The Scholar: St. Mary's Law Review on Race and Social Justice

For the purposes of legislative redistricting, Texas counts prison populations at the address of the prison in which they are incarcerated at the time of the census, rather than their home prior to incarceration—regardless of whether the prisoners themselves maintain a residence in their home communities and intend to return home after incarceration. This deprives those home communities of full representation in the redistricting process. Combined with Texas’s felon disenfranchisement laws, this also results in arbitrarily bolstering the representational power of some Texans on the backs of other Texans who themselves are unable to vote. “What would I do if I wasn’t given freedom? I would protest every day.” This illustrates the empathy that locals in Lesbos shared with the struggles of refugees when the European Refugee Crisis arrived on the shores of Lesbos in 2015. Locals on the island helped refugees get off boats—or saved them from the water—and offered to take them to the city center to claim asylum. But soon, with the arrival of humanitarian aid organizations, life on Lesbos changed considerably. Meanwhile, refugees continue to sit in camps that are over capacity to await asylum processing. OBJECTIVES: The aim of this paper is to analyse Baltic security developments from U.S. government and military resources, scholarly journal articles, and multinational public policy research institute assessments. METHODS: The aim is to analyse the content and rhetoric within these resources to learn how those producing these materials view Baltic security developments and their viewpoints on how the U.S. and its allies should respond to these developments focusing on increasing Russian regional assertiveness. The purpose of this study was to explore how secondary students interpret the classroom culture that preservice social studies teachers create during their student teaching semester. This question was answered by examining results of a survey of secondary social studies students that allowed them to evaluate the classroom culture their social studies preservice teacher created. A Student Perception Survey was used for the study, which loaded four main indicators of classroom culture. Through descriptive statistical analysis of the survey results, this study found that secondary social studies students believed their preservice teachers were most adept at creating a student-centered classroom, …

The history of the transatlantic slave trade and the holocaust is a history of different cultures, which explains the diverse and growing efforts to remember these phenomena. This paper compared how the transatlantic slave trade and holocaust are embraced through memory culture, specifically looking at monuments available in Germany and Ghana to represent them, how they are taught in schools and whether they are being discussed. To do this various holocaust and slave trade sites were visited within Ghana and Germany to illicit how these monuments help people to learn about, and embrace these events. The C3 Framework by the National Council for the Social Studies (NCSS) has placed an emphasis on elementary social studies teachers strengthening their students’ content-area literacy skills. One tool that can be paired with primary sources to accomplish this goal is wordless picture books. In this article, we discuss a one week project where a fourth grade teacher used primary sources and wordless picture books to explore the Fugitive Slave Act of the 19^th century. This dissertation explores the question of whether recurring episodes of violence, forced displacement, and other forms of repression against the ethno-religious sub-nationalist identity group, the Rohingya, across Burma's (Myanmar) modern history, are rooted in the implications of post-colonial nation-building or represent independent and self-contained incidents of communal/ethnic violence. The sub-question of whether the modern construct of the Burmese state accurately fits the description of a modern nation-state or whether other paradigms or ideal types better capture the development of the post-colonial Burmese state, is also explored. Yet, while Justice Ginsburg’s image and story has reached an unprecedented level of valorization and even commercialization, scholars have yet to give sustained attention to the phenomenon and to contextualize it: why has this idolization emerged within this context, and what is its impact? Community policing is touted as the solution to fostering restoration between communities and policing agencies across the United States. However, this remains a widely unregulated policy area where minimal assessments of available data exist on the effectiveness of community policing reform. Given the nature of police brutality and the struggles of policing agencies across the United States there is increasing need to measure outcomes. This research finds that community policing does serve as a proactive tool for crime rate reduction and prevention.

Democracy Unchained: Contractualism, Individualism, And Independence In Buchanan’S Democratic Theory, John Thrasher

Contrary to the claims of some of his critics, James Buchanan was an ardent democrat. I argue that Buchanan’s conception of democratic governance organized by a contractually justified constitution is highly distinctive because of his commitment to a strong conception of individualism. For Buchanan, democracy is neither justified instrumentally—by the goods it generates—nor by reference to some antecedent conception of justice. Instead, democracy is the only political option for a society that takes individualism seriously. One implication of this view is that democracies can only be limited by the rules they collectively give themselves in the form of constitutions. I …

Finding aid and scan (Click on "Additional Files" below) for Manuscripts Small Collection 3470. Letter, 25 October 1920, of Kentucky Governor Edwin P. Morrow to Sim Smith, Albany, Kentucky. Written on letterhead of the Republican State Central Committee, the letter declares that the upcoming election in Kentucky “hangs by a thread” and will be won “if the mountain women come to the polls.” The letter pleads for efforts “above all” to “fire every man so that he will bring his women out” in order to thwart the stated intention in the Bluegrass of outvoting this constituency.

The article examines the recent U.S.-Taliban agreement reached in Doha, which aims to initiate a phased withdrawal of American and NATO troops from Afghanistan and pave the way for peace negotiations between the Taliban and the Afghan government. Despite the historic nature of the agreement, there are significant concerns about its effectiveness in ending the long-running conflict. The Taliban have stated they will continue their fight against the Afghan government, raising doubts about lasting peace. Pliny the Elder's Historia Naturalis, written in the 70s CE and perhaps left unfinished at its author's death in 79, is among the largest documents to have survived down to us from antiquity. It comprises some thirty-seven books on a breadth of topics about the natural world, and man's interaction with the world and marshalling of its resources. The work has often been referred to as the world's first encyclopedia. The vast majority of literature on the use of contraception focuses on its frequently documented connection to socioeconomic development. Thus, contraception has become a favored programmatic element of western organizations that deliver it to women in the developing world. I analyze discourse from transnational organizations that advocate for women’s use of birth control in the developing world, as well as deliver contraceptive services themselves, in order to uncover the dominance of liberal, capitalist assumptions therein. Reservations have long formed a fundamental tenet of affirmative action in India. Quotas for representation of various disadvantaged groups proliferate across public educational institutions and government jobs. However, elections to public office have largely escaped such quotas, except those that are caste-based. A shift in this status quo occurred in 1992 with the establishment of the Panchayati Raj system of grassroots governance. 34% of all seats under Panchayati Raj Institutions (PRIs) were to be reserved for women under the 73rd amendment. Another constitutional amendment passed in September 2009 increased PRI quotas for women to 50%. This paper seeks to examine …

The decision to declare a district for a specific cause is a critical policy decision; making an area an official office park or designated cultural site means it will attract specific types of residents and businesses and require specific amenities. This paper reviews the impact of designating a cultural district as a place-based policy, specifically by developing a measure of neighborhood stability and applying a stress test of neighborhood stability in cultural districts during the Great Recession. The model underpining the neighborhood stability measure is an optimal stopping time model which frames neighborhood rents as a Brownian motion with drift. …
