In 1992, Professor James Henderson and I wrote that, throughout the 1980s, a quiet, pro-defendant revolution in products liability had occurred. That revolution was likely largely the product of a "widespread, independent shift in judicial attitudes." It was not discernable in cases tried before juries. The federal data used in that study were available through 1989. Also in 1992, using the same database, Professor Kevin Clermont and I wrote about the surprising relation between plaintiff win rates in judge and jury trials in products liability cases. Professor Viscusi's article differs from the dominant mode of law and economics scholarship on punitive damages. The usual punitive damages article contains purely theoretical considerations about when punitive damages are appropriate and about their optimal level; no effort is made to ascertain whether the existing pattern of punitive awards corresponds with the theory. This is part of a larger problem: the dearth of empirical evidence in law and economics scholarship. Viscusi, on the other hand, provides empirical tests of whether punitive damages accomplish their goals, and he makes creative use of publicly available data sources. For the goal of his …

Given an irreducible inclusion of factors with finite index N ⊂ M, where M is of type IIIλ1/m, N of type IIIλ1/n, 0 < λ < 1, and m,n are relatively prime positive integers, we will prove that if N ⊂ M satisfies a commuting square condition, then its structure can be characterized by using fixed point algebras and crossed products of automorphisms acting on the middle inclusion of factors associated with N ⊂ M. Relations between N ⊂ M and a certain G-kernel on subfactors are also discussed.

What role does remorse really play in capital sentencing? We divide this basic question in two. First, what makes jurors come to believe a defendant is remorseful? Second, does a belief in the defendant's remorse affect the jury's final judgment of life or death? Here we present a systematic, empirical analysis that tries to answer these questions.
What makes jurors think a defendant is remorseful? Among other things, we find that the more jurors think that the crime is coldblooded, calculated, and depraved and that the defendant is dangerous, the less likely they are to think the defendant is remorseful. …

A mean-field model for dynamics of superconducting vortices is studied. The model, consisting of an elliptic equation coupled with a hyperbolic equation with discontinuous initial data, is formulated as a system of nonlocal integrodifferential equations. We show that there exists a unique classical solution in C1+α(Ω0) for all t > Ω, where Ω0 is the initial vortex region that is assumed to be in C1+α. Consequently, for any time t, the vortex region Ωt is of C1+α, and the vorticity is in Cα(Ωt).

Ranking And Explaining The Scholarly Impact Of Law Schools, Theodore Eisenberg, Martin T. Wells

This article measures 32 law schools' academic reputations by citations to their faculties' works. Yale, Chicago, Harvard, and Stanford rank alone at the top. Seven or eight schools compose the next group. We also explore the relation between scholarly impact and entry-level or lateral hire status, gender, minority status, subjects taught, and years in teaching. Lateral hires systematically outperform entry-level hires. We find no substantial evidence of male-female differences. We find some evidence of lower citations for minority females, but this difference is largely attributable to those in teaching fewer than 8 years. For faculty members in teaching more than …

Several studies hypothesize a relation between board size and financial performance. Empirical tests of the relation exist in only a few studies of large U.S. firms. We find a significant negative correlation between board size and profitability in a sample of small and midsize Finnish firms. Finding a board-size effect for a new and different class of firms affects the range of explanations for the board-size effect.

The overall objective of this research effort was to formulate a preventive maintenance strategy for AMRAAM missiles subject to extended captive carry flight time. A preventive maintenance policy is only applicable if the item in question is aging, or deteriorating with time. Therefore, a supporting objective of this research is to characterize the aging process of the missile system through a non-parametric analysis of its Mean Residual Life (MRL) function. Three non-parametric, censored-data MRL function estimation techniques discussed in the literature are examined via a numerical example. Capping punitive damages awards is a centerpiece of the tort reform movement. According to the American Tort Reform Association, as of June 30, 1996, forty-three states allowed punitive damages awards. Of these, twenty-nine states impose no caps on punitive damages and fourteen impose some form of cap. In states that cap punitive awards, the preferred method is to employ a simple multiple of the compensatory award. Eleven states rely on a multiple of the compensatory damages award. The most popular multiple is three times the compensatory award, but this is used by only five states. The capping multiples range from …

Two elements A and B in a ring R determine a generalized derivation deltaA,B on R by setting δA,B(X) = AX - XA for any X in R. We characterize when the product δC,DδA,B is a generalized derivation in the cases when the ring R is the algebra of all bounded operators on a Banach space epsilon, and when R is a C*-algebra U. We use the se characterizations to compute the commutant of the range of δA,B.

