The empirical legal studies movement, or ELS, is positioned to provide an important scholarly impact. As noted ELS scholar Theodore Eisenberg once put it, “[a]cross a broad range of legal issues, empirical studies can inform policymakers and the public. Legally trained social scientists have unique opportunities to enhance description and understanding of the legal system.” By all accounts, this influence is well underway. ELS scholarship has been present in law schools since at least the 1920s and is on the rise in recent years, with important empirical insights gained into legal subjects such as error rates in capital punishment convictions, …

The political prison camps of North Korea are blatant violations of human rights within the state. They have recently received international attention within the United Nations General Assembly and the United Nations Security Council. This paper examines these political prison camps through Kenneth Waltz’s levels of analysis in order to better understand the existence of these camps.

Research related to extractive industries has grown significantly over the last decade. As the commodities boom appears to be winding down, this essay outlines areas for potential future research. Emphasis is placed on the need for research on: the relationships among extractivism, climate change and societal transitions; the aggregate effects of the commodity boom on the environment, on societal structures, on elite formation and on cultural politics; the implications of resource extraction on the couplings of space and power at different scales and with particular reference to the Colombian peace process; and the gendered and generation dimensions of the effects …

Indonesia’s democratization resulted in a uniqueness in party development. After the 2009 elections, new political party species which previously not represented and appears in western democracies, was raised. This article investigates the correlation between political pragmatism with adaptive party change in the electoral contest as well as in the parliament following the election. An important finding of this study is the emergence of species of match-all party that exist in pragmatic political conditions. This paper aims to elaborate the increase of political kinship phenomenon in South Sulawesi, especially from the perspective of political legacy of a candidate from parti¬cular political family. Utilizing a qualitative research method, the paper reveals that in kinship politics, interest in politics is transferred through political discussions within family, activities in political parties and social organizations. Israel as a state has been existing for almost 70 years. Despite of decades of its pres¬ence, the foundation and its struggle for survival and acknowledgement have been constantly challenged including from its own supposedly the backbone of its Israel national identity: intellectuals. This paper argues that the critics from some of Jew¬ish intellectuals represent the fundamental problem of the effort to build a national identity. This paper discusses the politics of policy making behind the signing of the parliamen¬tary institutional arrangement law (UU MD3 2014) from new institutionalism approach. The policy incites controversy over domination of one coalition over the other and the future of legislative-executive inter-institutional relations. This study argues that in the policy making, the drive for power domination in the parliament and the dynamics of contestation in the presidential election strongly affected its process. This article tries to address the problem of a corrupt and broken electoral system that has been captured by special interests through big money spending in political campaigns, while at the same time preserving the spirit of the Free Speech Clause of our Constitution. In doing so, this article first reviews and summarizes the different alternatives proposed as potential fixes for the campaign finance problem. It then explains why none of the proposed alternatives can accomplish the dual goals set out above. This is an article written for a symposium on Joel Trachtman’s book, The Future of International Law. I first deal with the contractarian features of Trachtman’s approach to understanding international law. Using the tools of new institutional economics and constitutional economics, Trachtman seeks to describe the features of an international legal system. This is positive political theory or at least relates substantially to the methods of positive political theory. I explore a different approach, one connecting to normative political theory. In its ambitious sense, my approach would see international law as a form of moral argument, but in its modest …

This Article examines the inefficiencies of Missouri municipal courts that came into sharp focus following the killing of Michael Brown by Officer Darren Wilson in Ferguson, Missouri. Norwood details and expands on her lone dissent in the Final Report of the Municipal Division Work Group—a group created by the Missouri Supreme Court to address the alleged abuses of black and poor residents in Missouri. Norwood argues for consolidating failing municipal courts to create larger, more functional, and just courts.

The recent policies of former Iraqi Prime Minister Nouri al-Maliki, combined with the collapse of the Syrian state in 2011, created conditions that led to the rise of the Islamic State of Iraq and Syria, or “ISIS.” As of November 2014, ISIS controls large areas of western and northern Iraq and northern and eastern Syria, an area roughly the size of Belgium. This thesis evaluates the effects of compulsory military service in South Korea on the political behavior of men from a public policy standpoint. I take an institutional point of view on conscription, in that conscription forces the military to accept individuals with minimal screening. Given the distinct set of values embodied by the military, I hypothesize that the military would need a powerful, comprehensive, and fast program of indoctrination to re-socialize civilians into military uniform, trustable enough to be entrusted with a gun or a confidential document. This senior thesis is a study of federal forestry policy in Oregon and its effects on rural communities and the urban-rural division in the state. Looking specifically at the “Timber Wars” of the early 1990s, it delves deeper into the controversy over the protection of the northern spotted owl, the Northwest Forest Plan, and President Clinton’s efforts to solve the conflict between grassroots environmental activists and those with a vested interest in the timber industry. This thesis provides a comparative analysis of the environmental values present in Ghana’s and Senegal’s coastal regions, and the implications that those have for the surrounding environment. The countries approaches to urban farming, mining and oil and gas extraction, fishing, marine debris and municipal waste management are assessed in order to reach a greater understanding of these environmental issues. Early in her Prime Ministership, Margaret Thatcher fought an unlikely diversionary war far from home for the ownership of the Falkland Islands. The Islands lie off of Argentina’s coast about 8,000 miles from London, but have been subject to Britain’s rule since 1836. In April 1982, hoping to distract from domestic political and economic turmoil, Argentina’s military dictatorship ordered a surprise invasion of the Islands. Thatcher, Britain’s first female Prime Minister, responded in full force. By early May, a British fleet reached the Islands. This thesis is a review of U.S. foreign policy in Pakistan through a realist lens. It critiques the current state of U.S. policy and recommends that the United States prioritize national security interests, particularly with regards to counterterrorism, over building Pakistani democracy and running civilian aid programs. It then further recommends ways for the United States government to account for ground level dynamics in Pakistani politics in crafting foreign policy aimed at bringing Pakistan into line with U.S. counterterrorism priorities.

This senior thesis is a study of international funding bodies in the case of Northern Ireland peace process. I examine the role of the European Union PEACE Fund and International Fund for Ireland. Particularly, I focus on creating, structuring, and maintaining these funds and their impact the local community. Why has the United States, given its status as the sole remaining superpower following its Cold War victory, been unable to translate its preponderance of power into the outcomes it desires? The system established by the United States over the course of the Cold War does not effectively translate its power into influence in the post-Cold War world.
