การวิจัยเรื่อง แบบจำลองการคาดคะเนปัจจัยที่เป็นข้อบ่งชี้ลักษณะอาชญากรรมลูกผสมในสังคมไทย มีวัตถุประสงค์ในการวิจัยเพื่อ (1) ศึกษาปัญหาอาชญากรรมลูกผสมที่เป็นปัญหาสำคัญในสังคมไทย (2) สร้างแบบจำลองการคาดคะเนปัจจัยที่เป็นข้อบ่งชี้ลักษณะอาชญากรรมลูกผสมที่ใช้ในการจำแนก และอธิบายความสัมพันธ์และ/หรือหลักฐานในการยอมรับว่าเป็นอาชญากรรมลูกผสมในสังคมไทย และ (3) ศึกษาแนวทางในการป้องกันและแก้ไขปัญหาอาชญากรรมลูกผสมในสังคมไทย ผู้วิจัยใช้ระเบียบวิธีวิจัยแบบผสมผสานของการวิจัยเชิงปริมาณและเชิงคุณภาพ โดยเน้นการวิจัยเชิงปริมาณเป็นหลักสำคัญจากเจ้าหน้าที่ผู้ปฏิบัติงาน สำนักงานตำรวจแห่งชาติ และเจ้าหน้าที่ผู้ปฏิบัติงาน กรมสอบสวนคดีพิเศษ จำนวน 400 คน ซึ่งใช้วิธีการเลือกกลุ่มตัวอย่างจากการสุ่มกลุ่มตัวอย่างแบบง่าย เครื่องมือที่ใช้ในการวิจัยเป็นแบบสอบถามที่ผู้วิจัยสร้างขึ้น (IOC = 0.868, Reliability = 0.981) วิเคราะห์ข้อมูลโดยการหาค่า ความถี่ ร้อยละ ค่าเฉลี่ย ส่วนเบี่ยงเบนมาตรฐาน และวิเคราะห์ปัจจัยบ่งชี้ลักษณะอาชญากรรมลูกผสมในสังคมไทยโดยใช้ตัวแบบสมการเชิงโครงสร้าง ในส่วนของการวิจัยเชิงคุณภาพ ใช้เทคนิคการสัมภาษณ์เชิงลึกผู้ปฏิบัติงานระดับผู้บริหารหน่วยงานภาครัฐที่เกี่ยวข้องกับปัญหาอาชญากรรมลูกผสมในสังคมไทย จำนวน 15 คน ซึ่งใช้วิธีการเลือกกลุ่มตัวอย่างแบบเจาะจง เครื่องมือที่ใช้ในการวิจัยเป็นแบบสัมภาษณ์แบบกึ่งโครงสร้าง วิเคราะห์ข้อมูลโดยวิธีการวิเคราะห์เนื้อหา เพื่ออธิบายและยืนยันความถูกต้องของข้อมูลที่ได้จากการวิจัยเชิงปริมาณ รวมทั้งเป็นส่วนเสริมหรือส่วนเติมเต็มความสมบูรณ์ถูกต้องของงานวิจัย ผลการวิจัย พบว่า ปัญหาอาชญากรรมในสังคมไทยมีการปรับเปลี่ยนรูปแบบด้านปัญหาอาชญากรรมลูกผสมอยู่ในระดับมาก (ค่าเฉลี่ย = 4.18) ซึ่งเป็นอาชญากรรมมากกว่ารูปแบบเดียว ที่เกิดจากการผสมผสานกันระหว่างอาชญากรรมรูปแบบเดิมและอาชญากรรมรูปแบบใหม่ เป็นอาชญากรรมลูกผสมพื้นฐาน อาชญากรรมลูกผสมขั้นสูง อาชญากรรมลูกผสมอื่น ๆ และในอนาคต โดยปรากฏลักษณะสำคัญของปัญหาอาชญากรรมลูกผสมในมิติด้านต่าง ๆ ได้แก่ ผู้กระทำผิดหรืออาชญากรมีการรวมตัวกันเป็นเครือข่าย/องค์กรมากขึ้น ข้ามรัฐ/ไร้พรมแดน พึ่งพาเทคโนโลยี