Environmental Regulation And The Constitution, James E. Krier Jan 1985

Environmental Regulation And The Constitution, James E. Krier

Book Chapters

Indirectly, at least, the Constitution provides the federal government with power to regulate on behalf of environ-mental quality, but it also sets limits on the power. It sets limits, likewise, on the regulatory power of the states. What it does not do, at present, is grant the ‘‘constitutional right to a clean environment’’ so avidly sought in the hey-day of environmental concern, the decade of the 1970s. Thus, the one unique aspect of the general topic consid-ered here has no doctrinal standing; the remaining aspects are matters of doctrine, but they are not unique to envi-ronmental regulation. It is quite …

A National Survey Of Private Crime Commissions, Vincent J. Webb, Dennis Hoffman

Privatization is one of the most significant emerging issues in public administration. Studies of the phenomenon in the area of criminal justice have concentrated on greater private sector involvement in corrections (e.g., Camp and Camp, 1984; Mullen, Chabotar and Carrow, 1984) and policing (e.g., Shearing and Stenning, 1981).

The Demography Of New England: Policy Issues For The Balance Of This Century, George S. Masnick Jan 1985

The Demography Of New England: Policy Issues For The Balance Of This Century, George S. Masnick

New England Journal of Public Policy

New England's rapidly aging population, its traditionally low fertility rate, and the fact that net migration from other regions and abroad should continue to be close to zero means that only very slow population growth will characterize the region for the balance of this century. Nevertheless, New England's demographic metabolism is exceptionally dynamic: (1) the numbers of different age groups are growing at very different rates; (2) a redistribution of population is occurring from the southern to northern tier states; (3) within each state population is dispersing into non-metropolitan areas; and (4) metropolitan areas, both central and suburban, are quickly …

Private Banks And Public Money: An Analysis Of The Design And Implementation Of The Massachusetts Linked Deposit Program, James T. Campen

McCormack Graduate School General Publications (active until 2013)

In March 1978, in accordance with the unanimous recommendations of two special commissions, the Treasurer of Massachusetts established a "linked deposit program." Under the terms of this program, a portion of the approximately $400 million available for short-term investment from the state's General Fund was to be deposited with in-state banks and thrift institutions, selected on the basis of their performance in promoting the economic and social welfare of Massachusetts citizens and communities through their lending and related activities.

Six years after its inception, the Massachusetts linked deposit program (LDP) has grown to become a sizable and stable part of …

The Development Of Elementary And Secondary Education Policy In The Minnesota Legislature, Joyce Krupey, Gene Mammenga Jan 1985

The Development Of Elementary And Secondary Education Policy In The Minnesota Legislature, Joyce Krupey, Gene Mammenga

Journal of the Minnesota Academy of Science

This discussion of the political climate in which elementary and secondary education is funded in Minnesota begins with the Minnesota Miracle of 1971. In each successive legislative session some adjustments have been made in this formula. In this paper we describe the various lobbying groups that try to affect education legislation. We also discuss the role played by the governor, key legislators, legislative and Department of Education staff, the State Board of Education, and the commissioner of education in educational policy formation. In conclusion, we summarize major formula changes since 1971 and review the many education-related issues before the legislature …

Editor's Note, Padraig O'Malley Jan 1985

Editor's Note, Padraig O'Malley

New England Journal of Public Policy

Over the years, public policy issues have proliferated, and with proliferation has come the inevitable specialization. The result: fragmentation of effort and problems of communication not only between those who make policy and those who implement it, but between practitioners in general and the academic and research disciplines that complement them. Public policy constituencies have created their own languages, but too often the result is a confusion of tongues rather than a profusion of ideas.

The New England Journal of Public Policy is designed to create a profusion of ideas by providing a medium for practitioners, policy analysts, and academics …

Public Education In Boston, Joseph M. Cronin Jan 1985

Public Education In Boston, Joseph M. Cronin

New England Journal of Public Policy

Historically, Boston schools have been a source of pride and educational innovation, yet they have also been fraught with problems that are typical of urban education. Both the success achieved and the problems encountered in Boston schools bear analysis. In looking at such areas as overall quality of education, funding, and compliance with federal guidelines, specific recommendations for the future of public education in Boston can be offered. In addition, the impact of Boston's success or failure in implementing new ideas through the school committee and the mayor is not limited to the city itself. This article' s outlining of …

Student Rights: U.S. Supreme Court Cases-- Their Implications For And Implementation In Washington Schools, Angela Dawn Ramsey

All Master's Theses

The relationship between national litigation and state legislation was studied. Seven areas of student rights were used in categorizing Washington State's educational laws and policies, and twenty-three precedent-setting United States Supreme Court cases. The results showed support for the hypothesis that national litigation impacts state legislation in educational policy-making. Implications for and impact that this has upon the future are discussed.

Seabrook: A Case Study In Mismanagement, Irvin C. Bupp Jan 1985

Seabrook: A Case Study In Mismanagement, Irvin C. Bupp

New England Journal of Public Policy

The Seabrook nuclear power plant construction project is an unqualified financial disaster. It simultaneously threatens its chief owner, the Public Service Co. of New Hampshire (PSNH) with bankruptcy and the company's electricity customers with huge rate increases. The fifteen-year history of the project is reviewed to identify "what went wrong?"

The review suggests that the basic problem has been mismanagement by both PSNH and by government regulators. A three-year regulatory imbroglio over the environmental effects of the plant's cooling system was extremely costly in the mid-1970s.

By the time this problem was belatedly resolved, the project had begun to outstrip …

The New England Economic Revitalization And Future Research Priorities, James M. Howell Jan 1985

The New England Economic Revitalization And Future Research Priorities, James M. Howell

New England Journal of Public Policy

New England's recent economic revitalization is largely attributed to the region's success in technological innovation and adaptation. This capacity to supplant older, maturing technologies with new technologies — a willingness to continually shed the old to make room for the new — has been a characteristic of New England since the early nineteenth century. At that time, as today, the critical factors in the process of technological development were the presence of investment capital, skilled labor, entrepreneurs, and, above all, preeminent colleges and universities that foster unconventional thinking and risk-taking. While the region's economy should continue to benefit from these …

Job Satisfaction And Job Performance: A Meta-Analysis, Michelle Iaffaldano [Graef], Paul M. Muchinsky Jan 1985

Job Satisfaction And Job Performance: A Meta-Analysis, Michelle Iaffaldano [Graef], Paul M. Muchinsky

Center on Children, Families, and the Law: Faculty Publications

The assumption that job satisfaction and job performance are related has much intuitive appeal, despite the fact that reviewers of this literature have concluded there is no strong pervasive relation between these two variables. The present meta-analytic study demonstrates that (a) the best estimate of the true population correlation between satisfaction and performance is relatively low (.17); (b) much of the variability in results obtained in previous research has been due to the use of small sample sizes, whereas unreliable measurement of the satisfaction and performance constructs has contributed relatively little to this observed variability in correlations; and (c) nine …
