Effect Of Religious Legislation On Religious Behavior: The Ramadan Fast, Hannah M. Ridge

Political Science Faculty Articles and Research

State laws compelling citizens to comply with elements of religious law – also known as religious legislation – are globally pervasive. Previous research has well documented the incidence of myriad examples of religious legislation. These laws’ practical effect on citizens’ behavior, however, has been less examined. This article looks at the effect of one piece of religious legislation: state laws enforcing the Ramadan fast. It demonstrates that the use of state power to sanction violations of religious law significantly increases citizens’ compliance with this religious law.

Maqāsid al-Shariʿah has been typically defined as the objectives behind the Islamic rulings or the Shariʿah higher intent. This knowledge is very important for the mujtahids and Islamic scholars not only to understand or interpret the Shariʿah legal texts, but also to deduce solutions for contemporary problems faced by Muslims. Maqāsid al-Shariʿah is traditionally divided into three levels of necessity, which are necessities (al-Ḍaruriyyāt), needs (al-Ḥajiyyāt), and luxuries (al-Taḥsiniyyāt). Some Muslim immigrants in the United States have difficulty reconciling American free speech rights with the blasphemy component of Islamic law, which often requires death for those who criticize Islam. Little academic literature addresses reconciliation of Islamic beliefs with the Constitutional right to free speech or information on Muslim political participation regarding free speech. Using policy feedback theory as the foundation, the purpose of this phenomenological study was to understand the experiences of Muslim immigrants who practice Islam in a free speech society. There is a lack of research on the relationship between dehumanization of minority religious groups and affiliation with terrorism, which suggests a need to consider the consequences of dehumanization perceptions beyond promoting aggression. This qualitative case study addresses whether dehumanization embedded in public policies influences Muslim Americans 18 to 25 years of age, native and nonnative, to engage in homegrown terrorism. Using Schneider and Ingram’s social constructions of target populations as the foundation, research questions focused on how perceptions of mechanistic dehumanization in policy design influence homegrown terrorism among Muslim- American adults. This paper examines the tropes through which the Hindi (Bollywood) historical films Bajirao Mastani (2015) and Padmaavat (2018) create idealised pasts on screen that speak to Hindu nationalist politics of present-day India. Bajirao Mastani is based on a popular tale of love, between Bajirao I (1700-1740), a powerful Brahmin general, and Mastani, daughter of a Hindu king and his Iranian mistress. The relationship was socially disapproved because of Mastani`s mixed parentage. The film distorts India`s pluralistic heritage by idealising Bajirao as an embodiment of Hindu nationalism and portraying Islam as inimical to Hinduism. Padmaavat is a film about a legendary …

This research investigated a model of the effect of information literacy, media literacy, moral literacy, and learning & thinking skills as the construct of e-literacy maturity level through information behavior (IB) on prophetic-liberation communication behavior (P-LCB). The model was constructed based on social cognitive theory (SCT) and uses and gratifications theory (UGT). P-LCB is an applied model of ethical values in the Qur’an that liberates humans from social injustice and misuse of information and communication technology. With the end of the Second World War, Yugoslavia became a de facto communist country. One of the policies of the new communist regime was to relegate religion entirely to the private sphere and to reduce the influence of religious communities in the public sphere. As a number of its legacies were expropriated, the Islamic Community of Yugoslavia was in need of new sources of funding. This research tackles the issue of interior interpretation and attempts to show its influence on doctrinal sects in the Islamic world. The research shows the sources of interior interpretation (Greek, Jewish and Christian sources) and the way it sneaked into doctrinal sects in the Islamic world (Ibn Saba', fanatic Sufi and Khawarij). Examples of interior interpretation from some sects (Isma'iliyyah and Nusayriyyah) are presented. The danger of these interpretations is highlighted by showing that the interior way employed to from inside destroy the Islamic doctrine and legislation.
