob Alan Glover

This dissertation is the first comprehensive study of “everyday” racial violence in the postbellum South. Taking as its focus the states of Louisiana and Kentucky, One Dead Freedman juxtaposes the practical enactment of black citizenship against daily racial terrorism by incorporating personal, familial, and community testimony left behind by African Americans who had a direct experience with such violence. Within this dissertation, the terminology of “everyday violence” is employed to differentiate the more mundane forms of white violence from the more spectacular forms of Reconstruction-era violence such as lynching, the Ku Klux Klan, and race riots. This dissertation traces the long-term evolution of the Inner Bluegrass region of central Kentucky with a focus on the period between the first Euro-American incursions into the area and the Civil War era. Utilizing an agroecological perspective that analyzes cultivated landscapes for their ecological features, it explores the ever-shifting mix of cultural and natural influences that shaped the local environment. Most prominently, it reveals the extent to which intertwined strands of capitalism and slavery mingled with biology to produce the celebrated Bluegrass agricultural system.

In most ways, The Mountain Eagle is an ordinary community oriented weekly newspaper, and indeed, a close examination of the paper will reveal that it focuses mostly on community news in Letcher County Kentucky, a small county in the mountains of eastern Kentucky. It carries holiday recipes, neighborhood news, and coverage of local government, school boards and sporting events. But a closer examination of the paper and its history reveals a different kind of community weekly. The existence of the Willowbrook State School was a culmination, of over a one-hundred-year history of Western society’s attempts to provide adequate care, and treatment for individuals with disabilities. The residents housed there, suffered violations of their human and civil rights in various forms of severe abuse, neglect, and violence. Following a three-year legal battle in 1975, as a result of the travesties that occurred, the legal doctrine known as the Willowbrook Consent Decree was written. In January 1937, Thomas Thacher, a former solicitor general of the United States under President Hoover, gave a talk at the annual meeting of the American Academy of Medicine. He attacked socialized medicine as a “fallacy” that would “blanket the country without regard to local conditions and individuals.” He also expressed doubts about the constitutionality of socialized medicine under the proposed system of compulsory health insurance, adding that states had no power to enforce funding for it.
