For centuries, the dinar and dirham have been recognized as the most stable and sharia-compliant official trading instruments. In Indonesia, dinars and dirhams may be used with specific qualifications. However, the precedent for arresting scholar Zaim Saidi for organizing a muamalah market using dinar-dirham is a bad practice of punishing innovation in the use of dinar-dirham, which reduces the development of the sharia economy in Indonesia. It is known in the science of jurisprudence that abrogating is a symptom of judgment, and specification/restriction is a symptom of verbal words, but abrogating and restriction share in lifting the injunction, so if the lifting is complete then it is abrogating, and if it is partial it is the specification/restriction. This sharing prompts us to search for differences between them - as there is a need to do so - in order to avoid confusion/mis-interpretation. This article deals with the political considerations behind the emergence of jurisprudence in Muslim traditionso as to protect the text from political exploitation. The study also focuses on Imam Al-Shafi’I’s method of Ijtihad which mainly stands on analogy. We have also discussed the pitfalls of analogy oriented inference with an attempt to widen the scope of analogy, and the purposes of sharia so as to renew the Islamic political thought.
