นับตั้งแต่อินเทอร์เน็ตถูกคิดค้นขึ้นได้ส่งผลกระทบต่อการเปลี่ยนแปลงอย่างรวดเร็วจากความก้าวหน้าของเทคโนโลยีในโลกไซเบอร์ ปัญหาสำคัญที่สังคมกำลังเผชิญอยู่ในขณะนี้คือการเพิ่มขึ้นของการโจมตีทางไซเบอร์ซึ่งสามารถเชื่อมโยงกับการก่อการร้ายทางไซเบอร์ แต่ละประเทศในโลกกำลังเริ่มที่จะจัดการกับข้อกังวลของการก่อการร้ายทางอินเทอร์เน็ตซึ่งเป็นวิธีการใหม่ในการบรรลุเป้าหมายทางการเมือง ประเทศไทยเป็นหนึ่งที่กำลังตื่นตระหนกและให้ความสนใจในประเด็นนี้ แต่เนื่องด้วยข้อจำกัดหลาย ๆ ประการจึงทำให้ความก้าวหน้าในการจัดการกับประเด็นนี้มีไม่มากนักเมื่อเทียบกับประเทศอื่น ๆ เพื่อตอบสนองต่อสถานการณ์การก่อการร้ายทางไซเบอร์ในประเทศไทยและสถานการณ์ที่อาจจะเกิดขึ้นในประเทศไทยในอนาคต วิจัยนี้จะทบทวนคำจำกัดความของคำว่าการก่อการร้ายทางไซเบอร์เพื่อกำหนดทิศทางการทำนโยบาย และแผนการเตรียมการของหน่วยงานของรัฐต่าง ๆ ที่มีความเสี่ยงของการก่อการร้ายทางไซเบอร์ไปในทางที่ถูกต้อง โดยการใช้เครื่องมือวิจัยในการศึกษาเอกสารและสัมภาษณ์เชิงลึกกับเจ้าหน้าที่ที่ทำงานด้ายไซเบอร์ของแต่ละองค์กร เพื่ออธิบายสถานการณ์การก่อการร้ายทางไซเบอร์และวิธีจัดการกับมันในอนาคต ผลการศึกษาพบว่าสถานการณ์การก่อการร้ายไซเบอร์ในประเทศไทยนั้นเป็นเพียงแค่ภัยคุกคามทางไซเบอร์เท่านั้น แต่ถึงอย่างไรก็ตามหน่วยงานภาครัฐของไทยก็มีศักยภาพในเรื่องของการออกกฎหมาย การใช้งบประมาณ และการเข้าถึงทางเทคโนโลยีอย่างปลอดภัยสำหรับประชาชน หากพิจารณาไปยังจุดอ่อนพบว่าประเทศไทยยังต้องมีการปรับปรุงในเรื่องของการบังคับใช้กฎหมาย ข้อบกพร่องทางเทคโนโลยี และจำนวนบุคลากรที่มีความรู้ความสามารถ เพื่อลดจุดอ่อนที่กล่าวมา รัฐบาลจำเป็นต้องสร้างสภาพแวดล้อมที่ไม่เอื้ออำนวยต่อการกระทำความผิดทางไซเบอร์ สร้างช่องทางทางอินเทอร์เน็ตใหม่ โดยที่รัฐสามารถควบคุมช่องทางทางไซเบอร์ได้ เพิ่มหลักสูตรความมั่นคงไซเบอร์ในโรงเรียนและมหาวิทยาลัย สร้างเครือข่ายสำรองกับประเทศอื่น ๆ หรือกับภาคเอกชนอื่น ๆ เพื่อรองรับการโจมตี

Sexual exploitation and abuse of girls is one of the endemic social problems in Nigeria. Although this problem has attracted much research attention in recent times, some newly emerged factors contributing to the problem have been mostly ignored. This study explored how the abandonment of children following their stigmatization as witches contributes to sexual exploitation and abuse of the girls in the Akwa Ibom and Cross River states of Nigeria. Social disorganization theory (Shaw 1942; 1969) suggests that communities with greater racial heterogeneity, residential mobility, and low socioeconomic status will be less organized, thereby less able to collectively repel criminal behavior. These characteristics describe many institutions of higher education (IHEs), so we should expect that IHEs would have higher crime rates than neighboring areas with greater social organization. However, recent explorations of social disorganization have considered the mitigating concept of collective efficacy. This research suggests that the characteristics of social control, social cohesion, and trust present in communities will mitigate crime (Sampson 1997). These community characteristics also describe many IHEs. …

Compassionate relief matters. It matters so that courts may account for tragically unforeseeable events, as when an illness or disability renders proper care impossible while a defendant remains incarcerated, or when family tragedy leaves an inmate the sole caretaker for an incapacitated partner or minor children. It matters too, as present circumstances make clear, when public-health calamities threaten inmates with literal death sentences. It matters even when no crisis looms, but simply when continued incarceration would be "greater than necessary" to achieve the ends of justice.

