The central point of Kent Greenawalt's latest book is that the basic principles of liberal democracy do not resolve the question to which liberal democracy has been proposed as the answer. The question concerns how comprehensive accounts of the good - especially religious accounts - fit into public deliberation and decisionmaking in a pluralist society like ours. The left should not be so quick to condemn private arbitration of statutory rights for two primary reasons. First, although these processes have historically been seized by employers as an efficient, less costly alternative to litigation devoid of due process safeguards, there is nothing inherent in private arbitration to prevent making the process fairer for employees. Second, there is a substantial payoff that justifies the work required by those on the left to transform these processes for the betterment of employees. That payoff is greater access to justice. The most important variable in a decision making situation is the role of information. On the strength of information received, choice between competing alternatives is made. One decision making situation that receives intense scrutiny, and is a subject of much debate is the passage of bills into laws. Legislative decisions are arrived at in a highly charged political environment. This paper explores the role of information and informants in the legislators' institutional and environmental arena, and the personal characteristics of the legislators that influence the decision making process.

This Essay is divided into five Parts. Part I sets the stage for the historical debate by evaluating the text of the Qualifications Clauses as well as the limited evidence of what the Framers and the ratifiers thought about these provisions. Part II shows that many states, immediately after the federal Constitution was ratified, behaved as though the Qualifications Clauses did not prevent them from adding qualifications for congressional office-holding. Part III compares this early evidence of state behavior with a debate in Congress after the Civil War concerning the meaning of the Qualifications Clauses. Part IV returns to the …

Stephen B. Presser: Recapturing the Constitution: Race, Religion, and Abortion Reconsidered. (Washington, DC: Regnery Publishing, 1994. Pp. xiv, 398. $24.95.)

With Recapturing the Constitution Steven Presser has launched a heat-seeking missile. It is, he confesses without contrition, "politically incorrect," "the same sort of exercise Allan Bloom was attempting in Closing of the American Mind" (pp. 12, 11). Presser aims to diagnose what ails our constitutional law as Bloom did our universities and culture. Presser argues that constitutional law is very sick indeed, and that it threatens to kill our body politic.

In the midst of this morally charged situation might not Christian congregations hear again the call to a public vocation? As we ponder this prospect, two questions will guide our inquiry. First, where might Christian congregations locate a space in which they might attend to the public moral meaning of everyday rage? That public space, which we will explore, is “civil society.” Second, how can this public space of civil society be accessed so that its moral possibilities can be maximized?