วิธีการที่หลากหลาย/ซับซ้อน ส่งผลกระทบในวงกว้าง ไม่จำกัดช่วงเวลาและสถานที่ สร้างการเลียนแบบ เข้าถึงเป้าหมายได้ง่าย ไม่จำเป็นต้องเผชิญหน้ากับเป้าหมาย คุ้มค่ามากที่สุดในการก่อเหตุต่อครั้ง เกี่ยวข้องกับการใช้ชีวิตประจำวัน ติดตามตัวผู้กระทำผิดมาลงโทษได้ยาก ทำให้สูญเสียบุคลากรและงบประมาณจำนวนมากในการปราบปราม ป้องกันและแก้ไข ซึ่งการสร้างแบบจำลองการคาดคะเนปัจจัยบ่งชี้ลักษณะอาชญากรรมลูกผสมในสังคมไทยตามสมมติฐาน มีความสัมพันธ์กับข้อมูลเชิงประจักษ์ (p-value = 0.881, Chi-square / df = 0.920, CFI = 0.95, GFI = 0.96, AGFI = 0.95, RMSEA = 0.000, SRMR = 0.040) สรุปได้ว่า ปัญหาอาชญากรรมลูกผสมในสังคมไทยได้รับอิทธิพลรวม …

ในการลงทัณฑ์ในประวัติศาสตร์ไทยเป็นการใช้ความรุนแรงของรัฐกระทำต่อมนุษย์ผู้อยู่ในสังคม โดยสังคมย่อมยินยอมให้รัฐลงโทษมนุษย์ที่กระทำความผิด อย่างไรก็ตามการลงโทษทัณฑ์ของรัฐต้องอาศัยความสมเหตุสมผลซึ่งเป็นอำนาจของความรู้อย่างหนึ่งในการสร้างความชอบธรรมในการปกครอง วิทยานิพนธ์ฉบับนี้เป็นการชี้ให้เห็นถึงความสัมพันธ์ของโทษทัณฑ์ในฐานะวาทกรรมอย่างหนึ่งที่เปลี่ยนแปลงตามรูปแบบของรัฐไปพร้อมกับการเปลี่ยนแปลงการให้เหตุผลในการลงโทษในแต่ละสมัย โดยพิจารณาจากการเปลี่ยนผ่านรูปแบบการให้ความสมเหตุสมผลของภาครัฐ และความเห็นจากภาคสังคม ผ่านกรณีศึกษาการลงโทษประหารชีวิต และรูปแบบของเรือนจำ ด้วยวิธีวงศาวิทยาเชิงประวัติศาสตร์ จากปัจจุบันร่วมสมัยจนถึงรัฐสมัยโบราณ ซึ่งทำให้เห็นว่าในมิติทางประวัติศาสตร์การลงโทษเป็นเพียงวาทกรรมที่ปรากฏเด่นชัดในแต่ละยุคสมัย โดยเป็นอิทธิพลของการรับเอาวิธีคิดจากภายนอกเข้ามาปะทะกับความคิดภายในสังคมแบบเดิม และทำให้ความคิดที่เป็นวาทกรรมเกิดการซ้อนทับกันเป็นชั้น โดยต่างเป็นการจับวางในวาทกรรมทัณฑวิทยาทั้งรูปแบบดังต่อไปนี้ (1) การแก้แค้นทดแทนให้สาสม (2) การลงโทษเพื่อการยับยั้งป้องกัน และ (3) การลงโทษเพื่อการบำบัดฟื้นฟู ซึ่งเป็นวิธีการหนึ่งของรัฐไทยในการผดุงความชอบธรรมของความสมเหตุสมผลของการลงโทษในสังคมไว้แบบเดิม วิทยานิพนธ์ฉบับนี้นับเป็นคุณูปการในการพยามนำเสนอการใช้วิธีวงศาวิทยาในการศึกษาการลงทัณฑ์ในประวัติศาสตร์ไทย ตลอดจนเปิดมุมมองที่หลากหลายต่อความสมเหตุสมผลของกรอบคิดของการลงโทษแบบอื่นๆต่อไป