The geographical concentration of criminal violence is closely associated with the social, demographic, and economic structural characteristics of neighborhoods. However, few studies have investigated homicide patterns and their relationships with neighborhoods in South Asian cities. In this study, the spatial and temporal patterns of homicide incidences in Karachi from 2009 to 2018 were analyzed using the local indicators of spatial association (LISA) method. Generalized linear modeling (GLM) and geographically weighted Poisson regression (GWPR) methods were implemented to examine the relationship between influential factors and the number of homicides during the 2009–2018 period. The theory of differential association applies not only to adolescent people but also to the adult population. A lot of studies tested this theory on delinquent behavior but tests on victimization are rare. Using West Virginia Social Survey 2020 data, this study finds that there is an association between having delinquent friends and learning of self-delinquency in the adult population. It also reports that self-victimization can be predicted with having delinquent friends. The highest probability of victimization is twice for people for having pain medication misuser friends than of people having marijuana user friends. But self-delinquent behaviors do not report …

Social engineering is a method used by offenders to deceive their targets utilizing rationales of human psychology. Offenders aim to exploit information and use them for intelligence purposes or financial gains. Generating resilience against these malicious methods is still challenging. Literature shows that serious gaming learning approaches are used more frequently to instill lasting retention effects. Serious games are interactive, experiential learning approaches that impart knowledge about rationales and concepts in a way that fosters retention. Well trained pets have often been used in Animal Assisted Therapy (AAT) programs in hospitals and nursing homes to help patients cope with illnesses and recovery while away from home. Pet visits to these facilities have documented reductions in medications, stress, and loneliness when a simple wet nose reaches on to a patient’s bed for attention. การศึกษาเรื่อง การศึกษาการเคลื่อนย้ายของเสียข้ามแดนอย่างผิดกฎหมายในประเทศไทย มีวัตถุประสงค์เพื่อศึกษารูปแบบการเคลื่อนย้ายของเสียข้ามแดนอย่างผิดกฎหมายในประเทศไทย ศึกษาการบังคับใช้กฎหมาย ปัญหาและอุปสรรคที่เกิดจากการบังคับใช้กฎหมาย ตลอดจนแสวงหาข้อเสนอแนะต่อการป้องกันและปราบปรามการเคลื่อนย้ายของเสียข้ามแดนอย่างผิดกฎหมายในประเทศไทยโดยใช้วิธีการในการดำเนินการวิจัย