Currently Accepted Practices That Are Known To Lead To Death, And Pas: Is There An Ethically Relevant Difference?, Thomas A. Cavanaugh

Philosophy

A number of common and generally noncontroversial practices in the care of patients at the end of life lead to their deaths. For example, physicians honor a patient's refusal of medical intervention even when doing so leads to the patient's death. Similarly, with a patient's or surrogate's consent, physicians administer sedatives in order to relieve pain and distress at the end of life, even when it is known that doing so will cause the patient's death. In contemporary U.S. public policy, these practices are accepted as ethical and legal while physician-assisted suicide (PAS) is—for the most part—rejected in current U.S. …

"The Principle Of Punishment Is A Categorical Imperative", Nelson T. Potter Jr. Jan 1998

"The Principle Of Punishment Is A Categorical Imperative", Nelson T. Potter Jr.

Department of Philosophy: Faculty Publications

There has been a considerable renaissance in retributivism as a theory of the justification of punishment in the second half of this century. Retributivism is often defended as if it were a particularly hardy moral intuition, a basic free-standing moral principle that is underivable from any broader theory or set of principles. In this vein it is often "supported" through the presentation of outrageous and horribly cruel crimes, especially against persons, particularly murder, in order to elicit what may be thought to be the natural and appropriate emotional response, a response of anger, indignation, and desire for retribution. Under such …

A Populist Critique Of Direct Democracy, Sherman J. Clark Jan 1998

A Populist Critique Of Direct Democracy, Sherman J. Clark

Articles

It is often assumed that direct democratic processes - referenda and initiatives - offer the people a chance to speak more clearly than is possible through representative processes. Courts, commentators, and political leaders have defended or described direct democratic outcomes as the voice of the "people themselves." Because plebiscites allow the people to speak directly, without the potential distortion inherent in representation, they seem ideally responsive to popular will. Indeed, even critics of direct democracy appear to grant as much. Critics are quick to point out, of course, that actual plebiscites often fall far short of the ideal. Uneven voter …

Cloning People: A Jewish Law Analysis Of The Issues, Michael J. Broyde Jan 1998

Cloning People: A Jewish Law Analysis Of The Issues, Michael J. Broyde

Faculty Articles

This Article is an attempt to create a preliminary and tentative analysis of the technology of cloning from a Jewish law perspective. Like all preliminary analyses, it is designed not to advance a rule that represents itself as definitive normative Jewish law, but rather an attempt to outline some of the issues in the hope that others will focus on the problems and analysis found in this Article and will sharpen or correct that analysis. Such is the way that Jewish law seeks truth.

In the case of cloning-as with all advances in reproductive technology- the Jewish tradition is betwixt …

The Reemergence Of Kantian Ethics: Have We Adequately Responded To Hegel's Objections?, Gwen C. Thompson Nov 1997

The Reemergence Of Kantian Ethics: Have We Adequately Responded To Hegel's Objections?, Gwen C. Thompson

Dissertations and Theses

The philosophies of Kant and Hegel have experienced a renaissance for the past thirty years, and a debate continues as to whether Hegel's objections to Kant's moral philosophy are sound, and/or whether Hegel's ethics are an improvement on Kant's. This debate takes many forms, and most recently, theorists have been interested in measuring Hegel's objections against contemporary theories following in the Kantian tradition. 'Critics,' (theorists defending Hegel's moral point of view) suggests such reconstructed theories leave themselves open to identical criticisms Hegel wielded at Kant almost 200 years ago. 'Defenders,' (theorists supporting Kant's moral philosophy, or a revised version) reply …

Theory And Practice In The Career Of Fernando Henrique Cardoso: Part I, Ibpp Editor Jul 1997

Theory And Practice In The Career Of Fernando Henrique Cardoso: Part I, Ibpp Editor

International Bulletin of Political Psychology

Political psychologists often contemplate the significance of their research--theoretical, empirical--for the practice of politics. Too often, seemingly valuable research is ignored, discounted, misperceived, and misapplied by political practitioners. Yet occasionally researchers practice politics as well--not just the politics of everyday life--but the formal politics of local, regional, national, and international entities. In the United States, Woodrow Wilson, Eugene McCarthy, and even Newt Gingrich come immediately to mind. What will be the interaction of research and practice when both are developed and implemented by the same individual? Dr. Ted Goertzel of Rutgers University has written the following article concerning another researcher-practitioner--Fernando …
