"Flaw-Backs:" Executive Compensation Clawbacks And Their Costly Flaw, Connor Douglas Maag

The Journal of Business, Entrepreneurship & the Law

Saving money should not be expensive. Compensation “clawbacks” are a legal mechanism for companies to reclaim employee compensation, but the legislative framework is complex and disorganized. There are four primary federal claw-back provisions: Sarbanes-Oxley § 304, Dodd-Frank § 954, 12 U.S.C.A. § 5221(TARP), and Dodd-Frank § 956—as well as voluntary contractual clawback policies. This comment untangles the web of clawback legislation by overlaying each clawback mechanism to extract a single, clear, and concise description of executive compensation clawbacks, called the “Comprehensive Clawback Coverage.” The Comprehensive Clawback Coverage reveals a major flaw in the legal and regulatory framework: clawbacks increase agency …

Two years ago, when Scott Thompson took over tech startup Tuition.io as chief executive officer in 2016, he felt as though he had to educate his clients about his product — a new benefit, managed by his software company that allows employers to help their employees repay their student loans.

Today, he doesn’t feel that need. When he recently walked into a Fortune 20 company with a stack of documents, his prospective clients said they understood his pitch and hardly required the introductory material. “I don’t evangelize anymore. We very rarely educate any longer,” Thompson said.

No More “Magic Aprons”: Longitudinal Assessment And Continuous Improvement Of Customer Service At The University Of North Dakota Libraries, Karlene T. Clark, Stephanie R. Walker

The University of North Dakota (UND) Libraries have developed a multi-award winning Customer Service Program (CSP) involving longitudinal assessment and continuous improvement. The CSP consists of iterative training modules; constant reinforcement of Customer Service Principles with multiple communication strategies and tools, and incentives that boost morale and foster not only compliance, but initiative-taking and innovation. The CSP became a widely adopted part of campus-wide assessment, beyond the libraries. Subsequent presentations at conferences led to multiple requests and implementation at other libraries.

The purpose of this study was to examine the relationships between engagement, job satisfaction, job burnout, and turnover intention as provided by higher education student services employees. This study addressed the gap in the literature: the lack of information regarding the experiences, attitudes, and perceptions of student services employees and examined the relationships among employee engagement, job satisfaction, job burnout, turnover intention by analyzing the responses received from members of the electronically mailed (e-mail) survey that contains a combination of three main survey instruments to review employee engagement, job burnout, job satisfaction, and turnover intention.

Unethical pro-organizational behavior (UPB) is concerned with employees’ engagement in unethical conduct for the benefit of the organization that is immoral and/or illegal. In August 2010, thousands of people across the United States were poisoned by eating eggs unknowingly tainted with Salmonella enteritidis bacteria. Following a lengthy investigation, the owners of the facility where the outbreak began were sentenced to three months in prison. This is not a one-off case; poor food safety practices are responsible for several outbreaks and often end in incarceration. Filthy hen houses, diseased fruit storage, and negligent food processing may be the last thing we want to imagine, but these practices have much to teach today's food producers. Rising costs and competition for entry-level employment increasingly call into question the value of a university degree. Now more than ever, career counselors must identify key factors that enhance employability for graduating seniors. Existing research shows professional experience is vital to securing quality postgraduate employment but offers little insight into ways perceived value varies by experience characteristics. This study surveyed value perceptions of more than 600 U.S. hiring managers. Results revealed a significant preference for hiring undergraduates with off-campus professional experience relevant to their full-time position at graduation. An experience of 3 to 5 months duration was considered valuable.

This article focuses on the impact that face and/or neck tattoos may have on the employment screening process. With some estimates placing the number of possible candidates with tattoos as high as 28%, and the increase in social acceptance of tattoos, reveals that this research may play a significant role for the employer and the candidate during the employment screening process. Tattoos today can be found on men and women, with no limits on professional status and the tattoo designs can hold profound meaning to the wearer. This study examined the degree to which the predictive validity of personality declines in job applicant settings. Participants completed the 200-item HEXACO Personality Inventory-Revised, either as part of confidential research (347 non-applicants) or an actual job application (260 job applicants). Approximately 18-months later, participants completed a confidential survey measuring organizational citizenship behavior (OCB) and counterproductive work behavior (CWB). There was evidence for a small drop in predictive validity among job applicants, however honesty-humility, extraversion, agreeableness, and conscientiousness predicted lower levels of CWB and higher levels of OCB in both job applicants and non -applicants.