คือ การวิจัยเชิงคุณภาพด้วยการศึกษาค้นคว้าจากเอกสาร และการสัมภาษณ์เชิงลึกผู้ให้ข้อมูลสำคัญ จำนวน 13 คน ประกอบด้วยพนักงานศุลกากร เจ้าพนักงานตำรวจ พนักงานสอบสวนคดีพิเศษ พนักงานอัยการ เจ้าหน้าที่กรมควบคุมมลพิษ ผู้แทนองค์กรพัฒนาเอกชนด้านสิ่งแวดล้อม และผู้เชี่ยวชาญด้านกฎหมายสิ่งแวดล้อม ผลการศึกษาพบว่า รูปแบบของการเคลื่อนย้ายของเสียข้ามแดนอย่างผิดกฎหมายในประเทศไทยที่พบมากที่สุด คือ การนำเข้าเศษพลาสติก ด้วยการขนส่งทางเรือโดยบรรจุของเสียในตู้สินค้า ซึ่งมีประเทศต้นทางที่สำคัญ คือ ประเทศสหรัฐอเมริกา โดยผู้กระทำผิดใช้วิธีการฉ้อฉลทางเอกสารเป็นหลัก และเป็นการกระทำโดยองค์กรอาชญากรรมข้ามชาติ ในขณะที่หน่วยงานบังคับใช้กฎหมายก็เผชิญกับปัญหาและอุปสรรคในการบังคับใช้กฎหมาย อาทิเช่น ปัญหาช่องว่างของกฎหมายในเรื่องหลักเกณฑ์การเปรียบเทียบงดการฟ้องร้องตามกฎหมายศุลกากร เป็นต้น อันนำมาสู่ข้อเสนอแนะเชิงนโยบายในการงดการเปรียบเทียบงดการฟ้องร้องเพื่อดำเนินคดีผู้กระทำผิดในชั้นศาล การนำพระราชบัญญัติป้องกันและปราบปรามการมีส่วนร่วมในองค์กรอาชญากรรมข้ามชาติ พ.ศ. 2556 มาใช้ในการปราบปรามการเคลื่อนย้ายของเสียข้ามแดนอย่างผิดกฎหมายในประเทศไทย ตลอดจนการจัดการกับของเสียที่เป็นของกลางและของตกค้างด้วยการส่งกลับต้นทาง เป็นต้น

การวิจัยนี้ มีวัตถุประสงค์ในการนำเสนอขั้นตอนของกระบวนการตรวจพิสูจน์พยานหลักฐานดิจิทัลในประเทศไทย กฎหมายที่เกี่ยวข้อง ตลอดจนปัญหาและอุปสรรค เพื่อนำไปสู่ข้อเสนอเชิงนโยบายในการปรับปรุงกฎหมายและพัฒนากระบวนการตรวจพิสูจน์พยานหลักฐาน โดยเนื้อหาเกี่ยวกับลักษณะเฉพาะของพยานหลักฐานดิจิทัล กระบวนการตรวจพิสูจน์พยานหลักฐานดิจิทัล ประเด็นปัญหาและอุปสรรคจากผู้ที่เกี่ยวข้อง ข้อเสนอเชิงนโยบายและเชิงปฏิบัติ โดยใช้วิธีการวิจัยเชิงคุณภาพจากเอกสาร การลงพื้นที่สัมภาษณ์เชิงลึกและกรณีศึกษา จากการศึกษาพบว่า กระบวนการตรวจพิสูจน์พยานหลักฐานดิจิทัลในประเทศไทย 4 ขั้นตอน มีปัญหาและอุปสรรค คือ 1) การรวบรวมพยานหลักฐาน มีปัญหาในการรวบรวมพยานหลักฐานให้สมบูรณ์ขณะเกิดเหตุโดยไม่ถูกเปลี่ยนแปลงแก้ไข 2) การเก็บรักษาพยานหลักฐาน ไม่เป็นไปตามมาตรฐานการจัดเก็บ และการจัดการพยานหลักฐานดิจิทัล 3) การวิเคราะห์พยานหลักฐานดิจิทัล บุคลากรบางส่วนขาดความเชี่ยวชาญที่จำเป็นเฉพาะด้าน 4) การนำเสนอผลพิสูจน์พยานหลักฐานดิจิทัล มีการโต้แย้ง หรือขาดน้ำหนักในการรับฟังในชั้นพิจารณาคดี ข้อเสนอแนะจากการศึกษาครั้งนี้ คือ ควรมีการปรับปรุงพัฒนากระบวนการตรวจพิสูจน์พยานหลักฐานดิจิทัลในประเทศไทยให้มีมาตรฐานการปฏิบัติที่ชัดเจนในทั้ง 4 ขั้นตอนให้สอดคล้องกับมาตรฐานสากล บุคลากรควรได้รับการอบรมเพิ่มเติมในประเด็นความเชี่ยวชาญเฉพาะด้าน เพื่อช่วยลดปัญหาและอุปสรรคในการปฏิบัติงาน มีการแก้ไขกฎหมายที่เกี่ยวข้อง รวมถึงสนับสนุนให้มีการจัดตั้งสภาวิชาชีพนิติวิทยาศาสตร์ และจัดตั้งหน่วยงานเฉพาะที่ทำหน้าที่ในการกำกับดูแล โดยเริ่มต้นจากการส่งเสริมบทบาทของศูนย์ดิจิทัลฟอเรนสิกส์ที่มีอยู่เดิม เพื่อให้การป้องกันปราบปรามอาชญากรรมคอมพิวเตอร์ในประเทศไทยมีประสิทธิภาพมากขึ้น การวิจัยนี้ ได้รับการสนับสนุนทุนการศึกษาจากทุนการศึกษาหลักสูตรดุษฎีบัณฑิต “100 ปี จุฬาลงกรณ์มหาวิทยาลัย” (The 100th Anniversary Chulalongkorn University Fund for Doctoral Scholarship) และทุน 90 ปี จุฬาลงกรณ์มหาวิทยาลัย กองทุนรัชดาภิเษกสมโภช [The 90th Anniversary of Chulalongkorn University Fund (Ratchadaphiseksomphot Endowment Fund)]

