تأتي هذه الدراسة لتتحدث عن شخصية جدلية مهمة ومن كبار الفلاسفة اليهود الذين ظهروا في القرون الوسطى، وعاش في كنف الإسلام وهو موسى بن ميمون والذي يعتبره اليهود من كبار علمائهم ومفكريهم، ولكن الدراس لفكر موسى بن ميمون يجد أنه تأثر بعلماء الإسلام وفلاسفته ومن أكثرهم ابن رشد الذي تتلمذ على يديه، وسأحاول في هذه الدراسة أن أثبت أن قواعد الإيمان التي ذكرها ابن ميمون في كتابه: "سراج الدارسين" كانت في معظمها مستمدة من الفكر والفلاسفة الإسلامية وأن كثير من هذه القواعد خالفت أصول اليهود في التوراة والتلمود، فسيقوم الباحث بذكر القاعدة ثم ذكر أقوال العلماء المسلمين الموافقة لها؛ …

إنّ أحكام ديون الميت وحقوق دائنيه من المسائل المهمة في أيامنا هذه؛ فموضوعات الحق والميراث والديون من الموضوعات التي أشغلت الحيز الأكبر من جهد الفقهاء والعلماء ورجال القضاء والقانون، حيث يُعد موضوع قضاء ديون الميت من الأهمية، وجعل ترتيبه في المرتبة الثانية من الحقوق الثابتة بالموت.

This article critically analyzes the dominant opinion prevailing regarding the foundation of Islamic jurisprudence (uṣūl al-fiqh) which states that absolute independent juristic interpretation (al-ijtihād al-muṭlaq al-mustaqill) is no longer possible. Therefore, based on the belief that this level of interpretation requires the creation of a unique method for deriving legal rules (istinbāṭ), a method that arguably ended with the founders of the primary schools of law. This research inspects a new interpretive method which was not developed by late scholars. The English Court of Appeal in Beximco v. Shamil Bank chose to apply only English law in a breach of contract case, even though the choice of law clause in the contract at issue also selected Islamic law. The court cited three main reasons for this decision. Studies the threefold hierarchy of certainty, from its origins in Mahāyāna Buddhism, through Islam, to 17^th century China. This tripartite scheme may be traced back to the ancient Buddhist scheme of the threefold wisdom as systematized by Vasubandhu of Gandhāra in the 4th-5th centuries CE. The British Mandate’s actions of state-building in Palestine were informed by a Zionist-Western modernist envisioned past of Palestine. This state-building ideology was embedded within much of the bureaucracy of the Mandate’s system and infringed on numerous Palestinian institutions such as Waqf. Waqf was disenfranchised in particular through the implementation of urban development programs, like town planning and archaeological regimes, which sought to support the British-Zionist recasting of Palestine.

يتحدث البحث عن الاختلاف العقدي تأسيسا لفقهه وتأكيدا على أن الاختلاف في فروع العقيدة شأنه شأن الاختلاف الفقهي؛ إذ ليست كل مسائل العقيدة من باب القطعيات التي لا يصوغ فيها الاختلاف. وبيّن البحث أن للاختلاف العقدي أسبابه الموضوعية. كما قد عرض إلى آثار الاختلاف، وبيّن سبل علاج الاختلاف حتى لا يتحول الاختلاف المقبول إلى خلاف مرذول.

ملخص

إن صلاحية الإسلام لكل زمان ومكان يوجب على حملة العلم الشرعي والتربوي وأصحاب الاختصاص إيجاد الحلول ووضع الضوابط لكل مشكلة تظهر في حياة الناس، ومحاولة تلمس المنهج الشرعي التربوي في معالجة كل ما هو حادث وجديد.

وكان مما ظهر في زماننا نتيجة تسارع الأحداث وانتشار وسائل التواصل الاجتماعي تداول الأخبار ونقلها دون التثبت منها.
