2016 marks the 70th anniversary of the International Convention for the Regulation of Whaling (ICRW) as well as the 30th anniversary of the International Whaling Commission’s (IWC) moratorium on commercial whaling. It also marks three decades of effort by Japan to overturn this ban. Its strategy to circumvent the moratorium by issuing permits to kill protected whales for scientific research is famous—even the subject of a 2014 lawsuit at the International Court of Justice. In interpreting and evaluating the history of the Supreme Court's corporate jurisprudence, legal scholars have deployed three broad theories of corporate legal personality: the aggregate entity theory, the artificial entity theory, and the real entity theory. While these theories are powerful ways of conceptualizing the corporation, this article shows that they have not been as central to the Supreme Court's corporate jurisprudence as recent scholarship suggests. It instead argues that historic transformations in the high court's corporate jurisprudence are best understood in light of contemporary intellectual currents rather than through an expost facto application of the aggregate, artificial, and real …

The increasing amount of electronic word of mouth (eWOM) has significantly affected the way consumers make purchase decisions. Empirical studies have established an effect of eWOM on sales but disagree on which online platforms, products, and eWOM metrics moderate this effect. The authors conduct a meta-analysis of 1,532 effect sizes across 96 studies covering 40 platforms and 26 product categories. On average, eWOM is positively correlated with sales (.091), but its effectiveness differs across platform, product, and metric factors. The percentage of S&P 500 firms using multiyear accounting-based performance (MAP) incentives for CEOs increased from 16.5% in 1996 to 43.3% in 2008. The use and design of MAP incentives depend on the signal quality of accounting versus stock performance, shareholder horizons, strategic imperatives, and board independence. After the technology bubble, option expensing, and the publicity of option backdating, firms increasingly use stock-based MAP plans to replace options, resulting in changes in pay structure, but not in pay level. This research examines the direct effect of country personality (CP) on consumer product attitude and indirect effect through consumer self-congruity between CP and his/her own self-concept on product attitude in an emerging country- Turkey. We propose an integrated structural equation model to examine the relationships. Measurement scales for CP, self-congruity and attitude are developed whose validities and reliabilities are confirmed by exploratory (EFA) and confirmatory (CFA) factor analyses with data collected from a sample of consumers in Turkey on two countries: USA and China.

The commercial-grade kitchens found in the Randall Dining Commons (RDC) of Sandhu Conference Center are frequently used to prepare food for students for every meal, seven days a week. This paper explores the value of disclosing stress test results to investors and market participants within the US financial system. Recently the Federal Reserve (“Fed”) expanded its required internal stress testing program, often referred to as the Dodd-Frank Act Stress Test (“DFAST”), to include bank holding companies (“BHCs”) with more than $10 billion in total assets. These BHCs were required to publicly disclose their results for the first time in June of 2015. Public accountants and students evaluated career success before and after career actions by public accountants, represented by resumes that were randomly assigned traditionally male or feminine names. Bias in favor of the resumes with a traditionally male name was initially detected, but after implementing recommendations from subjects, subject assessments favored resumes with a traditionally female name. This suggests that career choices matter and that choices can mitigate or even overcome gender bias in public accounting.

The civil application of the Racketeering Influenced and Corrupt Organizations Act (RICO) has been misapplied by the lower courts, but the statute can be improved by incorporating elements that will make the statute a better tool for justice. It is evident from examining the procedural limitations of the statute and important case law that the securities fraud gap, terrorism financing, and difficulties for indirect victims are three critical subjects that need to be addressed by enhancing RICO. The Airline Quality Rating (AQR) is the most comprehensive study of the performance and quality of the largest airlines in the United States. The rating is a multifactor look of the airlines based on mishandled baggage, consumer complaints, on-time performance and involuntary denied boardings.

The Airline Quality Rating industry score for 2015 shows an industry that improved slightly in overall performance quality over the previous year. Six airlines (Delta, ExpressJet, JetBlue, SkyWest, Southwest, and United) showed improvement in AQR scores in 2015. ExpressJet and SkyWest had the largest improvements in their AQR scores for 2015.

This project sought to determine what the labor conditions of porters working in Annapurna are and the factors both immutable and human-influenced that shape them. To do so, I interviewed government bodies, national and regional trekking organizations, unions, agencies, guides and porters to ascertain what issues a broad term such as “labor conditions” encompasses. Participants highlighted the importance of insurance, wages, weight carried, equipment, access to employment, job training and topography as important factors. I will argue that large advocacy organizations shape these issues, and therefore the porter market, at a national level. Discrepancies in employment experiences between porters are …

Buildings influence human consumption levels and lifestyles, require resources for creation and operation, and occupy physical space in the environment. This study examines if energy efficient buildings provide sufficient benefits to overcome costs in a certified green building project and the ways that tenants and owners can work together to accomplish retrofit projects and LEED certification in existing buildings. The results of the LEED feasibility analysis demonstrated that the office building studied could achieve Silver or Gold certification with little or no infrastructure and process change cost. Adequate credit availability for small businesses is an important public policy issue because small businesses are essential for employment and economic growth for the economy. The Gramm-Leach-Bliley Act of 1999 includes a provision that could potentially support financial institutions in the provision of credit to small businesses through the use of advances from the Federal Home Loan Bank (FHLB) system that are secured with small business loans. Natural gas vehicles are being developed because of increasing concerns about energy dependence, air quality and emissions, and, more recently, climate change. The major advantage of natural gas vehicles is their lower fuel cost. Several economic and technical factors such as limited range and availability of relevant infrastructure prevent widespread adoption of natural gas vehicles. A model for the financial analysis of the possibility of compressed natural gas (CNG) vehicles being competitive with gasoline-powered vehicles is offered.