วิทยานิพนธ์เรื่องสายลับกับการสืบสวนปราบปรามอาชญากรรมยาเสพติดในประเทศไทย มีวัตถุประสงค์เพื่อศึกษาถึงความเป็นมาและบทบาทของสายลับในการสืบสวนปราบปรามอาชญากรรมยาเสพติดในประเทศไทย พร้อมทั้งศึกษาความสัมพันธ์ระหว่างเจ้าหน้าที่สืบสวนกับบุคคลที่เป็นสายลับในการทำงานปราบปรามยาเสพติด เพื่อวิเคราะห์ผลกระทบที่เกิดขึ้นจากการนำสายลับมาใช้ในการสืบสวนปราบปรามอาชญากรรมยาเสพติด โดยเป็นการศึกษาเชิงคุณภาพด้วยการวิจัยเชิงเอกสารและการสัมภาษณ์เชิงลึกจากผู้ให้ข้อมูลสำคัญ ประกอบด้วย เจ้าหน้าที่รัฐ สายลับ และบุคลากรในกระบวนการยุติธรรม จำนวนทั้งสิ้น 27 ท่าน ผลการศึกษาพบว่า สายลับเป็นกลวิธีในการหาข่าวที่ปรากฏหลักฐานมาตั้งแต่สมัยบรรพกาล ตราบจนกระทั่งสังคมมีพัฒนาการทางด้านกฎหมายและกระบวนการยุติธรรมทางอาญา วิธีการใช้สายลับจึงได้ถูกนำมาปรับใช้ในการทำงานสืบสวนของเจ้าหน้าที่ตำรวจซึ่งมีภารกิจรักษาความสงบเรียบร้อยภายในรัฐและการควบคุมอาชญากรรม บทบาทที่คาดหวังของสายลับคือ การกระทำใด ๆ ที่ตอบสนองต่อภารกิจการสืบสวนปราบปรามยาเสพติดตามที่เจ้าหน้าที่ต้องการ ซึ่งเป็นงานที่เจ้าหน้าที่ไม่อาจกระทำได้โดยฐานะของเจ้าหน้าที่เองหรืออาจต้องใช้ระยะเวลานาน บทบาทความสำคัญของสายลับส่วนหนึ่งขึ้นอยู่กับมุมมองของเจ้าหน้าที่แต่ละบุคคลซึ่งมีลักษณะเป็นอัตวิสัย รูปแบบของความสัมพันธ์ระหว่างเจ้าหน้าที่สืบสวนกับบุคคลที่เป็นสายลับจะแตกต่างกันไปในแต่ละคู่สัมพันธ์ การใช้สายลับได้ก่อให้เกิดผลกระทบในหลายด้าน เป็นต้นว่า สายลับต้องอยู่ในวัฏจักรของการกระทำความผิดและมีโอกาสกลับไปกระทำความผิดซ้ำ และด้วยลักษณะที่เป็นความลับทำให้การตรวจสอบความโปร่งใสของการทำงานเป็นได้ยากอันส่งผลกระทบต่อสังคมและกระบวนการยุติธรรมทางอาญาหลายประการ แนวทางพัฒนาการสืบสวนโดยวิธีใช้สายลับที่เหมาะสมกับบริบทของประเทศไทยจึงควรแก้ไขเพิ่มเติมกฎหมายวิธีพิจารณาคดียาเสพติด พ.ศ. 2550 หมวด 1 ว่าด้วยการสืบสวน โดยให้ระบุถึงการสืบสวนโดยวิธีใช้สายลับ พัฒนาระบบงานยุติธรรมทางอาญาให้ทุกฝ่ายยึดหลักการค้นหาความจริงในเนื้อหา และสร้างมาตรการกำกับดูแลให้ดียิ่งขึ้น

การศึกษานี้ มีวัตถุประสงค์เพื่อศึกษา ปัญหาการซื้อขายผลิตภัณฑ์ด้านความงามผ่านระบบพาณิชย์อิเล็กทรอนิกส์ในสังคมไทย ปัจจัยที่ส่งผลต่อพฤติกรรมการตกเป็นเหยื่อและการกระทำผิด รวมถึงผลลัพธ์ของการตกเป็นเหยื่อ และแนวทางการป้องกันการตกเป็นเหยื่อ โดยใช้การวิจัยเชิงคุณภาพ (Qualitative Research) ด้วยวิธีการสัมภาษณ์เชิงลึกจากกลุ่มผู้ให้ข้อมูลสำคัญ 4 กลุ่ม จำนวน 19 คน ประกอบด้วย ผู้เสียหาย ผู้กระทำความผิด เจ้าหน้าที่ที่เกี่ยวข้องกับการดำเนินคดีและกำกับดูแล