การป้องกันการตกเป็นเหยื่อคุกคามทางเพศของเด็กในโลกออนไลน์, พรรษาวดี คล้อยระยับ

การศึกษาการป้องกันการตกเป็นเหยื่อคุกคามทางเพศของเด็กในโลกออนไลน์ครั้งนี้มีวัตถุประสงค์เพื่อ 1) ศึกษาสภาพปัญหาการตกเป็นเหยื่อคุกคามทางเพศของเด็กในโลกออนไลน์ 2) ปัญหาและอุปสรรคในการป้องกันการตกเป็นเหยื่อทางเพศของเด็กในโลกออนไลน์ และ 3) เสนอแนะแนวทางการป้องกันการตกเป็นเหยื่อทางเพศของเด็กในโลกออนไลน์ เป็นการศึกษาวิจัยเชิงคุณภาพ โดยการสัมภาษณ์เชิงลึก (In-Depth Interview) กับกลุ่มตัวอย่างที่มีส่วนเกี่ยวข้องกับข้อมูลเชิงลึกในการศึกษาวิจัยครั้งนี้คือองค์กรภาครัฐ องค์กรภาคเอกชน อัยการ จำนวน 10 คน ผลการวิจัยพบว่า 1) สภาพปัญหาการตกเป็นเหยื่อคุกคามทางเพศในสื่อสังคมออนไลน์ปัจจุบันมีจำนวนมากขึ้น สาเหตุการคุกคามทางเพศในโลกออนไลน์ เกิดจากหลายสาเหตุทั้งจากตัวของเด็กที่เข้าถึงโซเชียลมีเดียได้ง่าย ครอบครัวของเด็กมีปัญหาในครอบครัวทำให้ต้องพึ่งพาสังคมออนไลน์ สภาพแวดล้อมที่เด็กอยู่ รวมไปถึงเพื่อนของเด็ก และตัวผู้กระทำความผิดมักจะเป็นผู้มีความชำนาญ รูปแบบการคุกคามทางเพศในโลกออนไลน์ มีดังนี้คือ การกลั่นแกล้งทางเพศ การข่มขู่ทางเพศ การลวนลามทางเทศ และ การอนาจารทางเพศ 2) ผลการศึกษาปัญหาและอุปสรรคในการป้องกันการตกเป็นเหยื่อทางเพศของเด็กในโลกออนไลน์ พบว่า กฎหมาย บทลงโทษตลอดจนนโยบายของรัฐ เกี่ยวกับการป้องกันการถูกคุกคามทางเพศในโลกออนไลน์ มีความสอดคล้องเหมาะสม แต่การนำผู้ต้องหามาลงโทษมีความยากลำบาก เนื่องจากในโลกออนไลน์ไม่สามารถเก็บพยานหลักฐานได้ครบ ขาดการประสานงานร่วมกันระหว่างหน่วยงานภาครัฐ ภาครัฐกับภาคเอกชน และการได้รับการสนับสนุนจากภาคเอกชนยังไม่เพียงพอทั้งด้านงบประมาณ ด้านข้อมูล และบุคลากรยังไม่เพียงพอ 3) แนวทางการป้องกันการตกเป็นเหยื่อทางเพศของเด็กในโลกออนไลน์ ดังนี้ คือรัฐและหน่วยงานที่เกี่ยวข้อง ควรมีการดำเนินการเชิงรุก โดยใช้สื่อสังคมออนไลน์ เพื่อให้ความรู้ความเข้าใจแก่เด็กและเยาวชน ประชาชน ในการป้องกันการตกเป็นเหยื่อคุกคามทางเพศในโลกออนไลน์ องค์กรเอกชน หรือภาคเอกชน ร่วมเสริมสร้างความตระหนักรู้เกี่ยวกับการป้องกันการตกเป็นเหยื่อคุกคามทางเพศของเด็กในโลกออนไลน์ เพื่อลดความเสี่ยง ควรให้การสนับสนุนทรัพยากรต่าง ๆ ทั้งทางด้านงบประมาณ บุคลากร และข้อมูล เนื่องจากภาครัฐมีทรัพยากรดังกล่าวไม่เพียงพอและ ผู้ปกครองสร้างความรู้ความเข้าใจ เอาใจใส่ดูแลบุตรหลาน ทุกหน่วยงานต้องมีส่วนร่วมป้องกัน แก้ไขปัญหากันอย่างจริงจัง เจ้าหน้าที่รัฐไม่เผยแพร่ข้อมูลเหยื่อสู่สาธารณะ

วิทยานิพนธ์เล่มนี้เป็นการวิจัยเชิงคุณภาพ มีวัตถุประสงค์เพื่อ (1) ตีความเนื้อหาละครโทรทัศน์เกาหลีที่สามารถเปลี่ยนทัศนคติเกี่ยวกับความรุนแรงในทางย้อนแย้งของคู่รักวัยรุ่นไทย โดยศึกษาจากละครโทรทัศน์เกาหลี 3 เรื่อง ได้แก่ Princess Hours, You Who Came from the Stars และ Crash Landing on You และ (2) ศึกษาทัศนคติเกี่ยวกับความรุนแรงของคู่รักวัยรุ่นไทยหลังจากการดูละครโทรทัศน์เกาหลี โดยศึกษาจากการสัมภาษณ์เชิงลึกคู่รักวัยรุ่นชาวไทยเพศชายและเพศหญิงอายุ 18-25 ปีที่รับชมและชื่นชอบละครโทรทัศน์เกาหลี ซึ่งผลการศึกษาพบว่า ละครโทรทัศน์เกาหลีสามารถเปลี่ยนทัศนคติเกี่ยวกับความรุนแรงในทางย้อนแย้งของคู่รักวัยรุ่นไทยในด้านความคิด ความรู้สึก และพฤติกรรม ด้วยการนำเสนอภาพตัวละครนำชายที่มีลักษณะของความเป็นชายแบบใหม่และความเป็นสุภาพบุรุษ รวมถึงการไม่ใช้ความรุนแรงกับคนรัก ซึ่งย้อนแย้งกับความเป็นจริงของสังคมเกาหลีที่เป็นสังคมปิตาธิปไตยและเพศชายมีการใช้ความรุนแรงต่อคู่รักของตน ซึ่งงานวิจัยนี้อาจเป็นแนวทางและความรู้สำหรับหน่วยงานที่เกี่ยวข้องในการสร้างเนื้อหาละครโทรทัศน์ให้สามารถเปลี่ยนทัศนคติเกี่ยวกับความรุนแรงของคู่รักวัยรุ่นไทย เพื่อลดการเรียนรู้และลอกเลียนแบบความรุนแรงจากสื่อ

การศึกษาวิจัย เรื่อง "แนวทางการลงโทษประหารชีวิตในสังคมไทย: ศึกษากรณีอาชญากรรมอุกฉกรรจ์ที่สุดตามแนวทางสหประชาชาติ" มีวัตถุประสงค์เพื่อศึกษาข้อกำหนดและแนวทางของสหประชาชาติ รวมถึงความสอดคล้องของสภาพสังคมไทยกับการลงโทษประหารชีวิตในคดีอาชญากรรมอุกฉกรรจ์ที่สุด และแนวทางที่เหมาะสมสำหรับสังคมไทยในการลงโทษประหารชีวิตในคดีอาชญากรรมอุกฉกรรจ์ที่สุดตามมาตรฐานสหประชาชาติ เป็นการศึกษาวิจัยเชิงคุณภาพ (Qualitative Research) โดยการวิจัยเอกสาร (Documentary Research) และการสัมภาษณ์เชิงลึก (In-depth Interview) จากกลุ่มผู้กำหนดนโยบาย ผู้นำนโยบายมาปฏิบัติ กลุ่มประชาสังคม และกลุ่มนักวิชาการ จำนวน 14 คน ผลการศึกษาพบว่า ข้อกำหนดและแนวทางการลงโทษประหารชีวิตในคดีอาชญากรรมอุกฉกรรจ์ที่สุดของสหประชาชาติเป็นมาตรฐานสากลที่พึงปฏิบัติ แม้ว่าในแต่ละประเทศจะมีบริบททางสังคมและวัฒนธรรมที่แตกต่างกัน หากประเทศไทยกำหนดนโยบายการลงโทษประหารชีวิตในคดีอาชญากรรมอุกฉกรรจ์ที่สุดสอดคล้องต่อแนวทางของสหประชาชาติจะส่งผลให้สามารถลดความผิดพลาดในการดำเนินคดีอาญาด้วยการลงโทษผู้บริสุทธิ์ และลดผลกระทบต่อเหยื่อได้ แนวทางที่เหมาะสมในการใช้โทษประหารชีวิตในกรณีคดีอาชญากรรมอุกฉกรรจ์ที่สุดตามแนวทางของสหประชาชาติ คือ การใช้โทษประหารชีวิตเฉพาะในคดีเจตนาฆ่าทำให้ผู้อื่นเสียชีวิต และอาจพักการใช้โทษประหารชีวิตในทางปฏิบัติ อีกทั้งการนำมาตรการแทนการลงโทษประหารชีวิตในฐานความผิดที่มีอัตราโทษสูงถึงขั้นประหารชีวิตที่ไม่สอดคล้องต่อแนวทางของสหประชาชาติ คือ กำหนดโทษจำคุกเพิ่มเข้าไปในบางฐานความผิดที่มีบทลงโทษประหารชีวิตเพียงสถานเดียว, การใช้โทษจำคุกระยะยาวที่มีกำหนดระยะเวลาแน่นอนในการพ้นโทษ, การจำคุกตลอดชีวิตโดยไม่ได้รับการลดโทษ และการนำนักโทษประหารไปใช้ให้เกิดประโยชน์ในด้านต่าง ๆ อันเป็นประโยชน์ต่อสังคม เพื่อการเปลี่ยนแปลงแนวทางการลงโทษประหารชีวิตในคดีอาชญากรรมอุกฉกรรจ์ที่สุด (Most Serious Crime) ที่สอดคล้องกับแนวทางของสหประชาชาติและเหมาะสมกับสังคมไทยในปัจจุบันและอนาคตสืบไป

Criminal sentencing in the United States has shifted over the years. This paper outlines the current role morality plays in the sentencing and punishment of criminals. Recent work in moral psychology points the way to a better approach. Jonathan Haidt’s moral matrices, from his book The Righteous Mind: Why Good People Are Divided by Politics and Religion, provide a signpost for more efficacious treatment of those on parole or under community supervision, overall contributing to the reduction of recidivism. In sum, Haidt’s work in moral psychology could lead to fairer sentencing and more effective treatment.

