In 1974 the state of Michigan enacted what has come to be referred to as model rape legislation. A salient objective of the Criminal Sexual Conduct (CSC) Code in this state was to facilitate the comparable rather than unique handling of sexual assaults in the criminal justice system. The primary purpose of this study was to discern whether or not this objective of equitable case treatment was realized through implementation. The focus of this research was therefore directed towards the discovery of differences in sexual and non-sexual assault case prosecutions. Disaggregation In Deterrence And Death Penalty Research: The Case Of Murder In Chicago, William C. Bailey

This article examines the deterrent effect of executions on first-degree murders in Chicago, Illinois for the period 1915-1921. Chicago provides an ideal research setting since there is close geographic proximity between the place where first-degree murders are committed and the place where the convicted murderers are executed. The population density factor included in the model is very highly correlated with the nonwhite population, male population fifteen to thirty-four years of age, and the foreign born population variables. In examining monthly first-degree murders and total criminal homicides, two execution measures are utilized: the actual number of monthly executions, and a dummy …

There has been little intellectual support for the average American's view of the proper relationship between L' crime and punishment. This text is an effort to philosophically define and defend this view. Chapters one and two deal with teleological theories and justification for systems and rules of practices. I first discuss the historical relationship of man to the state, showing the necessity of and providing a basis for civil authority and law and showing both to be based on social utility. Political Symbolism In Juvenile Justice: Reforming Florida's Juvenile Detention Criteria, C. Aaron Mcneece, Mark Ezell

The Journal of Sociology & Social Welfare

A recent reform in Florida's juvenile detention criteria was over-turned during the subsequent legislative session. This paper describes both the initial reform and its reversal and suggests that symbolic political rewards may often be more important than the actual consequences of a policy. Recommendations are made for accomplishing policy reform in a traditional political culture.

Crime as a social phenomenon has customarily been examined as sets of occurrences which happen outside the boundaries of the legitimate social structure. Research by Lawrence E. Cohen and Marcus Felson suggests that more fruitful explanatory models of crime may be developed from the routine activity approach, an approach which regards crime as a routine activity in the same sense that everyday work may be regarded as routine activity. Such an approach is consonant with the precepts of human ecology. Human ecology as a theoretical model posits an interrelationship among the divergent parts of the social fabric. In such a …

Faculty Scholarship

Although punishment has been a crucial feature of every legal system, widespread disagreement exists over the moral principles that can justify its imposition. One fundamental question is why (and whether) the social institution of punishment is warranted. A second question concerns the necessary conditions for punishment in particular cases. A third relates to the degree of severity that is appropriate for particular offenses and offenders. Debates about punishment are important in their own right, but they also raise more general problems about the proper standards for evaluating social practices.