และผู้ทรงคุณวุฒิที่เกี่ยวข้องกับการโฆษณาผลิตภัณฑ์ด้านความงามบนสื่อออนไลน์ และการวิจัยเชิงปริมาณ (Quantitative Research) โดยเก็บข้อมูลจากผู้เสียหายด้วยแบบสอบถามออนไลน์ จำนวน 27 คน ผลการศึกษาพบว่า ปัญหาที่พบ ได้แก่ ด้านกฎหมาย การบังคับใช้กฎหมาย การชดเชยเยียวยา การควบคุมและกำกับดูแลร้านค้าออนไลน์ การควบคุมความปลอดภัยของสินค้ และการโฆษณาบนสื่อออนไลน์ โดยปัจจัยที่ส่งผลต่อพฤติกรรมการตกเป็นเหยื่อ ได้แก่ ค่านิยมการให้คุณค่าความงาม โอกาสในการตกเป็นเหยื่อ การมีส่วนร่วมของเหยื่อ การพึ่งพาเทคโนโลยีสมัยใหม่และพฤติกรรมของเหยื่อ ทั้งนี้ การพัฒนาแนวทางการป้องกันการตกเป็นเหยื่อในเรื่องนี้ ประกอบด้วย การปรับปรุงอัตราโทษทางกฎหมายเกี่ยวกับเครื่องสำอางให้สอดคล้องกับสถานการณ์ปัจจุบัน การกำกับดูแลเพื่อควบคุมคุณภาพและความปลอดภัยของผลิตภัณฑ์ การบูรณาการความร่วมมือกับหน่วยงานของต่างประเทศในการสืบสวนสอบสวน เป็นต้น

วิทยานิพนธ์เรื่องอาชญากรรมสิ่งแวดล้อม: กรณีศึกษาผลกระทบของการลักลอบนำเข้าขยะอิเล็กทรอนิกส์ในประเทศไทย มีวัตถุประสงค์เพื่อศึกษาสภาพปัญหาและผลกระทบของการลักลอบนำเข้าขยะอิเล็กทรอนิกส์ในประเทศไทย ศึกษาปัจจัยของการลักลอบนำเข้าขยะอิเล็กทรอนิกส์ในประเทศไทยและเสนอแนะแนวทางและมาตรการในการป้องกันและแก้ไขการลักลอบนําเข้าขยะอิเล็กทรอนิกส์ในประเทศไทยให้สอดคล้องกับอนุสัญญาบาเซล (Basel Convention) โดยเป็นการศึกษาเชิงคุณภาพด้วยการวิจัยเชิงเอกสารและการสัมภาษณ์เชิงลึกจากผู้ให้ข้อมูลสำคัญในหน่วยงานภาครัฐบาลและภาคประชาสังคม จำนวน 10 ราย ผลการศึกษาพบว่า สภาพปัญหาการลักลอบนำเข้าขยะอิเล็กทรอนิกส์เริ่มมาจากการที่ประเทศจีนมีประกาศห้ามนำเข้าขยะรีไซเคิลอย่างเด็ดขาดในปี พ.ศ. 2560 และปัญหาการกำจัดขยะอิเล็กทรอนิกส์ที่มีอยู่เดิมของประเทศไทย ทำให้ปริมาณขยะอิเล็กทรอนิกส์ในประเทศไทยมีจำนวนสูงมากขึ้น พบการลักลอบโดยการสำแดงเท็จ การดำเนินการส่วนใหญ่มักยุติที่ชั้นศุลกากรโดยไม่เข้าสู่กระบวนการทางอาญาแม้จะมีกฎหมายระบุไว้ การลักลอบนำเข้าขยะอิเล็กทรอนิกส์จะส่งผลกระทบต่อสิ่งแวดล้อม ระบบนิเวศ สุขภาพ สังคม ชุมชน และเศรษฐกิจของประเทศ สำหรับปัจจัยของการลักลอบนำเข้าขยะอิเล็กทรอนิกส์นั้น มีทั้งหมด 4 ด้าน ได้แก่ ปัจจัยด้านพื้นที่ ปัจจัยด้านการปฏิบัติงานของเจ้าหน้าที่ผู้บังคับใช้กฎหมาย ปัจจัยด้านการบังคับใช้กฎหมาย และปัจจัยด้านความคุ้มค่า ผลการศึกษาแนวทางในการป้องกัน และแก้ไขปัญหาการลักลอบนำเข้าขยะอิเล็กทรอนิกส์มีทั้งหมด 3 ด้าน ได้แก่ ด้านการปฏิบัติงาน และการบูรณาการร่วมกันของหน่วยงานที่เกี่ยวข้อง การปรับปรุงแก้ไขกฎหมาย/นโยบาย/มาตรการ และการบังคับใช้อย่างเคร่งครัด และการสร้างจิตสำนึก และการตระหนักถึงปัญหาสิ่งแวดล้อมให้มากยิ่งขึ้น

