Despite the imposition of increasingly substantial fines and recently successful efforts to impose individual liability on corporate executives under the Park doctrine, punishing pharmaceutical companies and their executives for unlawful promotional activities has not been as successful in achieving compliance with the Federal Food, Drug, and Cosmetic Act (FD&C Act) as the protection of the public health demands. Over the past decade, the Food and Drug Administration (FDA) and the Department of Justice (DOJ) have shifted their focus from correction and compliance to a more punitive model when it comes to allegedly unlawful promotion of pharmaceuticals. The dramatic increase in investment by Chinese SOEs in overseas oil assets is primarily driven by energy security concerns. Whether such investment will benefit or harm energy security of other countries is hotly contested. On one hand, this investment can supplement the overall lack of investment in the sector, benefiting all consumers. On the other hand, it may exacerbate environmental and political problems associated with fossil fuels.

A basic theoretical challenge for third sector scholars today is to speak in general and consistent terms about the institutional and normative orders forming outside households, markets and governments in numerous countries, regions and urban centers everywhere. The third sectors of the world have formed in light of a range of distinctive local conditions, including history, culture, law and other factors. A growing international group of scholars has produced a convincing, although limited and partial model of the third sector based in the linked concepts of nonprofit organization, nonprofit sector and non-distribution constraints. Leading Economic Indicator Reports

The Leading Economic Indicator – Nebraska (LEI-N) grew by just 0.09% during September 2012. The increase in the LEI-N, which predicts economic growth in the state six months in the future, was quite weak, but did follow two months of solid increase in July and August. The continued expansion of the LEI-N, however slight, confirms that the Nebraska economy will grow moderately at the end of 2012 and early 2013. A primary reason for the slight improvement in the LEI-N was a solid increase in single-family building permits, suggesting continued improvement in the Nebraska housing market. The International Financial Reporting Standards (IFRS) is pending a move to incorporate a single set of accounting standards across International borders. The definitive decision for uniting the standards appears to be stalemated. The pending move by the United States to adopt financial reporting practices set forth by the IFRS to encompass a single set of reporting standards bears both advantages and disadvantages for multinational corporations. This paper examines some of the difficulties that can arise by using a single set of standards and addresses two significant studies regarding converging reporting standards. THE PROBLEM. The research required an investigation into and an assessment of selected risk exposures of multinational companies headquartered in the United States and Hong Kong which have engaged in or planned to participate in joint ventures within the special economic areas or mainstream economy of China.

THE METHOD. A data sample of forty-five companies (twenty-two in Hong Kong and twenty-three in the United States) was obtained from a population of 187 published listings of parent companies with verifiable joint ventures. A questionnaire was mailed to top-level corporate managers responsible for or vitally involved in the joint venture investment decision. …

The American sovereign debt components were analyzed in the context of their present and future implications to worldwide capital markets. Rare earth minerals contain unique chemical and physical properties such as lanthanum, are found in small concentrations, need extensive precise processes to separate, and are critical components of modern technologies such as laser guidance systems, personal electronics such as Blackberries, and satellites. The U.S. has some rare earth resources, but is heavily dependent on access to them from from Afghanistan, Bolivia, and China. The Curacao North Sea Jazz Festival (CNSJF) attracted during the past three annual festivals 12,542 tourists, generated nearly US$22 million in direct spending due to the festival and had a total contribution of nearly US$40 million to the Curacao economy. These unprecedented results are even more significant considering the unique funding source of this festival, which is backed by a private investment source. Private investments in festival production are a financial funding source that is not common in the event industry, especially when considering the significant economic benefits the CNSJF has generated for Curacao. A Grouping Analysis For The Similarity Of Ship Fleet Composition Among Leading Container Carriers, Hua-An Lu

Tonnage supply of the liner shipping industry is highly concentrated and continuously growing. Carriers provide ship capacities by various fleet composition strategies for coping with their service networks. This paper explores the similarity of fleet supply among the top 20 global liner carriers in terms of data gathered at the beginning of 2008. A scatter analysis is applied to simply show the difference in two-dimensional elements. This research also attempts to group these carriers with cluster analysis by appending more attributes concerned with fleet composition. Results reveal that MSC, Evergreen, COSCO, CSCL, and Yang Ming always form a firm cluster …

Effectively Measuring Student Leadership, Barry Z. Posner

Management & Entrepreneurship

With a worldwide sample of students (N = 77, 387), this paper reviews and analyses the psychometric properties of the Student Leadership Practices Inventory [1]. Modest to strong internal reliability coefficients are found across a number of different dimensions. Predictive validity of the instrument is supported, with the instrument being able to differentiate between effective and ineffective leaders using both self-reported and observer (constituent) data. Few significant differences are found on the basis of respondent gender, ethnicity, nationality, or institutional level (high school versus college). Implications for developing student leaders and future research are offered.