This thesis examines to what extent traditional gender norms are adhered to by the depiction of stalkers within films. Stalking has only recently been recognized as a social problem. Due to the relatively new attention, there has been a lack of research surrounding the way in which stalkers and stalking behaviours are being portrayed within popular media, particularly film media. This paper uses a qualitative ethnographic content analysis approach to examine these stalking depictions. This qualitative, multi-manuscript dissertation examines the experiences of Black women who live in the Greater Toronto Area and other southwestern Ontario regions who have experienced intimate partner violence (IPV), some of whom were also charged with an IPV-related offence. Semi-structured interviews were conducted with 25 Black women to better understand the meanings they attach to their experiences. There is a considerable and established literature on the topic of violence against women. Yet, there remains understudied areas of foci with lesser attention paid to its occurrence within online and digital contexts. Of particular interest is the networked misogyny and sexism of the online group that self-identifies as “involuntary celibates”, or “incels”. Drawing on data collected from online forums and chat rooms, the language and discourse of this particular group are analyzed through an integrated conceptual framework encompassing hegemonic masculinity, aggrieved entitlement, and patriarchy to better understand the prevalence and types of violence promoted by “incels”. This article reviews the literature of how individual differences (specifically trait conscientiousness) may contribute to ex-offender responsivity to reentry programming. By studying if individual differences (e.g. personality traits) contribute to specific responsivity, programming can be determined to be ineffective for the general population and redesigned in a manner that is beneficial for the largest number of clients. Bruce Bryant, 50, was convicted of the murder of 11-year-old Travis Lilley in June 1996. Bryant maintains he never fired a weapon that day in 1993. But he recognizes that his lifestyle as a young person — he started dealing drugs when he was 14 — contributed to an environment in which a stray bullet could take a young life. And for that reason, he’s spent most of his 25 years in prison working to help young people.

The study analyzed the criminogenic effect of legalizing recreational marijuana dispensaries in Denver. Street segments with recreational dispensaries experienced no changes in violent, disorder and drug crime but did experience an 18% increase in property crime, and street segments adjacent to recreational dispensaries experienced some notable (but non-significant) drug and disorder crime increases. Medical dispensaries demonstrated no significant crime changes. A cost-benefit analysis found the associated crime costs were largely offset by sales revenue. Monetary benefits were much less pronounced, and barely cost effective, when only considering tax revenue.

Sexual violence is a pervasive issue identified on post-secondary campuses. Existing research focuses almost exclusively on an American context and quantitatively explores the frequency with which sexual assault occurs on campuses. As men are overrepresented as perpetrators, it is necessary to investigate their perspectives on the issue. The present study qualitatively examines the perspectives of white, heterosexual, male students to facilitate dialogue about sexual violence on university campuses in Ontario. This dissertation examined the link between low self-control, risky lifestyles, and victimization, using data from 1,057 South Korean adolescents included in the Study on Childhood Delinquency. Specifically, this study explores a full mediation model to test whether risky lifestyles (unstructured activity, association with deviant peers, and delinquency) account for the effect of low self-control on victimization. The results indicated that low self-control only had an indirect effect on victimization primarily through unstructured time and one’s own delinquency. Private security personnel play an important but largely overlooked role in the operation of CCTV surveillance to prevent crime in public and private areas. This role can take a number of forms, including active monitoring of cameras. Drawing upon a global database of CCTV evaluations (N=165), this article examines the function and performance of private security personnel as related to the effectiveness of CCTV. Findings indicate that CCTV schemes operated by private security personnel generated larger crime prevention effects than those operated by police or those using a mix of police and security personnel. Policy and research implications are discussed.

Scholars argue that prison rule violations are a way to assess whether individuals are engaging in prosocial behaviors. Individuals who engage in prosocial behaviors, during periods of incarceration, are less likely to engage in behaviors that result in official rule violations. Sex offender registration laws are widely implemented, increasingly restrictive, and intended to serve both specific and general deterrent functions. Most states have some form of policy mechanism to place adolescents on sex offender registries, yet it remains unclear whether adolescents possess the requisite policy awareness to be deterred from sexual offending. This study examined awareness of sex offender registration as a potential sanction and its cross-sectional association with engagement in several registrable sexual behaviors (sexting, indecent exposure, sexual solicitation, and forcible touching) in a community sample of 144 adolescents. We were fortunate enough to work with the Union County Probation Office where we focused on adult probation, juvenile probation, and treatment court. We focused specifically on how it works, the effects of probation on society, and the differences between juvenile and adult probation.