การวิจัยเรื่อง การนำกระบวนการยุติธรรมเชิงสมานฉันท์มาใช้ในศาลเยาวชนและครอบครัว : ศึกษาการพัฒนามาตรการพิเศษแทนการดำเนินคดีอาญาชั้นหลังฟ้องคดี มีวัตถุประสงค์เพื่อศึกษาการนำกระบวนการยุติธรรมเชิงสมานฉันท์มาใช้ในกระบวนการยุติธรรมทางอาญาสำหรับเด็กและเยาวชนโดยศาลเยาวชนและครอบครัวผ่านการดำเนินการตามมาตรการพิเศษแทนการดำเนินคดีอาญาชั้นหลังฟ้องคดี ที่ได้นำแนวทางการศึกษาการนำนโยบายไปปฏิบัติมาใช้เป็นแนววิเคราะห์ปัญหาและอุปสรรคผ่านปัจจัยที่มีผลต่อความสำเร็จหรือความล้มเหลวจากขั้นตอนการนำไปปฏิบัติ และศึกษาเปรียบเทียบกับกระบวนการของต่างประเทศ นำไปสู่ข้อเสนอแนะแนวทางการพัฒนาการดำเนินการตามมาตรการพิเศษแทนการดำเนินคดีอาญาชั้นหลังฟ้องคดี เพื่อให้เกิดการพัฒนาและสามารถแก้ไขปัญหาอุปสรรคที่เกิดขึ้นจากการนำไปปฏิบัติโดยศาลเยาวชนและครอบครัวได้ โดยใช้วิธีการวิจัยเชิงคุณภาพ ด้วยการวิจัยเอกสารที่เกี่ยวข้อง การสังเกต การอภิปรายกลุ่ม และการสัมภาษณ์แบบเจาะลึกจากผู้ให้ข้อมูลสำคัญ ให้ได้ข้อมูลเพื่อนำมาวิเคราะห์แบบอุปนัย สร้างข้อสรุปเพื่อตอบคำถามการวิจัย ผลการวิจัยพบว่า การดำเนินการตามมาตรการพิเศษแทนการดำเนินคดีอาญาชั้นหลังฟ้องคดี เป็นทางเลือกหนึ่งแทนกระบวนการทางตุลาการปกติ ซึ่งประยุกต์มาจากงานยุติธรรมเชิงสมานฉันท์ ที่ผู้กระทำสำนึกผิดเข้าสู่กระบวนการของการมีส่วนร่วมจากทุกฝ่ายผ่านการพูดคุย ให้ได้ผลเชิงสมานฉันท์ที่ผู้เสียหายได้รับการชดเชยเยียวยา และผู้กระทำผิดได้แก้ไขบำบัดฟื้นฟูเพื่อกลับคืนสู่สังคมด้วยดี ซึ่งพบปัญหาและอุปสรรคในการปฏิบัติโดยศาลเยาวชนและครอบครัว 5 ประการ คือ ด้านกฎหมาย ด้านคุณภาพและความพอเพียงของทรัพยากร ด้านลักษณะหน่วยงานผู้ปฏิบัติ ด้านการสื่อสารและควบคุมดูแล และด้านสภาพแวดล้อมหรือบริบท โดยสมควรปรับปรุงกฎหมาย จัดสรรทรัพยากร เพิ่มเติมหน่วยงานในองค์กรของผู้นำนโยบายไปปฏิบัติ และติดตามควบคุมดูแล เพื่อแก้ไขบำบัดฟื้นฟูเยาวชนอย่างสมดุลกับการชดเชยเยียวยาความเสียหายที่เกิดจากอาชญากรรมอย่างเหมาะสมกับบริบทของสังคม

As social awareness of the prevalence of sexual violence on university campuses has increased, it is important to understand the role of university policies in providing protection and support for the campus community and people affected by sexual violence. The purpose of this research is to analyze and compare Sexual Violence Policies (SVP) from four Canadian universities. The analysis evaluates the comprehensiveness of the policies and considers how power, and ideas of power are embedded within SVPs. Findings suggest that policies are at times comprehensive, but may be missing important information, such as including an Objectives section in the policies. …

The purpose of the present study was to examine how individual differences in stigma against people who are mentally ill, free will beliefs, just world beliefs, and sentencing goals are associated with attitudes toward the insanity defense. Because there are many misconceptions about what the insanity defense is, and how it is actually used as a sentence, the Not Guilty by Reason of Insanity (NGRI) plea may be underutilized due to public opinions reflecting misunderstanding and/or possible biases (Perlin, 2017). Stalking is one of the main types of abusive