Chapter 11 is widely believed to be among the industrialized world's most debtor-oriented reorganization laws. Critics assert that Chapter 11 is too easily available and that it allows debtors too much control by, inter alia, not requiring appointment of a trustee. One criticism of Chapter 11, low returns to unsecured creditors, resonates with an important theme of this Symposium, the Bebchuk-Fried proposal to reduce secured creditor priority in insolvency proceedings. The Chapter 11 criticisms and the Bebchuk-Fried proposal raise the question whether less easy access to Chapter 11, reduced debtor control, diminished secured creditor priority, or other changes could reduce …

This paper uses a current statistical approach to examine and adjust the seasonalities in the Naira exchange rate statistics, vis-a-vis the U.S. Dollar and the pound sterling for a period of twenty-five (25) years. Using the first exit time for Brownian motion from a smoothly bounded domain in Euclidean space, we define two natural functionals on the space of embedded, compact, oriented, unparametrized hypersurfaces in Euclidean space. We develop explicit formulas for the first variation of each of the functionals and characterize the critical points.

In this dissertation, we consider a model based approach to the estimation of exploitation rate of a fish population by combining mark-recapture procedures with a creel survey. We also consider the analysis of a proportional hazards survival model for randomly censored observations, known as the Koziol-Green model. The model assumes that the lifetime survivor function is a power of the censored time survivor function.

Using one year of jury trial outcomes from 45 of the nation's most populous counties, this article shows a strong and statistically significant correlation between compensatory and punitive damages. These findings are replicated in 25 years of punitive damages awards from Cook County, Illinois, and California. In addition, we find no evidence that punitive damages awards are more likely when individuals sue businesses than when individuals sue individuals. With respect to award frequency, juries rarely award punitive damages and appear to be especially reluctant to do so in the areas of law that have captured the most attention, products liability …

Several previous studies investigated the performance of competing circular error probable (CEP) estimators for small samples. This estimation is important in ICBM analysis because, due to expense, there are a limited number of ICBM test launches. In the most recent previous study (1993), Tongue considered five CEP estimators in a simulation test, attempting to determine the behavior of these estimators for populations of various bias, ellipticity, correlation, and sample size. The Litigious Plaintiff Hypothesis: Case Selection And Resolution, Theodore Eisenberg, Henry S. Farber

The process through which cases are selected for litigation cannot be ignored because it yields a set of lawsuits and plaintiffs that is far from a random selection either of potential claims or of potential claimants. We present a theoretical framework for understanding the operation of this suit-selection process and its relationship to the underlying distribution of potential claims and claimants. The model has implications for the trial rate and the plaintiff win rate at trial. Our empirical analysis, using data on over 200,000 federal civil litigations, yields results that are strongly consistent with the theory.

Circular covariance is important in modelling phenomena in epidemiological, communications and numerous physical contexts. We introduce and develop a variety of methods which make it a more versatile tool. First, we present two classes of estimators for use in the presence of missing observations. Using simulations, we show that the mean squared errors of the estimators of one of these classes are smaller than those of the Maximum Likelihood (ML) estimators under certain conditions. The term ''self-consistency'' was introduced in 1989 by Hastie and Stuetzle to describe the property that each point on a smooth curve or surface is the mean of all points that project orthogonally onto it. We generalize this concept to self-consistent random vectors: a random vector Y is self-consistent for X if E[X|Y] = Y almost surely. This allows us to construct a unified theoretical basis for principal components, principal curves and surfaces, principal points, principal variables, principal modes of variation and other statistical methods. Unusual microstructures of YBa2Cu3Ox (123) crystals have been observed. These structures have been shown to pass very high transport currents. A model of the solidification of 123 from a melt with Y2BaCuO5 (211) inclusions indicates that the stability of the 123 interface can depend on the sizes of the 211 inclusions. The observed formations are interpreted in the light of this instability.