behaviour facilitated by technology. The purpose of the current study was twofold: to identify the challenges of cyberstalking investigations and prosecutions in Australia and determine how best to investigate these types of offences. A qualitative analysis of four years of interviews, focus groups and participant observations with police departments provides an overview of the cyberstalking investigative process. The findings map out the process from the initial report of the incident to the preparation of the prosecution brief. In response to the 2012 landmark federal Supreme Court decision, Miller v. This article is a re-analysis of a previous study (please see https://doi.org/10.1080/10911359.2017.1402724). Considering the previous findings, in addition to the recent discussions around criminal justice reform, race, policing, and mental health in the United States, the data were reanalyzed using an updated version of QSR NVivo. The new findings revealed that reintegrating justice-involved African American men back into society requires reentry programs to utilize a different approach. Reentry programs must be constructed under the notion that the process involves multiple interrelated components that interact with larger systems outside the individual or organization's immediate control or organization advocating for them. …

Changes in the policy process is one of the lesser explored phenomena within the field of criminal justice. A basis of knowledge about changes in various criminal justice policy processes in the U.S., could benefit scholars and practitioners alike. This thesis explores changes in content of pretrial release policy (PRP) portfolios in states with the least policy activity both within and across states over time. A thematic content analysis of PRPs from eight U.S. states (Alaska, Arkansas, Idaho, Maine, North Dakota, South Dakota, Vermont, and Wyoming) revealed how PRPs have changed in those states over time. "Although research has shown that students and school personnel believe that adults respond to bullying at different rates, it is unclear why these differences occur. Using open-ended survey responses from 189 students, this study investigates why students perceive that school personnel fail to respond to bullying. Students articulated a variety of reasons for school personnel’s lack of response, including ways in which they could fail to see, notice, or respond to the bullying. In turn, students used their agency to understand and counteract school personnel’s lack of response. Theoretical and policy implications are discussed."
